The newspaper is using an insane title, yes, but the ruling itself can work for both genders.

I'm not impressed with the use of 'he' in that sentence, as although the case was against the male with a female as the victim, the same argument could be used if a woman had forced a male to stay in rather than withdraw.

Prosecutors originally decided not to charge him with rape or sexual assault, claiming it would be ‘impossible to prove’ his actions were not ‘spontaneous’.

They were told to review their decision after the judges decided it fell ‘within the statutory definition of rape’.

However, Lord Judge said that men who tried in vain to withdraw in time should not be pursued for rape, adding: ‘These things happen – they always have and they always will.

So basically it was rape because he willfully broke a term the consent and he admitted to it or so it appears. The judge clearly states that had it been an accident there would be no grounds for a charge

Don't plan to have sex anytime soon because of things like this. I don't see what the difference is between a vagina and my hand. People can laugh all they want. I'd rather not have sex with a girl, then have her say I forced her to do it. Screw that

I think you're taking it out of context, or rather misunderstanding it. My guess here is what they mean is, say you consent to sex, and then he just starts like trying to shove a bear bottle in you (which has happened), or insists on anal, etc. He gets more forceful with it, that kind of thing.

I guess my point is, the ruling (the way I take it) is to get rid of the old stigma against rape victims who were willingly with the person up to a point. I mean if you go home with a guy intending on sex, and then he goes fucking nuts, it's rape. Or maybe it's something else, but it's still a crime and we don't have a term for that 'something else' yet.

The article is about a woman being forced into pregnancy. This is essentially the counter part of sperm jacking. So, yes, this is indeed a nonconsensual sexual act, or, rape
