First ever on reddit so I hope I'm doing it right.

I was blindsided by wife's affair and her claim that she hasn't loved me in years. The sex was great. We hardly ever fought. We bought a beautiful home, went on trips, and she spent frivolously. If there ever was a problem, I absolutely would have gone to counseling. As fucked up as it is... I'd STILL go to counseling if she'd wake up and realize what she's doing to our family (daughter is 9 and son is 6). You've all heard this story before though I'm sure. I'm absolutely devastated, but I can't continue to live in this house and listen to her giggle with her boyfriend in the next room at night or essentially enable her affair by being with the kids while she has overnights with him. I asked her, repeatedly, and in front of her father, if she wants to work on our marriage and she said no.

My first question is... I'm right, right? Even though the affair is only less than 6 months old, and as much as it kills me to think about divorcing her... I gotta hear what she's saying, right?

2) I've met with lawyers. I think I'm gonna go the collaborative divorce route. Finances will be pretty easy to split (We're both teachers). Custody will be a fight but from what I hear her adultery doesn't mean shit, and even though I want (already take on) primary custody, she's gonna get 50/50 no matter what.

3) So how do I hire this lawyer? Do I take out a personal loan in my name, expecting my wife to do the same? I want to send my wife a letter of representation from this lawyer to let her know I'm serious. My wife drags her feet on everything. How do I get a hold of the $5,000 retainer?

4) Also... what else should I be doing to get started financially? My wife spends a lot of money. We have joint everything, but I thought all debts and income and everything were marital assets anyway. Is there any way to start legally separating from her financially NOW?
