In divorce all marital assets will be divided equally. The idea behind it is that you were able to go to work and make all that money and save in the 401k because your wife was at home tending to the family. If she had been working, you would have been paying a tremendous amount of money for childcare. So the money you saved from having her at home you were able to save. So it’s half hers.

I’m not saying I agree with this idea. But it’s the most equitable way to settle things in courts. I’m going through a similar situation. Married 10 years. Two young kids. Wife worked part time or not at all for about half our married years. I supported her to get back into the workforce when our youngest started school. She took online courses and I continued paying. Then she got her “dream job” and now makes more money than me. She cheated on me and left as soon as she got stable financially. So now she has very little in personal savings because she is just now making real money. So I have to split half of my retirement and pension with her even though right now she makes more than me and she will have a better retirement than me.

Fun fact- I also paid off her car and student loan debt. So she gets to leave this marriage with no debt and a great income, and a fully funded retirement. Fair, right?

Georgia divorce here, your feeling it because you are being taken to the cleaners. She came prepared with lawyer, its a mother state for most counties so be prepared for long term marriage alimony and childcare support plus 50% of all assets. Expect child support to be roughly 20% of pre tax gross plus extra curriculars etc and alimony to be another 10 to 15% if it hits. Your immediate goal is lawyer up and aim for a quick resolution to start building back.

In Georgia you can expect to pay her spousal support for one-third the duration of the marriage. That's on top of the child support which is a standard calculation based on incomes. Since she hasn't worked, you will either impute her income at full-time minimum wage or perform a vocational evaluation if she has a college degree she isn't using.

All of the home equity and money in retirement accounts that accrued during the marriage is a marital asset. If you owned your home or established financial accounts prior to marriage, then that portion is separate property (outside the scope of divorce).

My usual advice, take a sabbatical and declare zero income during filing (ignore comments which tell you prior 3 years pay history is taken into account), don't declare any financial asset she is unaware of, give a low valuation to your house. I get the feeling you've already declared all your assets. In that case just add up everything and divide by 2. Yes, the entire 50% of the 401K will be given to her, not just the appreciation. You could have avoided the situation by cashing out the 401K and paying 10% penalty.

Georgia is an equitable distribution state, so marital assets (including 401k contributions during marriage) get divided fairly, not necessarily 50/50. Her homemaker role matters legally. With 11 years married and her being out of workforce 6 years, alimony is possible. Also, you need a serious legal counsel, look into firms like marble law, hellams llc, etc

Get an attorney. Basically, she's entitled to half of everything. Family court is a farce, but fight for what you find most important and have a chance of winning.

Her being at home for the last 6 years not working.......kinda is tough in the fact that yes it's gonna be more of a financial load on you no matter how you look at it. How old are your children?
