So, if you're a woman and you have sex while drunk, you've been "forced" to have sex since you were drunk and cannot consent with impaired judgment, making you a rape victim.

If you are a man and have sex while drunk, your impaired judgment is not an excuse and you have... raped someone.

Really? "no answer means no as well"? So if someone doesn't explicitly give permission it's considered rape? Damn, I've been raping my wife for years and she always gives me a kiss and says she loves me after we're done. Apparently enthusiastically participating in, and even instigating the act of love making just isn't clear enough.

I never understood the idea of "drunk = impaired judgement." Of course, there have been studies and common sense dictates that someone who is drunk has very little self-control. However, someone who chooses to drink to the point of loss of self-control has chosen to drink until they have their judgement "impaired". It is a lucid choice to actively change the chemicals in your brain, understanding that it will make you make choices you might not make. If you choose to get drunk, and you choose to consent, it was your choice. No one forced the drinks down your throat; you knew that if you got shitfaced, you would make bad decisions. Society shows hundreds if not thousands of stories about the drunk guy who wakes up next to the ugly chick. If the girl is drunk, however, its always shown in a very shady and criminal light.

To my point about choosing to drink, consider this: A woman arrives at a bar. She stays for an hour, drinks 8 drinks (shots). She is drunk.

If she chooses to go home with a man and have sex with him (given she gave consent), then the next day she doesn't like him, she can accuse him of rape. She could not make a choice because her judgement was impaired, and any consent or decisions she made while inebriated are invalidated because of that.

On the other hand, if she just decides to drive home, she can be arrested and have her licence taken away. In this case, her judgement carried consequences, inebriated or not. She could regret this in the morning, but it doesn't change the fact that, in this situation, even though she was drunk, the law says that her choice to drive the car was her own and she must suffer the consequences of her choice.

Of course, rapes exist. If a drunk girl does not consent, it is rape. However, its really important to note that if a drunk guy does not consent, it is also rape. It's just important to make sure you do not trample on the man's rights while trying to help the woman, or vice versa.

As to many of the questions about if the man is also drunk, I believe in most places the "rape" will fall on the defendant. Whoever gets to the police first is determined the "victim." There are also laws in some places naming the person who weighs more as the rapist.

Forcing a woman to have sex is rape, even if you're drunk. A felony punishable by prison. The fact that your judgement was impaired is no excuse. No means no. And no answer means no, as well.

ALCOHOL ABUSE CAN LEAD TO SEXUAL ASSAULT

Honestly... it sounds very contradictory, but I really can't say it's wrong. Forcing someone to have sex while you're drunk is, indeed, still rape. The only objections I have are about the PSA being spectacularly confusing, the sexist part, and saying "taking a silent acknowledgement as consent is rape" (although that is still a very bad idea).

What pisses me off is that all the responsibility for actions is on the male. Females have no responsibility in these "rules".

If your both drunk and there are NO red flags ie being told no or physical resistance then it's consensual sex.

Get over it ladies. You are responsible for your actions not just us.

Passed out drunk is one thing but why is it rape if you've had a couple of drinks?
