Well, since my state requires use of force or the incapaciation of the victim by the defendant, I'd need to see evidence if use of force, or convincing testimony regarding it or evidence some non recreational drug had been administered. It's hard to make up your own fact pattern and then call it rape because crimes come in a million varieties.

I would look strongly at the speed with which the victim went to the police, her relationship to the defendant, the circumstances etc. A total stranger in a non traditional place for sex (alley), a rape kit and immediate seeking if help at hospital/police would go a long way

Like any other crime, there has to be some form of proof beyond a reasonable doubt - could be video evidence, a rape kit, witness accounts, a drug test (such as if the victim tested positive for Rohypnol), etc.

Rape victims should proceed immediately to police or medical centres if they want any hope of obtaining a conviction. (A hospital etc. Will swab you and keep the evidence on file without your committing to report so you can have time to think about it)

This should provide evidence as to sex taking place, some degree of evidence as to the consentuality of said sex. Tied with either forensic or logistic evidence to put the perpetrator at the respective time and place should be good for a conviction.

Unfortunately he said she said just isn't going to cut it as modern feminists have proved beyond reasonable doubt you guys aren't responsible with that power.

I think the idea that RedPill people are somehow against rape being a crime is really just a narrative. I'm down for convicting people of rape, so long as it's actually rape. If some guy grabs you off the street, yanks your panties down and takes you over a dumpster, ya dun' got raped, and we have a legal mechanism in place to hopefully address that with a conviction. If you went to a party, had sex, didn't make your lack of consent known and let him drunkingly jackhammer you anyway, you did not get raped, you just regret it, or your overly zealous feminist friends convinced you you got raped. These are the people that I'm ok with the legal system not taking seriously, or being particularly hard on.

The problem with rape is that it's now achieved a level of notoriety in our western culture as a "super crime". You're guilty whether you're guilty or not, she's an innocent victim whether she's lying or not, and the complainant so long as she's female, is completely above reproach. It's politically incorrect to question any of her decisions or motives, which is why we have this liberal mockery like "well what was she wearing?" and "#IBelieveTheVictim" or whatever it was, to insult people who would suggest women aren't always immaculate paragons in their usage of the justice system.

If I was a girl and wanted to plot against a man I could theoretically go on a date with dude and accuse him of rape immediately after intercourse. All I need to do is have a drink during said date which would allow me to say I was too drunk to consent and therefore been raped. Women can be very terrifying and their words can be more damning than sticks and stones resulting in you forcibly put in a cage.

If I recall correctly I think there was a movement to try to revoke consent long after intercourse if they find out you misrepresented yourself.

Note: Rape is a terrible thing. I am in No way advocating that all rape accusers are liars or somehow women deserve to get raped. I just wanted to highlight what may happen to you in real life when it comes to sex and laws and crazy people.

It really sucks.

It's not only one of the most horrible crimes, it's also one of the most difficult to proof.

Tbh, I can't answer the question. And yes, I know false rape accusations from real-life.

Guilt beyond a reasonable doubt.. Sadly with the event trend of false accusations it's getting harder to tell the difference between actual rape vs regret hookup..

The law doesn't allow charges to be brought up against women who falsely accuse men of rape.. They say this is to protect women, but it's having the opposite effect..

Physical evidence of use of force. Physical evidence, DNA, semen, skin samples. Believable, consistent, story from the victim. Any combination of these things in the proper context pertaining to the situation. PTSD in the victim means nothing to me.

if i were on the jury solid evidence, if theres reasonable doubt then I'm legally obligated to say not guilty.

More than one accuser with a consistent story would be pretty solid along with witnesses placing the accused in the right place at the right time, and an absence of defence evidence of collusion between the accusers.

If it was on videotape it would be compelling but unless the victim is vehemently saying no you can't really prove a lack of consent

Also if the defendant was proven to have lied in their own version of events

Bruising or a rape kit means nothing as roughness can be consented to unless the accused denies being there

A singular unchanging story from the victim is also not good enough

Also PTSD doesn't clear up the doubt

A rape kit would prove sex occurred and that she was uncomfortable with it in a reasonable amount of time to consider an assault.
A consistent story would decrease the likelihood she was lying.
Bruising would prove that some physical contact occurred at some point, it could corroborate but not definitively prove sex or unwelcome use of force.
Video evidence would be conclusive as long as it shows sex occurring and the victim clearly telling the perpetrator to stop, or made clear she could not do so.

I'd say video evidence would be most convincing, and would probably 99% result in a conviction. A rape kit is probably would result in a 90%, The story and bruising are both weak on their own (or even together) as bruising is circumstantial evidence and I can only assume the defendant will have his own, equally compelling story of consent.

Rape kits, but they aren't always reliable. I wouldn't say bruising, since some people do enjoy rougher sex. Video evidence would be good, but it's not logical to make that the one way since most people make sure they aren't being filmed when they have sex. A singular unchanging story is obvious, if the story changes, the victim is obviously lying.

In all honesty, I would go about making ways of changing the system as opposed to specific physical proof. In most situations, you can't prove rape, no one can. So you have to teach people how to deal with a rape accusations. Those people include police officers, lawyers, and especially judges. I find that a rape accusation is too often approached from a "guilty until proven innocent" stance. I've read too many situations where the judge gives the man the harshest possible punishment just to make an example out of him. In those cases, the only evidence that the judge had was what she said. It's ridiculous. In rape accusations, I would make it illegal for any information to be released about the judges, the lawyers or anyone involved in deciding guilt, and I would make sure that every accusation relating to sexual harassement or rape are tried jointly by both a male and a female judge. This would reduce bias and it would ensure that the people working the cases don't worry worrying about their professional reputation or their careers if they convicted or not. Rape and sex is a very sensitive topic, and the law should treat it in that way. The only things that judges and lawyers should be worried about when dealing with a rape accusation is whether its logical that it was rape or not, they shouldn't have to worry about their careers or what the papers will say if they convict or not.

What I would do is I would also increase education about rape. I would start teaching women that regretting a sexual encounter does not mean rape. That if you didn't explicitly say "STOP" when you felt pain during sex doesn't mean that you were raped. Men aren't mind readers, they don't know what is normal for a woman to feel during sex and what isn't. For example, I've heard that the first time can be painful for women. That women often bleed. So does that mean that every man that takes a woman's virginity raped her? How is a man supposed to know what is normal for a woman during sex and what isn't if she doesn't tell him explicitly when she feels something abnormal. I would make it illegal for newspapers to write the name of the accused until it is proven beyond the shadow of a doubt that he is guilty.

We have too much grey areas in rape, women think they can throw that accusation around when they make a mistake and sleep with people then regret it, men aren't even given a clear understand of how to not rape someone. All men are told is, "even if she consents, she may be in pain during sex, her job is not to tell you that she is in pain, it is your job to know that. It is your job to make sure she isn't drunk when she consents. And even if you do all of that, if she accuses you, there isn't really much that you can say or do to protect yourself". The responsibility shouldn't just be on men to "not rape", but also on women to not put themselves in situations where rape can occur.

Educating people in a non-biased way is what is needed. You can't just tell men to not rape and women to accuse men of rape whenever they THINK they were raped without having a clear cut definition of what rape is and a reasonable way for people to avoid both being raped and raping.
