I haven’t seen my daughter since Oct 11, 2019. Before that my ex kept her from for a year and half. My daughter is 8 as well. I wish this was the outcome I could look forward to when we finally get a court date in July but in Texas there’s not a chance. It’s absolutely ridiculous.

Fellow Texan here- my bio mother purposely kept me away from my father off and on and did everything she could to spite him, including taking him to court pretty much the second he had me back.

It was a long time, about 2-3 years, but keep evidence and stay on your toes and hopefully they'll see reason. They gave my dad full custody because they could see right through her bullshit. You've got this!

It’s possible, look into the “Albright factors” I don’t know if every stat considered these by my state goes by them and basically they go through them and keep score and whoever has the most factors in their favor wins

Similar situation here man. Been fighting since daughter was 18 months...she's 6 now. Long periods if absence due to mother's hiding her and weaponizing the custody process. Good luck in July! Hang in there.

I have mate.. twice lol but because my shifts at work I couldn’t have “set days” to see her every week so they just stopped me having her by coming up with reasons I couldn’t see her on my days off.. then when they gave me 3 days notice I contacted court and solicitors but by the time I got a court date they had moved to Scotland, turns out since they now live there the English courts can’t do anything and forwarded my case to the Scottish courts that was over 6 month ago and I’m still waiting for a follow up or a phone call anything really.. I’m afraid I’m out of luck until she’s old enough to choose to see me her self by the looks of it!

Yeah it’s not the best the worst part that absolutely rips me apart is I got married two weeks ago and she missed that and her brother and sister I have with my wife ask for her and ask to see her all the time and I can’t explain to a 9yo autistic child and a 2 year old that they can’t see there sister because my ex and there grandma they’ve never met ran away with her so I just keep saying we will see her soon it’s fucking awful but what else can I say..

Not my ex wife but my ex yes lol, she “couldn’t afford her rent” I had been separated for 3-4 years but had a child together I went away With my now wife on holiday came back and my mother had moved her in just for 6 month she said to save money until she can find somewhere else to live, that was 3 years ago I’ve had a daughter with my wife who my mother and her side of the family have never met and they have now moved away and are stopping me seeing my daughter... family ehh 🤣

I’ve heard stories of moms and grandparents showing up and just taking the kid and the police won’t do anything because they’re a legal guardian, I’d like to think this applies the other way around but I’m not sure I’d be willing to test it.

I can confirm that this works. When I split with my son's mom, we had a tentative agreement that I would have custody. We had both signed it and there were just a few details that needed to be ironed out before it could be submitted to the court. Before it was submitted, my ex picked our son up from daycare while I was working, filed a separate motion, and refused to give him back.

I knew her well enough to know that she would not be able to keep him with her all the time, even though she wasn't working or going to school at that time. Sure enough, a few days later I called his daycare and he was there. I picked him up, filed an emergency motion, and kept him with me 24/7 until the judge had signed it.

Nor should you test it. I haven't heard of this happening but I'm sure it does. And the police wont help because it is a civil matter not criminal so the only way to do anything is to go back to court. The entire system is fucked and it will never change because so many lawyers and judges like it this way because it keeps a lot of people employed.

I appreciate that. And I won’t stop. But moving in with family is not really an option. I have 2 other children with a different woman who I have a great relationship with and have no trouble getting on my days. I’m remarried and my wife has 3 children as well. We are a big family that my daughter is being deprived of being a part of. It’s fucking sad and I feel terrible for her. My wife and I make good money and I honestly think my ex thinks she will inconvenience me to the point I walk away. She doesn’t know how deep our pockets are but they aren’t that shallow and never will be.

I will give you some advice here from someone who went through this a long time ago. Stay in your kids life as much as you can and let them know you live them and want to see them. Your 8 year old will eventually be an 18 year old. And they will remember.

My son is 20 now, and we are best friends. He grew up realizing what was going on and now has almost no relationship with his mother, but ours is great. Kids are smart. They will figure it out. Your kid will need a real parent one day, just work on your life so you can be that parent when they need you. If you let what's going on affect your life in a negative way, you won't be in a good place when they grow up and need you.

Live your life, be happy, don't stop fighting, and know one day that if you do these things, it will payoff.

It’s been recorded. My daughter and I were even seeing a court ordered therapist that she picked out because she thought my daughter had anxiety when she had to come with me. Once the therapist started leaning towards her being the issue and not me, she stopped all sessions. She’s being called as a witness in July. I still have no faith the court will do anything but reiterate I have legal rights to visitation. She’ll go back to the court ordered schedule. But she will definitely do this again. I have no faith in the family court system. She should be in jail but they’ll never punish her.

Fellow Texan here. Whenever it’s your time, show up and ask to take your child. If she/he refuses, call non emergency and let them know you need to make a police report. Do this every single time. I did 3 months of this. I talked to my ex’s stepdad and told him that If she didn’t let me see my son, I would take all of my police reports to the attorney general and I will take full custody. That same day, she released my son to me and she never gave me a problem at all. You might have to actually take her to court but the judge will see that you are trying and give you more time and it’ll make her look bad. It never went that far for me. Best of luck to you.

My mother and father divorced around the age of 9. She went as far to make up lies about sexual abuse to keep me and my (twin) sister out of his custody. Eventually the state gave my father custody after about about a year, and we've not been back since.

My half sister (not the twin) lived with my mom until she was 15, she left when she got pregnant, yeah at 15... She was constantly doing all sorts of drugs for a long time. She has really turned her life around the past year and it makes me so happy to see it.

I'm now 20 years old, and I don't really see her as my mother. More like an aunt? I guess... I'm not angry I try to be above that, but it's hard to think that because of her selfishness I was robbed of a mother, and my father was almost robbed of his children.

I was young when it all happened so if things don't add up, it's probably because I don't remember all the details, and I don't like asking my father about it.

My husbands ex didn’t want him to have his kids either. KNOWING they absolutely adore him and love him so much. He’s the best father and she resents him for that. And now that he’s actually happy she doesn’t want the kids to experience a healthy relationship. We actually give them love and the time of day. She just sees dollar signs the more custody she gets. So we only see them on Sundays. It’s so sad to see her using the children to get back at him. She tells the kids he doesn’t want to see them and that’s why they only see him Sunday’s. So disgusting.

Ahhh, Australia, makes more sense now. I was thinking this was US at first and was totally shocked that it went this way. My ex tried more or less the same stuff during my separation and divorce. It worked out in the end, but it really opened my eyes to the wild inequality in divorce and custody law and precedent here in US.

The thing that really gets to me is that she doesn’t have a job and I have to support her but if I didn’t have a job she wouldn’t of had to support me. I just would have been an unfit father and not had any custody until I got a job. Ok, enough ranting about me.

I totally get why certain custody and child support and alimony laws exist, but if they can’t be written and enforced in a gender neutral way then they are just unfit for purpose. In situations like this case I always like to look into what’s happened in similar cases but where the genders were reversed. It’s so frustrating.

This sort of thing happening here is as rare as rocking horse shit. This is a story from 2014 so who knows what has happened in the intervening years?

Maybe the same as my mate who was given primary custody. The mother just kept the kids one weekend and wouldn't give them back. It took a year of court and thousands of dollars before he saw them again. Nothing happened to her. That was last year. Also in Australia.

This kind of stuff makes me afraid to have kids. You have no way of knowing whether someone is a decent person (or whether they will use the kids as weapons) until you're going through a divorce, and by then it is too late.

I think that collaborative divorce should be a mandatory first step, only proceeding to an adversarial process if the collaborative process fails.

When your lawyer has a financial incentive to not go for the "total war" mindset, they'll be more inclined to push their clients to a more just resolution. In the adversarial process, they have a financial incentive to fight over everything; the more the client dukes it out in court, the more billable hours they can charge...

It's the kid(s) that are the real losers in these shitty situations, they either have 1 or 2 shitty parents that will use them against the other.

I'm currently dealing with a situation like this, where the mother thinks she can do no wrong because she is the mother, and that makes everything she does right.

That’s how you know you impregnated the wrong woman, when her feelings take priority over a child’s needs. Avoid these narcissists at all costs. If you choose to have a child, it’s your responsibility to give them everything. That’s a selfish choice to have one and a child born into this world did not have any say on being born so why should the child suffer ?

I went for six months one time when my ex accused me of threatening her and my daughter. My lawyer, 7 grand later, proved she was lying and had the case dismissed but I never got the time or money back.

Yeah I feel ya man. Unfortunately my ex makes alot more money then me. So she's able to pretty much indefinitely tie me up in court. We were married for two years and it took three years to get divorced. The only thing we argued was child support and she eventually won since I couldnt afford to fight her anymore.

Did you read what I read?

The mother, over a 7 year period, carried out an unremitting campaign of interference in the father's court ordered visitation AND parental alienation.

So what was the penalty for defying repeated court orders, breaking the law, and harming her child?

She was "sentenced" to the exact same visitation and custody plan the father had before the change of custody.

In other words, the exact same custody scheme most father's get from courts is a fucking punishment when given to a mother!

Yes, it is a just outcome for the father to be awarded custody of his child, but it's just more of the same 'ol crap from a family court.

Only in the most extreme cases is a loving father given full custody of his child.

Standard should be asking the kid(s) what they want, where they want to live, how much time they want to spend with each parent, who they want to make decisions for them.

Then take into consideration what each parent wants out of it.

In most states, once a child reaches a certain age (usually 12-16,) they do ask the child what they would like the custody arrangement to be. You can't ask a younger kid, because they aren't likely to fully understand what a divorce is and choosing one parent can be traumatic.

My daughter understood by the age of 5-6, but it's a really long time to wait to reach that age, especially if your not happy where you are or the parent your staying with uses the child against the other parent.

My ex took me to court when she thought I was down and filed for sole custody. In my state if one parent files for sole custody then you can no longer come to a joint custody agreement.

She called me every name in the book like Disneyland dad and an absent parent. Meanwhile I said nothing bad about her and just told my story.

I think this was key in my success as she was obviously vengeful while I just wanted to raise my kids in a non toxic environment. The judge seen right through her bs. With no lawyer in a hoodie and jeans I won sole custody of my 2 girls on Nov 2017.

I hate how women use their kids as pawns. We're trying to win at least 50/50 custody for my boyfriend's child and his ex is just an absolute bitch and is wanting him to pay child support even though she said 50/50. When we told her that she would have to pay child support too, she refused to believe us even though we showed her the law. This is what stuck up bitches get. I wish we could get full custody like this, but living in Utah it probably won't happen.

Posts like these make me so angry. To have a loving father denied access to his child “just because”....

My ex is domestically violent.. hasn’t bothered seeing my sons in 3.5 years now. Says that “unsupervised visitation” is the only way he’s going to visit them. Over my dead body. You lost that privilege when you shook one of my children for crying when he was 2 months old... not to mention failing to lock the door so they got out into traffic 3 times on your watch, sitting on your phone/Xbox making them wait for food or interaction because a game/video was more important than they were. Oh and the suicide threats... the driving erratically saying he was going to crash the car and kill us all over an argument several times... the death threats..

I genuinely fear for my sons safety if ever left alone with my ex which is why I will fight. But if a man isn’t as mentally unstable, abusive and neglectful as my ex there’s no reason he shouldn’t be able to see his children.
