  1. Its not about proving the negative. She made public claims that were found to be unsubstantiated

  2. Those usually end up with convictions, presumably because evidence and confessions

  3. The claims were false, which is why the civil court ordered her to pay. You cant wrongly damage someone with an accusation that's true

  4. He die not lose rank, he simply did not get promoted. The army is under no obligation to promote an officer, especially when they're looking to get past field-grade. They must be impeccable in public view and in conduct. The accusation alone is bad enough. The army would have promoted him if she did not lie. The army is not on the hook for this; she actively tried to destroy his career.

  5. There is no "due process" because there was no criminal case whatsoever.

The thing is her wage won't be garnished as she doesn't have a job. I suppose they could do a bank levy, but that seems unlikely since she could've simply tranferred her funds to another family member. The only other thing I could think of is they could put a lien on her properties, but who knows what that's worth? Basically, her punishment is a lot of inconvenience and attorney fees. Hopefully, she's loaded and the Colonel gets some money out it even though it might not be in the millions.

Anyone can sue the military if you afford a good enough lawyer who can frame it in a way that the federal court will throw away the military's immunity. Nothing is ever that way. Lawsuit prohibiting clauses are thrown out or overturned all the time. All it takes is a judge who doesn't care that that clause exists and a lawyer to make an argument which sounds better to the judge than the law.

And this is where the notion of "innocent until proven guilty" comes from, but increasingly in cases like this, it seems you don't need proof, you just need to sound convincing.

While I would never suggest that historical rape never happens, I just don't think such late accusations (especially three decades later) should ever carry any weight. It's literally one person's word against another and there's literally no way to get proof to support one story over the other and to me screams of an agenda instead (as suggested by the article as well).

It's a classic dilemma. Two people are alone in a room, intercourse happens, one says it's rape, the other says it was consensual.

Since it's testimony v testimony, our laws go with innocent, if guilt cannot be proven.... That is as far as the law is concerned.
In Germany we had a famous TV personality lose his career over exactly this (woman thought she was getting a relationship, when he had a ons) so she cried rape. In the end court of law sided with him due to innocent unless proven guilty, but court of public opinion destroyed his career. So, the accuser still got what she wanted, pain& punishment on her victim.

Something like that happened to my brother in high school, when he started driving the gold diggers showed their faces.

One girl in particular thought she had her meal ticket, a guy with a nice car 1995 Ford Escort (this was 1999) from a seemingly upper middle class family.

Once she realized she didn’t have the guy she turned bitter and vindictive. One day she decided to go to the school liaison officer, with her mangina witness and claim my brother swerved the car (which wasn’t even his) at her as if he was going to run her over leaving the parking lot.

Luckily nothing really happened with it besides a few questions. The officer never believed the incident happened, as she quickly told on herself.

When asked if she wanted to press charges she said no. So why are you even bothering to tell the police if you want nothing done about it?

The court actually found that she gave false and negligent testimony. It's not that they couldn't parse the truth, it's that the case showed that she was lying. They found not that the accusation was unsubstantiated, but rather that it was false.

I feel like there’s a lot of assumptions made here, and the article didn’t really cover much detail of the situation.

It just said during the investigation, there wasn’t enough evidence to prove the rape occurred in the 80’s, which makes sense, because it was 30 years ago.

I’m totally for convicting and penalizing false rape accusations, but this just couldn’t be proven. It wasn’t that she admitted to making it up, she still claims it happened. It’s entirely possible it happened, and now she’s getting fucked again.

People really need to measure their emotional reactions with shit like this.

If I recall, she claimed they'd been drinking in a mess hall, after which he'd offered to drive her home, but he took her to a secluded underpass on the base, dragged her out the car and raped her.

His version was that alcohol was strictly forbidden and drinking was grounds for expulsion. So boozing in the open in a mess hall wasn't possible.

Also, juniors as he was then weren't allowed cars on the base.

And, the underpass was bricked up for most of the 20th century and only reopened in the 2000s.

All of which he was able to verify.

Finally, she claimed she had no idea he was about to be promoted when she made her blog post. His lawyers proved she did by conversations she had with others that she did.

After two hours of deliberation, they decided something that happened 30 years ago wasn’t true? It was a defamation lawsuit. It could go either way and largely depends on how much money you throw at the situation. That’s the way law works in America, if you haven’t noticed yet.

I’m just saying, she didn’t say she made it up. If she did, that would be grounds for a false rape accusation. She didn’t. She claimed she was raped 30 years ago, and couldn’t prove it.

Side note here: I spent about 4 1/2 years in the Marines, and met a few Colonels in my time. They are incredibly powerful and intimidating people, even on the civilian side, and don’t get that far without making a few friends. It doesn’t detail her military career either, interestingly.

The article just also looks and feels like garbage journalism, not even exploring any details of the situation. It’s literally garbage made to generate strong opinions, which generates money.

Having some sort of objectivity in these sort of things is helpful.

After I was molested when I was 12, word got out around my school. The bullying got so bad I had to move. I could get into the stress and anguish of the court process (imagine sitting on a stand while every single bad thing you've ever done is spoken and held against you in front of what seems like 100 people), but that was too much to bear.

Along the way, you see psychiatrists, lawyers, and doctors, who pick apart and scrutinize every part of your thinking process. Everything you say is held against you at some point. And ultimately, for what? Maybe the guy will get a week in jail and put on the registry. That is, if he's not acquitted.

So when my best friend was raped as an adult a few years ago, and she told me that she didn't want to press charges, I understood. But he ended up going to prison last year for brutally raping a young teenager and trying to rape another. So I guess, the whole system could use some reform.

She was used for defemation of character in which case its 100% on her to prove her accusations. His only burden of proof is proving damages from her statement (passed over for promotion).

Civil courts generally require a perponderance of evidence to reach a conclusion (what would convince a reasonable person). This is less stringent than ,"beyond a reasonable doubt". She actually had a lower threshold to overcome and she still FAILED. That actually makes her look even worse.

Irrevelant to thise case. This is a defemation of character case. The alleged rape is a specific act which did or did not occur. She carries the burden to prove it since she said it. His burden in bringing the action is to prove that he suffered financially from her statements.

There would be no verdict in which said he was determined to be x% a rapist. Or a verdict in which she was raped but was at x% fault.

If she had made multiple statements and he was challenging them all its possible that she could prove some and not others. But it does not appear so in this case.

When confronted with all these details she changed her story. The jury concluded that the accusations were entirely fabricated, which is why they returned such a severe punishment.

A jury did find her guilty of defamation, thus the judgment. He had to prove it was more likely than not that she was lying. I think many of us get angry at this because we know people who've been falsely accused. I know a guy who was railroaded by a corrupt prosecutor who was later disbarred. The scumbag DA threatened my friend with serious jail time so he pled guilty to a crime he didn't commit, all because his bitch of an ex was angry he didn't want her back after they'd broken up as he was dating someone else.

That being said actual rapists certainly deserve severe punishments, but I think due to political pressure they're going too far in the opposite direction like with my friend. His ex had no proof and he had no motive, but she nearly got him expelled and sent to jail by her accusation alone.

I don't think most people are actually trying to troll on this situation. I believe that the reason this phenomenon occurs is purely due to the nature of empathy. It is far easier to feel empathy when you can imagine yourself in the situation, and most men have a difficult time immagining being raped, or being a rapist, but we have all been falsly accused of something in our lives. This makes this the instance that is easiest to feel empathy for, and stirs the deepest emotional response. I believe most of these men would exhibit far more anger against a rapist if they catch them in the act, especially if they are attacking someone they care about. (And most men in such situations blame themselves for failing to protect the women in their lives.) Emotions are complicated, and they often really suck for everyone...no need to villianize people for theirs.
