"The 1988 CJA was wrong to repeal the defendants' right to anonymity. Anonymity should be given to both until the trial ends and then, if guilty, the defendant is named. If not guilty because of insufficient evidence then both retain their anonymity. If not guilty because there is sufficient evidence to demonstrate that the accuser deliberately lied then they should be tried (perverting the course of justice, perjury) and, if guilty, lose their anonymity. Unfortunately the identity of the accused being on public record is important, it prevents secret arrests and secret courts from operating. By knowing the identity of the accused we know that the police and courts can't just make them disappear.

The problem isn't with there being a public record. The problem is with the media and others publicising this to essentially suggest somebody's guilt before a guilty verdict. That is what needs to be illegal.

I don't know about the USA, but in some countries you are not allowed to name a child in any media report about their alleged crime. The same should be the case for people of all people of all ages, until they are found guilty.

Except there is almost no way there would ever be sufficient evidence that the accuser falsely reported a crime. The only thing this would do is prevent victims of legitimate rape from coming forward. I am completely with you on both parties retaining their anonymity, but opening up victims to being prosecuted for being abused is not right.

I think there are cases in which women maliciously lie for personal gain. This includes child custody, money, fame. In the cases it is done maliciously they should be prosecuted.

The problem is that this is nearly impossible to prove without getting them to admit it. What's to stop an overzealous police officer charging an actual victim just because of a major lack of evidence? If you open this doorway, actual victims will be harmed. I agree that if it's discovered that the victim outright lied, then you should charge them with filing a false report, but if you start going after women in terms for the act of reporting rape, it will not end well.

There are many ways to prove lies. They're called evidence. The problem is that sometimes, lack of evidence for a trial seems to be enough to prosecute someone, or even "He did it" and a pointing finger.

You can't say no conviction = false claim though because a lot of times there simply isn’t enough evidence to convict someone. That doesn't mean they are automatically innocent of the alleged crime but simply they couldn't say that person did it for certain. It's a grey area.

I want a person male or female who is accused of rape to have their anonymity until proven guilty but not because of misleading information being spread.

OJ is one person and OP is making a claim about 20,000 people. All I'm saying is a lack of evidence to convict does not equal a false claim.

If anything there was sufficient evidence to convict OJ and he got off. Which only further leads me to think that just because someone wasn't convicted doesn't mean they are innocent. Every case is situational, there is no one size fits all. Not all rapists are punished and not all falsely accused people are free after their trials. Framing it as one extreme or the other is the problem both sides always miss. Your agendas don't mean anything, only the truth.

While I agree with the sentiment, I think this is missing the point.

The real problem is not anonymity - the problem is the nature of the police "investigation", and the evidence-free show trials that result.

Being anonymous does not protect you from a malicious prosecution and trials that lack any kind of procedural fairness or evidentiary requirements.

Police don't actually investigate rape claims - they take the accusers statement then start working on framing the man for prosecution. They will activity ignore, or even suppress evidence that might help the accused.

In normal cases, if person A accuses person B of something, and person B denies it, police will treat both claims equally, and investigate them from all angles. As a matter of malicious policy, they will not investigate accusers for lying - unless they are hit with blatant evidence as to the fact.

In many ways, anonymity might work against men, by leading to less coverage of the real problem - the abolishment of fair trials and impartial police investigations in cases of sexual assault only.

The outcomes are fairly the same. Even if you are found innocent or guilty, your reputation is ruined.

But let's try to be realistic here. I think privacy and anonymity are getting every day smaller, and harder to retain for individuals. How much anonymity can we expect from the law, considering present media and technology? Shouldn't we reconsider that our position in our communities are indeed, in some degree, very much public nowadays, even if we like it or not?

2500 of the 22500 allegations each year in the UK results in a conviction so I would go with 89% of all allegations of rape are false!

If you look at some of the dubious outrageous marginal cases the CPS brings to court and then consider the ones that are too outrageously false to even put before a court, like 17500 of them! The vast majority of allegations must be false. 5000 appox cases are put before a court but only about half result in a conviction.

As for false allegations the CPS applies a different criteria to bring a prosecution the bar is much higher.

The CPS only prosecutes false allegations of rape when their is a public interest and a 100% chance of conviction. There has never been a prosecution for a false allegation that has not resulted in a conviction.

You obviously do not know how the CPS and the investigation process works. Appox 5000 cases go to court each year and a conviction is given in about 50% of the cases. The person making an allegation of rape receives compensation money from the criminal injuries board. Making false accusations of rape has become a way of making money .

In the UK the CPS prosecutes every case of rape that they believe actually happened. They spend most of the crowns budget on prosecuting sex crimes. In the current climate there is not a chance they would drop a claim if they did not think it was a false allegation. No you are absolutely right there are some grey areas. And I have no doubts that some rapists do escape justice. I am trying to counter balance the feminist hysteria. What I have seen of the CPS they prosecute even marginal cases hence the very low conviction rate in court 50%. So what on earth are the cases like that they do not prosecute? Some women see making false rape allegation as a way of getting preferential treatment in exams for example or in housing or getting custody of children. They even get money from the criminal injuries board. Including "wolf whistling" as a sex crime is hysteria.

1) The CPS prosecutes the most ridiculous cases. So imagine how ridiculous the ones they do not prosecute are.

2) Most of the CPS budget goes on prosecuting sex crimes.

3) Women who make rape allegations receive money from the criminal injuries board.

4) Women who make allegations receive a whole raft of help schemes and benefits.

5) Women often make false allegations to gain custody of children etc.

I could go on. You are the one who is being a simpleton to not recognise that a whole industry of false allegation has sprung up.

I agree with what you say. (And a US sheriff said the same thing recently.) The main force behind this sort of thing is the feminists claim that about 300k rapes are being committed in the UK every year. This is based on a poll(!) of about 4k people whose claims are taken as FACT, and then extrapolated to a population of over 57M to include rural villages which haven't had a rape in centuries. There is no evidence that a single one of the claimed rapes has taken place (although some of them undoubtedly have), yet the extrapolated figure is claimed by feminists to be fact. Thus, the police and the DPS end up going to extreme lengths, such as prosecuting commuters on the basis they must had raped someone during the one and half seconds it takes to walk past someone on the tube in an effort to find these phantom rapists. That's how it works.

There should be no anonymity in law. Except maybe for minors. It should be as transparent as possible.

TBH Peter Hitchens persuaded me. I'm a lefty on most hard issues, but he speaks a lot of sense. When you look past all the nonsense and hysteria, it's perfectly sensible that the law should be as transparent as possible.
