Maybe if the money was used on something like bills, or rent, or her children or something, the court would have taken pity on her "I only make this much a month" idea. But she went and spent it on unnecessary designer clothes... If you only make so much a month why would your first instinct be to throw away all this money on designer clothes.

Her argument is that she is being punished for her appearance. I don't know mush about banking industry regulations in the UK, but banks are usually the most litigious of institutions. It is highly unlikely that a bank or it's employees would ever advise her to spend these ill gotten gains. They could easily pull up routing information on her account to determine the bank/financial institution that the funds came from, make an inquiry and simply determine that validity of this transfer. The UK and Europe have something similar (ABA, IBAN or swift numbers). She just wants free money.

i definitely would have taken some of the money. She should have to pay it back, but it's kind of ridiculous for them to tell her that she has to go to prison if it's not paid off in a timely manner. The people who fucked up and accidentally deposited a shitload of money into the wrong account need to accept responsibility. Telling her she has to go to prison is tantamount to debtors prison.

If a councilman had left 80,000 in a taxicab and someone had found it, then the councilman would be blamed. I don't see how depositing it in the wrong account is any less stupid.

I once deposited a check and the bank accidentally added it to my account twice. Later when I saw my balance, I thought it was too high, so I told the lady it seemed too high and asked her to confirm that it was the balance was correct, which she did. So I go about my life believing my balance was higher than it actually was.

Then I got an overdraft fee because they corrected the mistake without saying anything to me. peckerpass denied :(

If her account of events are true, then she didn't do anything wrong. If she actually asked the bank where the money came from and they told her they didn't know, then she assumed it was gifted to her which is fair.

She paid off a few bills, bought some nice things for herself and saved the rest. A perfectly human thing for to do.

It's absolutely ridiculous that they made her pay interest on their mistake. That's just bullshit. On top of that, the interest is at a completely exorbitant rate for the time frame. Hell why don't I just "mistakenly" deposit money into someone's account and then sue them for it with that kind of interest rate? Much better than any savings account.

To be honest though, bank made a mistake. Bank has no case here. This has nothing to do with her being a woman.

i think that if someone makes a mistake and gives out money, it should be on them. the district council made a mistake and it shouldn't be on this woman to make up for it. i do think she should return the unspent amount though.
