Looking at an article about the matter I’ll try to give a factual rundown.

It is still unknown whether Smith wanted the money (she denied it), he asked her multiple times to marry her, and then left her out of the will?!?! Don’t get me wrong, he has the right to do what he wants, but that still seems just a little off to me but eh. He died a year after marriage. She filed for bankruptcy after losing a case against her for sexually assaulting the nanny who took care of her son (horrid, I saw people saying she seemed nice in the comments here). Prince Marshall (his stepson in the will) was the one person that didn’t do anything wrong at all in my opinion, he just fought the case honestly. Also, there was another son Marshall disowned who helped smith briefly.

My opinion is that if she was the guys spouse when he died, then she should get SOMETHING from his estate even if she wasn't written in. The marriage itself should serve as entitlement to something. Maybe not the whole estate because he had other family to take care of, but if the two of them were willing to get married legally, that should show some sort of obligation to one another and should be respected.

She, then her estate, then her daughter fought like hell for a piece of that pie and eventually got nothing. Which was what they deserved. The case went to the US Supreme Court twice and to federal, state and bankruptcy courts countless times. As usual, the lawyers were the winners.

I'm pretty sure remaining members of the Marshall family are still fighting over the money.

In the US it's very hard to disinherit your spouse, or even choose another beneficiary for your life insurance if you're married. It's a theory left over from the days when most women stayed home and raised the children. Even if a little antiquated, one should probably be discussing all these things with their spouse and in that process filling out the necessary forms to have the funds dispersed elsewhere if that's what they agree upon.

The beneficiary of my life insurance is a trust, and the trustee is someone other than my wife. We agreed to this not only to avoid some taxes, but also to avoid the kids getting a huge check when they're 16 (theoretically) and spending all the money on fast cars and fast women. If that's what is going to happen I'll do it. Anyway, we met with our attorneys and signed a bunch of forms in the presence of witnesses, and had them notarized.

My guess is that Nicole knew all this but figured she'd get several years of living really well while he was still alive, and a few million on his death. But changed her mind when he died and some attorney said that she deserved more.
