I think it would all depend on the legal and cultural climate where you are. I have had my share of public sex, the main thing I watch for is to make sure that there are no kids anywhere around. I find that under those conditions, people are pretty casual about it.
On some nightclub dance floors in particular, sexual assault is basically normalized. Guys moving through the crowd, grinding on women, and groping them without their consent. Clearly sexual assault by any legal definition, but basically accepted, the bouncers might throw an extreme offender out, but no question of charges. Most people consider sexual assault more serious than consensual public sex.
