I remember this story from about a year ago. While it certainly sucks that a police department would pursue something like this, and even worse that a judge would approve, it's comforting that there was such an outcry that they were forced to back peddle. The reaction was not only virtually unanimously negative, but quite outraged as well. The public was well ahead of the legal system (or at least Virginia's legal system) here.

The teen is facing two felony charges, for possession of child pornography and manufacturing child pornography, which could lead not only to incarceration until he’s 21, but inclusion on the state sex offender data base for, possibly, the rest of his life. David Culver of NBC Washington first reported the story and interviewed the teen’s guardian, his aunt, who was shocked at the lengths Prince William authorities were willing to go to make a sexting case in juvenile court.

We see this sort of thing a lot - ignoring the spirit of the law and pushing the literal interpretation of it to the absolute limit, always in the same direction too. "Child pornography" indeed. The police are in the possession of it too - and in this case wanted to manufacture more - but this ridiculous interpretation is never applied to them. Why do they push this so much?

“The prosecutor’s job is to seek justice,” said the teen’s defense lawyer, Jessica Harbeson Foster.

Well, that would be nice.

It's encouraging to see common sense and discretion being used in cases like this, even if the initial approach taken was absolutely bat-shit insane.

I am often critical of people here who make false double standards, but I remember this case well. There can be no mincing words in this case: it is a shameful sexist double standard. Both parties engaged in exactly the same conduct. Both took photos of themselves while they were minors. Both shared those photos with the other. And yet, despite identical behaviour, the young man is charged both for producing child pornography and possessing child pornography.

The Law looks like an ass here, and thankfully, it seems the police department came to its sense, and despite obtaining a warrant, decided to never serve it until it expired. Someone with common sense, and authority, clearly got wind of this travesty.

Edit: and to add - I said it before, and I'll say it again. Forcing a man to have an erection in order to photograph it is incredibly twisted. Creating child pornography as evidence to convict a minor of making child pornography is twisted.

Correct me if I'm wrong (I'm not a US citizen) but quick check on the Virginia laws says:

In Virginia, the age of consent is 18 years old.

But:

Close-in-age: Virginia has a close-in-age provision, which allows two minors who are both below the age of majority to consent to sexual activity with one another. Under these provisions, minors between the age of 13 and 15 can consent to sexual activity with one another. Similarly, minors between the age of 15 and 17 can consent to sex with each other.

They were exactly the same age group that allows them to even have sex. And the "laws against sexting" are suspiciously missing. So why exactly was this even classified as a crime at all? They are allowed by the law to fuck each other's brains out but they're not allowed sexting because... reasons?
