Ok, so law wasn't the appropriate wording. Noted; and I will edit it after this post.

According to the district website, they do recognize that the recording was not done in front of the children, due to having the teacher in the room with the performer. The outrage is from the altering of the video AFTER the fact, so technically, the children were released by their parents to be recorded for him playing "Lunch Lady Land".

I am going to revoke what I've said, because I was misinformed. I still personally feel that there should be some sort of consequence in altering the data after the fact to make it look like he was singing inappropriate things to six and seven year olds. Again, he shouldn't be labeled as a sex offender or do 20 in prison, but he does owe the school, the parents, and the students an apology for what he did, at the VERY least.

I'm actually really pissed that this comment, which makes the most sense in regards to the issue at hand, is at the bottom, downvoted by the hivemind of "OMG HE DID NOTHING WRONG AT ALL".

Folks: You have to have each and every child that is going to be videotaped be signed a waiver to video-tape by their parents or guardian. It protects against using the children's faces for commercial gain, and also to prevent things like this from going on.

What he did was recorded them listening to an appropriate song, "Lunch Lady Land". He then went back and edited the audio. The problem isn't the fact that "he didn't sing it in front of the kids", because he didn't sing the sexually explicit song to the children. The problem is that you can still see the children's faces in the video, but the video is now associated with something sexual rather than "Lunch Lady Land".

Now, he shouldn't be labeled as a sex offender for it, or serve 20 years for it. I think what he should be required to do is to make a public apology for deceiving the children, teachers, parents, and administration, get charged on the civil front by truly irate parents, and then every one goes on with life.

Michigan law also makes it a crime to "install, place, or use in any private place, without the consent of the person or persons entitled to privacy in that place, any device for observing, recording, transmitting, photographing, or eavesdropping upon the sounds or events in that place." Mich. Comp. Laws § 750.539d. The law defines a "private place" as a place where a person "may reasonably expect to be safe from casual or hostile intrusion or surveillance but does not include a place to which the public or substantial group of the public has access." Mich. Comp. Laws § 750.539a.

If this guy has a decent lawyer, the fact that the school gave him permission to record might be enough to satisfy this.

AFAIK, there are no laws saying people have a right not to be offended, though they certainly act like it.
