If you inherited it, the car is probably legally yours. In most states that I know of, inheritance does not become marital property, and something like a change of title would have to be registered. A mere signature on the form isn't usually enough.

I would also recommend that if you have a phone conversation where she makes the same admission again, that you record it.

There are statue of limitations but it depends on your state. And does she have any proof? A picture of a bruise doesn't really prove anything, and she might even be bluffing.

Get a criminal defense attorney and a private investigator. Here is how I suggest this thing goes down:

1.) Get a defense attorney, ASAP and tell him/her the story.

2.) Say you're going to turn yourself in for punching your wife.

3.) Call the cops about the stolen title and admit to hitting your wife.

4.) Here is when things get tricky, you're probably going to jail.

Its not a good outcome, but, you committed a crime and you gotta pay for it... On the plus side, you will have your car back.

Her threat about assault is weak, it's going to come out in the open anyway, but you say she hit you, so I reallly hope you have evidence of some kind assault charge for assault charge.

Gonna be blunt about this though, since she's a woman the court will very likely be in her favor, I just hope you get a good lawyer, and asap.

On the other hand, its impossible for cars to change hands like that in my country, so I never will.

And @anybody else here who keeps his title in the glovebox: Dont. Thats not where it belongs. If a cop wants to see the papers, a copy is enough. The original should either be in a safety deposit boxx, or, you can get a decent, fireproof safe that is big enough for all your vital documents for <100$.

See, this is why if I even have a shred of proof divorce is coming my way I go into self-destruct mode and destroy, sell, give away, and otherwise leave myself with nothing for my ex to take, especially my pride.

It's a "scorched Earth" policy that didn't fail me once before. I never had to go to the extremes, but they were as follows:

Vehicle = wreck it (she did that because she was an already crappy driver and likely drunk at the time)

House = burn it down (didn't have to because she was moving back home with mommy and daddy)

Alimony = don't work ever (didn't have to worry because I was just getting out of the military and we weren't married long enough for her to claim it)

I'd rather go to jail for that than see an ex reaping the benefits in material and monetary wealth.

Stop admitting to hitting her. Yes it was wrong and what not but it is going to come out in court. Hopefully by then you can afford a lawyer or get one to rally to your cause. If she does destroy the car it is possible to pursure charges and damages afterward( I know that's small consolation but it's something) if you can get a lawyer then. If she doesn't have proof of any abuse then it will be harder for her to use. Granted since courts are slanted in her favor anyway, there is no need to help her sodomize you and you belongings. It seems like you're trying to be the better person and own up to your wrong doings but stop. She obviously doesn't care about you and you don't need to give her any evidence she doesnt have already. Conversely, gain as much evidence as possible against her and please please please get a lawyer. Record calls, record everything. Bank account statements, bills, anything. Somethings will be unusable but its better to have something you can't use than not have something you can. Most importantly, stay strong and don't give up hope. Even when things look dark, you will end up ahead in the end. She sounds like a horrible woman and no one wants to end up with that so you're better off without her. So yeah I'm not lawyer but that's my 2 cents.

You are screwed. She has photos from when you hit her, and the emotional abuse is flimsy provocation unless you are yourself a woman. If you get her for stealing the car she will get you for assault, so i don't see how you can do anything except have the good sense to never marry again.

She committed theft and she is blackmailing you. If you can record her or get e-mail/text from her saying that then you have evidence. That can help make her look pretty unstable in the eyes of a judge, and possibly like the kind of woman who would invent a story about being hit.

Not saying you shouldn't be ashamed, you were wrong for what you did, but if she's going to play hardball (i.e. steal your car) she better be willing to play hard (i.e. face charges and accusations herself).

BTW call another lawfirm and ask for a free consult -- you already learned something from the first one. Then a third... :)
