I had a hearing a couple of weeks back where my STBXW asked for exclusive possession of this house. I fought it by noting that there was no history of violence in our relationship, we had already co-habitated for 3 months of the divorce with no major issues, and that we didn't have the financial means to support two households. Her motion was dismissed.

Fight this will everything you can, as losing it is going to make the rest of the case a lot harder for you.

I just got out of court myself over child custody issues with my ex. Just know this she says it you say the opposite there’s no evidence, unless there is actual evidence. It’s very very very common for someone to lie to try to gain advantage on things like child custody or money.

Judges like accurate, detailed and legit information. If you have anything written like texts, emails, notes, and video of your solid parenting… or the bad of her being a lair etc. do they allow character statements for other parents? She a cheater?
Is she on any mental meds, drinker, drugs Pull out all the dirty info on her and substantiate it.

You say your honor, never interrupt, (which they demand and if you don’t that’s a big strike against you) and say good morning etc. judges can access character if they are good. So present yourself as a good dad. Even when she is lying. Your response when given the opportunity should be. “. I would just like address the fabricated statement by my wife….”

Serious question, how do they expect you to ever see them without contempt after pulling this play?

To a lesser extent do they also not care at all if your response is to NOT fight passionately to remain in the kids lives?

I mean all of sudden I’m wholly unfit and you should have FULL (usually) custody of the kid I see and parent every.single.day?

Is the extra lump sum and monthly money the motivation? Is it worth it?

Is the need to craft a believable narrative to offset her (usually) cheating that strong?

Why can't you file to her removed from the house? Tell your lawyer to not just respond to whatever she is doing but to actually come up with some ways beneficial to you. Also if you get removed I would contribute 0 financially to her, no paying for the home no paying for any of the bills. If you have to get out because she wants to be king of the castle then she can fucking handle it. If I was you I would tourment that bitch on the daily with anything that upsets her, I would attack all of her insecurities relentlessly. These fucking stupid laws honestly. Why can women have 0 repercussions for their lies and fucked up behaviors
