The point of an analysis is to move that statement away from sentiment and observation, and towards fact and defined truth. One might notice a car is beginning to get worse gas mileage but it helps a lot if you can tell the mechanic it went from 28 mpg to 17.

I don't think false rape accusations are central to this story though.

What I think is the biggest victory is this part:

“The fact that court martial appeal court has imposed an immediate prison term on Caroline Salisbury sends out a strong message that teenagers have a right to be protected from sexual abuse.”

An appeals court stating absolutely that teenage boys deserve to be protected from abuse and making it absolutely clear that women who commit this crime being given a slap on the wrist is unacceptable will hopefully influence how prosecution of these kinds of cases are handled in the future. And by showing that they will be taken seriously, hopefully protect more vulnerable kids from this kind of abuse in the future.

Yeah, but this appears to be under some military court martial rules. They tend to be different from civilian courts, so I'm unsure how well this works in that regard.

From what I understand the initial sentence was passed in the military courts, but the appeal was handled in civilian courts. Which would hopefully set a precedent for all future cases, both civilian and military, in the UK.

I could be wrong though as I don't 100% understand the British court system.

It does not set a precedent. A judge still has a great deal of discretion. If the military court had given her 3 months custody the case could well have not been overturned.

But that detail aside, I would like to point out this broader problem inherit in the way all underage sex cases involving teens are portrayed. We are jumping the gun by insinuating that the boy was forced to be involved when in reality we have no idea what actually conspired.

That's what really irks me about these cases of teenage sexual abuse. I was a fourteen year old boy once. If a somewhat attractive (read: not butt-ugly) mid-20s lady started messaging me and trying to initiate a sexual relationship, 14-year-old me would have been ecstatic. Like it or not, fourteen year old boys are excessively horny. I can't speak from personal experience, but I know teenage girls have many equivocal hormones raging as well. While I'm not condoning underage sex with minors, I am questioning the way they are immediately framed as innocent rape victims by the media and general public without any details to back it up. The reality is likely much more complex than that.

It's okay to accept this fact of life. Nobody is going to rightfully call you a pedophile over admitting that teenagers are horny and many would gladly consent to sex with an attractive adult.

I think you're misunderstanding. No one's saying he was forced to be involved.

The idea behind statutory rape is that he consented, but the consent was coerced or manipulated because he is not grown up enough to make that decision for himself. Being horny has absolutely nothing to do with being intelligent enough to make decisions like this and avoid being manipulated by adults. In fact as manicmonkeys pointed out it makes you even MORE vulnerable to this kind of abuse.

I don't buy that. Unless I was genius level intelligence when I was 14 (which I doubt) I was more than capable of making my own decisions. Plus, 14 year olds fooling around with each other is pretty common. Is that sex less damaging? Or does it only become traumatic when the other person crosses 18, or 16 or whatever the local watershed is.

it varries from person to person.

heck it is entirely possible i'm being unfair and you happened to be perfectly capable to make that choice at 14. you would then be a massive exception.

the law is too concrete to not have a distinct line. so we need a line and it's gonna be arbitary. if we say 14 is good enough way to many not ready people get's left behind. just as if we say 18 arguably we are to strict even if at that point some people will still fall into holes.

i can't tell you what time and age precisely. but i can tell you that your claim that it's 14 is wrong.

Keep in mind when you answer that for the majority of our history we didn't wait until 18 for marriage, kids and the responsibilities of adulthood.

Well I would support Romeo and Juliet laws to make sex legal with someone 2-3 years older than you regardless of your age.

I think 18 is a good age because it's the boundary of high school. You generally have to do a lot of growing up after high school and the difference between freshman year of college and senior year of high school is bigger, in my opinion than between even 6th grade and senior year of high school.

They might be, but who can you blame here? The idea is that they're both equally vulnerable and susceptible to manipulation so you can't really punish one. They're both in that stage of growing up, discovering their own identities, etc. It's unlikely that one is actually preying on the other.

Whereas a kid and an adult is one kid going through that developing stage and an adult taking advantage of that for their own sexual gratification.

Now personally, I don't like the term statutory rape, applied to either men or women. I realize words only have the power we give them, but I don't see having sex with a willing immature person to be nearly as bad as having sex with an unwilling mature person.

I'd tend to agree. I think there should be a little more nuance in assessing whether an adult (male or female) having sex with a teenager is actually causing anyone harm. As for the whole "they're not emotionally equipped to handle it" BS, if that were true we'd have died out as a species long ago.

Certainly a teacher should immediately be fired for doing something like this, but I'm not sure criminal prosecution is the answer. That said, if she were investigated and tried to falsely claim the kid raped her, she should absolutely be prosecuted for that with the same vigour they would have prosecuted him.

part of the punishment for adults who have sex with kids is that you are 'branded' a rapist or pedo or whatever. One of the many reasons why men and women are unequal before the law is that women are very rarely labelled these terms and therefore never have to deal with the shame.

Legally, in the US it's rape. I don't know about the UK. But morally it's really not rape. The boy is 14, capable of making decisions. Not legally allowed to consent, but that doesn't mean it's rape. Just as a 14 year old girl can be fucked without it being rape, even though in some more prude countries you would commit a crime.

That's why I used the distinction of LEGALLY and MORALLY. Rape has a definition, and is present as a legal term, and the two are very different. Or more precisely, the word consent is the differing part. You can consent to sex without the legal system acknowledging your right for it. Consent is saying: yes, I want it, please do it. Legally it's only consent if you are over a certain age (and there can be other conditions too).

But many legal systems don't call it rape. They call it sex with minors. If it's sex with minor AND rape, that's a more serious crime.

The age of consent in Germany is 14, so this sounds like a case where if she had been a German citizen having sex with a 14 year old British male on German soil she would not have been committing a crime.

Sex tourism involving minors is illegal under UK law, for very good reasons.

She was working as a bus monitor, escorting the children of other soldiers to and from school. She befriended the boy and exchanged messages with him via social media sites.

It's unclear here, but she may have been in a position of responsibility over the boy, which would make her actions illegal under German law too.

She probably wasn't on German soil, though. They likely lived on a base, meaning she would be subject to British law, or more likely British military law.

The age of consent in Germany is 14

Only if your sex partner is 20 or younger.

If a 14-15 year old has sex with someone aged 21 or older, the younger person can (optionally) choose to complain that they were taken advantage of and have the older person charged. Once someone turns 16, this part of the law stops applying.

This woman was 25 at the time, so even in Germany the boy who was 14 could choose to complain to the cops and have her charged, because she was over 21.

In addition, if she was in a position of authority / responsibility over him, it would be illegal regardless as he was under 18 (teacher-student etc is illegal until both parties are over 18).

It used to be much lower in some places. For example Portugal was 12 until recently afaik, which is pretty much afghan child bride style stuff. I was a bit surprised when I heard that. It's still pretty low in parts of eastern europe too.

Ages of majority and consent based around puberty are typically found in more backwards, agrarian countries. Modern mixed economies usually have higher ages of consent and people wait until 18-35 for marriage.

Most African countries have the age of consent at 16 or 18. That's higher than Europe.

India and Indonesia (20% of world population) are 18 and 17 respectively. (Admittedly China is 14).

Ages of consent in eastern Europe are higher than in western Europe.

The real fucked up countries are Spain, Argentina, South Korea and Japan, which all have an age of consent at 13 (what the fuck) and the Middle East/Iran/Pakistan/Afghanistan which is usually "when you're married" which can be as young as 13 or before (again what the fuck).


There is a strange puritanical bent in English-speaking countries. America is the worst, having a mental breakdown at the idea of minors having sex (which they do, all the time, regardless of laws). Minors can view violence or even fire a gun but God forbid they see a fucking pair of tits on TV. 1/3 of American states (50% of the pop.) have 18 as the age of consent, another 1/3 of states are 17. Right up there with Indian/Indonesian/African laws.

17 and 18 are too high. Most people are capable of consenting to sex with an adult (who is not in charge of them) by then, and certainly with their peers. Fuck, most people have had sex already by 18.

13 is too low for obvious reasons. 14 is worrisome at best.

15/16 is a good age for laws.

Notably, Germany is 14 but only if the other partner is under 21.

Having looked it up, no I wouldn't say that's accurate. A large portion of africa is 16 to 18, and I've no doubt that that's how it works in the populous, modern cities. Out in the countryside? I doubt it. And eastern europe has lower ages than western europe on average. Same for asia, India has one of the oldest ages of consent in asia (phillipines is higher) but what's on paper, and what the actual rules of society are are two different things. Child brides still exist for example, and until recently it wasn't uncommon in china for boys to be married off to adult women (who would complete their upbringing).

Yeah, this is my objection. If having consentual sex below the age of consent is deeply traumatic and screws you up, then trauma is the norm. Especially given that people traditionally married before that age in the past.

Of course it happens, but that's true for girls as well as boys. That is why there is an age of consent at all, because you are considered not mature enough to consent at all. In fact, females mature faster than males, so it makes no sense at all to question the victim's potential consent because he happens to be a boy.

  1. Given an age of consent law, some consensual and responsible sex will be missclassified by the judicial system. It is not a perfect system, it is a decent system.
  2. I doubt that the boys in these kind of stories are commonly "high fiving their friends". Just because you think about sex often at that age doesn't imply you feel comfortable and are mature enough to make responsible sexual decisions, at least not more so than girls of the same age.

Age of Consent is a legal fiction. Of course, there are "children" who for whatever reason are more mature than their peers and can handle the emotional issues connected with sexual activity.

But the general idea where this came from is that we tied sexual development to biological age. You do realize that nearly all of these "age of consent" and "statuary rape" laws all focus on females, right? Because in our current "socially advanced culture," we considered fucking 12 year-old girls to be barbaric and only something that back-wood hicks and creepy foreigners from "the old country" did. Note that in the past, normally, biologically capable of safe and fully-functional sexual activity (fertile/potent) at age 12 and up.

And as for "kids fucking kids," there's a reason for the laws against that too. To put it bluntly; kids are forgetful, impulsive, and sometimes; just plain stupid. Hell; most 13 year-olds can't even masturbate responsibly yet...what are they gonna do when they get some real dick or pussy? Shit...teenage pregnancy is still a thing, you know.

But in the end; all of these underage sex laws are simply based on an assumption to err toward caution.

That's a whole other issue that I really dislike as well. I haven't seem much people saying how a 12 year old boy having sex with an older person, is completely okay and that it's not wrong. I know some people do, more so with men than with females.

However, the reaction between the two is worlds apart. Fucking a 12 year old girl will get you seen as a horrible person, some wouldn't even consider you a "person" because of it. Fucking a 12 year old boy will get you some of the same responses, there will be outrage, but nowhere near the amount of outrage as girls usually get, and of course you'd also get some responses like "Lol, men can't be raped." "He's a boy, he wanted it, as they all do." and stuff like that.

Well, that's how I've seen that, anyway. You might see it differently.

I can see the reason for such a law, especially after that stupid ass "Lol let's get pregnant on purpose to be on this pregnancy show!" thing that went on a while back. I just think it should be...different. As in, it shouldn't be labeled as "rape". Two people, technically raping each other is just weird to me. The problem is the double standard:
14 yo boy has consensual sex with a female adult: His sexual activity is seen positive. "He should be happy", "Nice!", "Now he's a man" and as someone has mentioned, it's described as "they had sex" and not "she abused him". The boy is not seen as a vulnerable child or a victim. The woman is not seen as a pedophile or sexual predator.
14 yo girl has consensual sex with male adult: Her sexual activity is seen negative. "He took advantage of her", "She lost her innocence", "He manipulated her" and it's usually described as "sexual abuse" and not "the had sex". The girl is seen as as avulnerable child and a victim. The man is seen as a pedophile or sexual predator.
It's not always like this but I think we can agree that this is the common narrative.

Taking these things from a kid, even if he thinks he is mature enough to handle losing them, for our own benefit just seems wrong to me.

It gives boys the right to be protected from abuse and exploitation.

There is also a double standard with regards to how long people are considered children. Boys as a whole, and in particular boys of color, are far more likely to be considered adults or "young men" in their early teens than girls of a similar age are. This leads to demands being placed on boys before they're ready and unhealthy expectations to follow. I think helping people to understand that, despite the physical appearance of a grown man, a 15 year old boy is as much of a developing child in need of protection as a 15 year old girl is beneficial.

She took advantage of him and his 17 year old brother. After finding out the boy's father was so upset with the sentence that he contacted higher authorities and pushed to have it appealed.
