Wife decided to move out while I was visiting a sick relative. We have agreed to use a divorce mediation service to divide property. Two questions: I let my STBX keep the nicer car, worth 36k. Mine is worth 6k. Both are paid off. When we are evening out our retirement accounts, will mediators count the 30k value difference, or split it to 15k? Second question. Because my STBX acknowledges the fact that she is the only person seeking divorce, she is willing to split the equity we have in our house, instead of forcing us to sell it. I am too old to qualify for and pay off another house. I can only withdraw so much from my 401k, thankfully it’s enough to cover half the accrued equity. If mediators find this split to be insufficient for my STBX, can they insert a clause stating that if I sell the house in the future, she can claim half of the proceeds beyond the payoff and real estate agent fees? Our kids are both over 21 so no custody issues.
