Veteran here. My ex had to refinance to a conventional loan. She couldn't use my veterans loan. She said this to me during the divorce, "why can't I use your VA loan? I am your spouse". I told her, because you cheated and we are getting a divorce, you are no longer my spouse.

I think I understand your question. If/when she buys you out does she refinance? How can she buy you out if she doesn’t? Yes she will have to change the loan. Your VA will be good to go.

If she cannot afford to pay the mortgage after buying you out, then she cannot keep the house.

If you cannot afford to pay the mortgage after buying her out when you cannot keep the house.

For either of you to go buy a new home you’ll have to be completely off of the title and mortgage for this first home. Otherwise your loan financing will look at all the numbers from this first home.

Yes she would have to refinance into a new loan and she would have to qualify for that new loan.

Do they have to? No. You can agree that it isn't necessary and draw up a contacting saying exactly what you both agree to.

But if you want your name off of her property it is completely normal and common to insist she refinance. If she can't afford to that's her problem. Maybe she should stop thinking her imaginary dreams will magically happen.

My ex didn't have to refi until I forced it in court. I called the VA and they refused to enforce the habitation clause.

The VA doesn't care who pays for the loan AS LONG AS IT GETS PAID. If it is missed, they come after you for the $$$.

Lawyer up and get her to either sell or refi. get that out of your name, you are accountable for all lawsuits, payments, and all other liabilities for the home until the VA guarantees are discharged.

While I don't have my mortgage through a VA loan, I am otherwise in a situation similar to you. I believe you had asked about buying out the ex.. with me I just had an appraisal done on my home and then split the amount of equity to determine what I would need to come up with to buy the ex out. I've decided recently to just go ahead and sell my home instead of trying to come up with that big chunk of money, but the equity split still stays the same. It'll just be based off how much I get for my house now instead of what the appraisal came in at

If you have a house that you used a VA loan on, make sure it's fully taken care of in the proceedings, including who gets it, if refinancing is a requirement and what timeframe, or what timeframe is required to sell the home. My EW tried getting slick, but I torched her lawyer before the settlement hearing. EW had to sell the home, which freed up my VA loan.

I couldn't find a solid answer with some research but it seems like if there's any way for it to continue after the divorce, you'll need to remain on the mortgage and guarantee it. I would resist that with every fiber of my being.
