You need to file first, to set the narrative. Emergency custody, and sole use of residence motions, like yesterday! If you don’t, she is going to lie like a gangster and silver bullet you. Get your lawyer to file immediately!

This is a silver bullet tactic. The playbook. She likely has a hen or a lawyer advising her. Make accusations, false or exaggerated. Make you look bad or dangerous, get you out of the house and keep the kids.

A hen told my ex, pretend everything is fine…you want to work on the marriage…then when he least expects it, make him move out. Tell them he scares you. You will keep the house and kids. It worked and hasn’t stopped.

Courts will side with her, she wins the sympathy they know she deserves, cause they need to protect momma and kids from a dangerous man. You are on the defensive from day 1, there’s no presumption of innocence so you are paying to defend yourself, and the standard of evidence is a joke. You’re looking for a place to live, have no stuff, and are fighting to see your kids. I’m wondering why you agreed to family counseling, judge will too. Questions will be asked…

Filing first may not help at this point. Lawyer. Start calling lawyers for a consult…all of them. They will check to see if there’s a conflict of interest (ie, your ex has consulted with them). Record every interaction with your wife, especially if she shows up with family/friend (ie, a friendly witness who will swear that you were about to kill here). Photo everything in the house in case you get removed. Get control of your financial accounts. If she puts a hand on you, you’re putting on a World Cup performance, make sure there’s a bruise, you call the police, and file charges.

My ex tried hard. Never got the restraining order, but just the accusations were enough.

I am 3 years past leaving a pathological liar and cheat. 3 years later the lies and deceit is going strong and constant in court. I live in a blended home with too many kids and my gf of 3 years now. I have had infront of all kids here, 6 visits from cps all unfounded, 2 false police reports proven without merrit, and 5 sherriffs visits for an order of protection and violations, proven false and soon to be thrown out. She wont ever be punished for the lies and i wont ever reclaim the time and money lost fighting this evil doer. Some of the worst advice i got: 1. Dont leave the house (dont listen to these people ever. Leave as soon as it becomes accromonious). 2. Record everything (same thing. Dont be the antagonist. Be easy. Use text. Remember the quote "a man who does not lie does not have to remember what he said". This quote if you learn to use it well, will be your out of all the lies she may commit to. 3. Lawyer up inmediately (why do you need to do things immediately? In fact you can rep yourself for a long time against her lawyer. You can save yourself tens of thousands just by not rushing and not panicing). If you have kids and she is a liar and combative, time may be on your side. If i had listened to peoples rational advice to stay in my home and all these self protective measures, i would be in a much worse place. Time was VERY much on my side qnd it may be on yours. Remember youre not a criminal and these strangers in court are lying to you. If their priority was the kids, then the term "court clerk circle jerk" wouldnt be my reality. If the kids are their priority, why have I and my lying X spent over 100k in litigation over 3 years with ZERO success. These people only care about your money. They dont give a dime about your kids. And if you let them into your lives willy nilly, you may regret it. I dont let any of these strangers run the show. I am fortunate my kids are tweens and teens now and are fully aware of this sheitshow. One of the courts mandates is "dont tell the kids nothing". There is some merrit in this. Avoid alienating their mom even if she is the most heinous person. But you are their father and the judge is an absolute nobody in this dynamic. If you disagree with something these strangers are saying/doing, man up and stand up. I have no risk of losing my kids nor my significant time with them now. Once this is your certainty, you will feel very different. The court and your stbx will use your fear of losing the kids against YOU. There was a time when i feared that. It is one if my biggest regrets. I wish i had put all these people in their place long ago before i was assured of my 50%.

My stbxw did the same thing. She had her therapist call CPS and report me for "body slamming" my son 4 years ago into his bed (she reported it 4 years after it happened). He was having a tantrum and they (wife and son) were screaming at each other, so I picked him up and he was struggling (he was a 4 year old throwing a tantrum) and put him in bed, I even remember being careful to not hurt him when I put him down. The funny thing is I think when CPS interviewed him, he said that I never hurt him but his mom has hurt him a number of times.

CPS came and basically said it was a one off incident, and closed the case. My wife than wiped out our emergency fund savings and filed for divorce.

The thing is, be extremely careful in what you say and what your actions are now, she is going to use anything you say or do against you. My stbxw tries to rile things up to make me mad, but I just brush it off and grey rock it (just answer in the most boring way possible).

Whatever you do, don't leave your house. You leaving will screw you. Wait until there's an agreement in place, signed by both of you and notarized.

Sorry brother. Protect yourself now. Record all conversations. If she called CPS she's trying to trap you or set you up.

Get a consult from the local, best lawyers so she can’t use them. When you do get a lawyer, get one that has had cases with the judge and understands how they make judgments. Make sure they are CFLS if your state has the certification.

So you think she is going to file tomorrow? Great cancel all of her credit cards tonight, and move the money from the bank account(honestly if you pull this off before she files she will be fucked)... if she is priming the shit with cps it's not going to be a friendly walk in the park.

Also of you want to know scan her bank account and credit cards for a payment to a lawyer, they want cash on the barrel head not a promise to pay.

Let your lawyer talk to CPS, but the basic premise is never agree to anything - once you let CPS into your family, they never leave.

My wife (separated) has reported me to CPS or the cops at least 20 times of abusing our kids in the past five years. Half the time the cops recognize me and we chat for a few minutes and then they leave. She was a drug addict for years and started taking Kratom which made her completely nuts. I had her put in jail for a few months after she tried breaking into my apt. at 2 am with weapons. She was so high her eyes seemed to vibrate. She is actually a lot better now after her fourth bout with cancer. The chemo seemed to knock it out of her. It's been a a year+ since she brought up the idea of me abusing the kids. She brought it up today as a possible reason why our daughter has addiction issues. I blew up at her. I didn't realize how much the abuse and trauma she caused me was still with me. How do you truly let that go?
