The sad part is, this poor kid most likely will be expelled from OU. The girl most likely will walk away scott free. The rules of the college clearly state that if under the influence of alcohol, the act can and will be deemed as rape.

I don't believe the school has or endorses a mens rights group/club, but the have a womens gender studies department that is very vocal about feminism. It's another sad day in Athens.

But as feminists have taught us: rape isn't about sex without consent. A woman can give her full consent and still be raped if she later regrets it. It's up to the man to be A) 100% sober all the time, B) responsible for both their actions, and C) a mind-reader/time-traveler. And if you think about it none of those things are that unreasonable.

Uh yeah, except for the most common ones: youthful sex hormones. Gah it's like they don't even realize that the Patriarchy controls everything, even our basic biology. Women would never consent to sex if they weren't drugged by something, roofies, alcohol, hormones, social mores, etc.

Blackburn said there is "a lesson to be learned" from the incident, both about being more careful in public behavior, and not jumping to conclusions based on limited evidence such as Twitter posts.

I'll just say it: giving the accused a chance to prove their innocence in a court of law is Rape Culture. To even have a trial that consists of anything other than her statement and sentencing suggests a woman could lie about this. Which means all women lie about this. Which means you don't think rape happens or women deserve it.

Nice to see the police investigation and their statements to be so reasonable, although I don't have the same expectation for the university proceedings.

It always bothers me that these news stories rarely mention if the man was drunk as well. If both were drunk, then weren't both parties incapable of consenting, according to the logic of some feminist groups? Of course, if women are incapable of raping men, as some attest, then I guess the man's sobriety or lack thereof is a moot point.

One local group that has spoken out about the incident is Hollaback Appalachian Ohio, which advocates against what it describes as a pervasive "rape culture." A spokesperson for the group said Tuesday that however the prosecutor and a grand jury might describe the Oct. 23 incident, "we would still consider this a sexual assault."

I see, "guilty untill proven innocent". Interesting...

Sarah Fick of Hollaback said group members are "very disappointed" in the grand jury's decision to return a no bill. "It seems that they're trying to pass this off as a normal part of drunken hook-up culture," she said – adding that it's precisely this culture, in Hollaback's view, that is the source of much sexual violence against women. It's unsafe, she said, "it's the opposite of empowering for women... It's also against the law."

Anyone have any proof that drunken hookups are against the law in Ohio? Nice "sex-positivity" though.

Fick also rejected the notion that the woman's spoken statements and apparent responsiveness mean she was not too drunk to consent. "If she was drunk at all, she was too drunk to consent," she said. "If she was too drunk to remember anything, she was definitely too drunk to consent." The outcome of the legal investigation, she added, is "another example of how the criminal justice system doesn't always work" for sexual assault victims.

Wow. Being socially drunk = not being able to consent (but only if you're a woman of course).

All the evidence says it wasn't rape, but the loons at Hollaback continue to assert it was. And if her being drunk means she can't consent, then the guy being drunk means he can't consent so they raped each other! Funny how Hollaback isn't calling for the girl to be seen as a rapist... What really worries me is that the girl isn't being charged with the false rape accusation. Also, the college is going to do its own investigation and as we all know, colleges require little evidence to crucify boys -- the girl's word should be enough for them.

If the state had any evidence that the woman was drugged, they would have presented it. Clearly they didn't. So the rape accusation really was false. Told you so.

There should still be other charges pressed. If the sources I've read are accurate, there was an assault by two people on one. Also, two people should be charged with lewd and lascivious conduct. One person should be charged for a false allegation, too. This is not effective justice if the sources are accurate.

Athens County Prosecutor Keller Blackburn said the evidence uncovered by an Athens Police investigation shows that the woman – who claims to remember nothing of the incident, but who filed a police complaint the next day alleging sexual assault – did give consent for the man to perform oral sex on her.

In video of the incident, Blackburn said, the woman "had a smile on her face at one time," and grabbed the man's head in her hands at another. When the man asked if he should stop what he was doing, Blackburn said, "she said, 'No, go ahead, continue.'"

At least the grand jury had some common sense. I also think the Athens County courts deserve credit for addressing this speedily rather than sitting on it to avoid controversy.

This woman was as described by others drunk and may have been so drunk as too not remember what happened.

But what is interesting about this is that she fooled not just her partner, but an entire crowd of adults of diverse backgrounds not one of which thought what they were seeing was non-consensual, or that she was too intoxicated to meaningfully consent.

Even the guys that beatup the fingerer did so not because they thought he was raping the girl, but because they disagreed with the public lewdness.

What this indicates is that the requirement that the men be in charge of the women's drinking is not just unfair and sexist but also completely unrealistic and unworkable.

This event should be widely documented to show how wrong it is to make the man responsible for a woman's drinking, or to make any person other than perhaps a trained bartender responsible.
