Yes, let's call it a dumbass tax.

So people who make bad decisions deserve whatever pain they get from it?

How exactly would you even prove moocherhood? What rules would you establish to split property? If you paid for it, it's yours?

How to prove it? You could record them in the act. As for the second part, sounds good. Assuming what you purchased wasn't a gift to the other spouse.

Is a stay-at-home dad who gave up his career fifteen years ago a moocher? Would you strip him from the clothes on his back, kick him out of the house and take away all his possessions because he didn't pay for any of it?

If he gave it up because both partners agreed to it, while contributing in other ways, then no, he's not a mooch. As for the possessions, if he didn't pay for it, and it wasn't a gift to him, yes I would. What would you do in that situation?

Comments like this imply that women marry because of what they can get during the marriage and in divorce. The point is that it doesn't always happen, and the same messed up system can screw over women. I acknowledge that men often get the short end of the stick in family law, but there are implications all over the place in this thread that women marry because of what they can get out of it after a divorce. I can't tell you how many "don't ever get married because WOMEN" comments I've seen. There are a lot of women who do just as much as men, if not more, nowadays to support their family. It's not like the 50s where women had to be completely reliant upon their husbands - I don't hear men being accused of being golddiggers (basically). Also, what "bad behavior?" A divorce? Sometimes divorce just happens - both sides are to blame. What the judge does afterwards can be shitty for men, but that doesn't mean the woman did something wrong.

Again, I acknowledge that men do get fucked over, but this comic is sexist in just its implication that men are the ones with the big shiny things, and in marriage (and divorce) all women are just there to take it. Does it happen? Yes. Does that happen in the majority of divorce cases? Most likely, no. Additionally, there are a lot of women now that enter a marriage with just as much, if not more than their husbands, and in divorce, the husband should receive his fair share in those situations.

Because if the child has two parents, both parents should pay to care for that child. Child support isn't about the parents - it's about caring for the kid whether they're physically with you or not. As I said, if a father has custody, the mother should have to pay for the child. Child support is for the best interest of the child.

Not a father with custody situation, but my sister in law had the shit beaten out of her by her ex husband over time which finally ended their marriage after 10 years. She wanted him to get therapy, etc, but he refused and then he basically threw his hands up and said if she wouldn't get back with him, he wouldn't pay for his kids (they have 3). When he did see them, he wouldn't feed them and only took them for a couple of hours before dropping them off with her. She was a stay at home mom in their marriage and when he left, she ended up getting a job at a coffee shop part time to pay bills. It wasn't enough. They went from relying on him to him not only being absent physically and financially, but her working a job that paid like shit and took her away from the kids (which required to pay for child care) . He refused to pay any child support and it took a year and a half to actually get a court date to try and get some help. She and her kids are still on food stamps and have been the majority of this time because there is no money. They had 3 kids under their arrangement as a family - child support from their father would have kept them off of food stamps, for example. Child support is for the kids.

Thanks for the info! Though I think what would need to be done to show that, economically, there is a pro woman bias in divorce courts is a comparison of different situations. You would need to look at the outcome when men earn the majority of household income, when it is equal and also when women own the majority.

It is also important to remember that while purely in terms of income a woman may bring less money into the typical marriage, she often takes on the role of a housewife. While this brings no tangible economic gain it is still work that is necessary to both people in the relationship.

To put this in a practical context: If the wife was not doing this work and they wished to continue living the same as if she did, they would have to pay someone to do this work. This would probably mean the wife, having more time and the necessity to pay the worker they hire, would get a job to pay for this extra expense. This income would then be taken into account if you were looking at the marriage in purely economic terms in a way that her work as a housewife, though of the same value, would not be.

Though this is naturally something the value of which is difficult to put a number on, it is still an important factor when looking at the justification of who gets what post-marriage.
