What if you meet a post-op transexual and have sex with her. She either;
a) Doesn't mention it.
b) Explicitly lies and tells you she was born a woman.

I think;
a) is fine.
b) is morally wrong, as lying usually is, but certainly isn't rape, and should not be regarded as a crime.

The general principle is that lying might be nasty and morally wrong, but its very different to sex without consent. if lying about your job equals rape, where does it end?
What about exaggerating the prestige of your job?
Lying about being married?
What about just sending out false signals of high status, like renting a fancy car?
