The article says

So she basically fucked up by ignoring the legal side of things and failed to contest the claims. Its a classic "I feel that." She just thought she could ignore it and it would all go away.

The ex-husband "admitted in court that he wanted copyright to continue reproducing paintings to sell and derive a future income stream." So what? he wants to get income over an asset he partly owns?

The thing is...the really funny thing is that her husband probably supported her when she was in art school and stood by her before she became successful with her art. Every dollar earned by either partner in a marriage is owned 50:50 :)

Well good for him! When I got divorced the first time - everyone including my own lawyer thought I was nuts for asking for half interest in the plays and music she created while we were married and for which she was receiving royalties. We spent @ $100k in recording studio time and other things.

Every time one of her plays is performed she is getting $5k to $10k.

I still feel I was robbed. She did make a run for my 401(k), pension and social security benefits but was denied.

I had to objectively think about this one, and honestly, it doesn't matter how she feels or the level of talent she has, she created a product that was profitable.

If Dave Chappelle, the artist got a divorce, half of that Netflix money would go to his wife. In fact he'd probably have to pay alimony and child support.

It doesn't matter that he sells ideas, or that anyone else sells physical objects or labor, some people even sell sounds, this lady happened to sell pictures.

Taking any party’s rightful assets should be illegal. If she exclusively worked on the paintings herself and gave it a copyright on her own then he should have no right to claim her work. She has no right on the guys assets either though. This shouldnt be a gendered issue at all your countrys laws are fucking retarded.

A lot of people in this article can't seem to make the leap between "something that comes out of your brain", and then the whole individual people and literally any form of economic activity.

The original ruling would also arguably set the precedent that I went to school prior to my relationship, so my ex isn't entitled to any of my assets earnt throughout the relationship.

I don't agree with this one. Typically I would say yes she needs to share the marital property bit this is not a purchased picture it's something she created from nothing. I dont think this would fly in many countries certainly not in the US.

This is a woman who had created art while being with her husband, and then when they divorced, he got rights to that art?? The husband had nothing to do with the art, and she was creating art before she even met him. thats absolutely ridicolous and not fair at all to the artist?

If someone creates an art piece or some music on their own, it should be theirs to own. this is the whole point of copyright.

That is absolutely ridiculous bullshit. This is especially egregious given the ex-husband's emotional exploitation using said artwork to pressure her leading up to the divorce.

Truly astonishing how poor the judgement in this case was.
