I work at a community mental health facility as a psych tech (kinda like orderlies). We're one of the few receiving facilities that accept minors....I think we're the only one in a 3 county radius that accepts any under the age of 12.

I've seen countless children come in that aren't allowed to play with the other children because they're registered as a sex offender. It's disgusting that the court ruins these kids lives just because they were curious. Usually it's for something mundane too....like "molesting" which really was more of a "I'll show you mine if you show me yours" kinda thing. For kids it's perfectly natural, but our sexually repressed society refuses to accept this and marks sex as bad. If an adult did the "show me yours" thing, then I'd be questioning it and slowly bringing out my pitchfork.

Oh, and to be fair, even though a majority of them are male, we have had several female minors registered as well. All for pretty stupid things that shouldn't even make an adult a sex offender, let alone a child.

I don't doubt that the little boy is likely going to be scared by this, but the girl likely has no idea that what she did was wrong. She clearly needs to be taught a lesson about right and wrong, but arresting her and threatening to make her register as a sex offender is just stupid.

But what di she do? Rape has become such a broad term that it is impossible to tell whether the girl deserves arrest or not. It could be that she actually did indulge in serious sexual assault knowingly, it could be she was simply curious and went a tad out of bounds.

Children don't know what's acceptable and what's not - that should be obvious to everyone.

Judicial punishment is for people who know or should know that what they do is wrong, not for people who have no idea; in fact in civilized countries those people are very specifically excluded.

It would be a grave mistake to prosecute this girl and I'm proud to see my fellow MRAs speak out so calmly against it.

When regarding sex offender registration, we should keep in mind that Texas, like most states, have separate rules for juvenile offenders.

Juvenile sex offenders, those who register on the basis of an adjudication of delinquent conduct, register until the 10th anniversary of the date on which the disposition of their case was made or the juvenile completes the terms of the disposition, whichever date is later.

Juvenile sex offenders, those who register on the basis of a conviction or an order of deferred adjudication in a juvenile case that was transferred to a district or a criminal district court, register until the 10th anniversary of the date on which the offender was discharged from state supervision of their case was made or the juvenile completes the terms of the disposition, whichever date is later.

Look I'm all for prosecuting women when they rape. Hell, I'm all for prosecuting anyone when they rape another person.

But she's fucking 10. You can't seriously put her on the sex offender list for life. It seems highly unlikely a 10 year old was sexually predatory towards a 4 year old. Knowing nothing about the crime at all (article tells us absolutely nothing about the act in question) I'd be inclined to believe her mother that it was just inappropriate play.

And on a related note, I remember a similar case in which a 10 year old boy was put on the sex offender list. Or maybe he was 8 or something. I'll try and dig it up.

The american system is vastly stupid and men get placed on the register for the smallest of things such as peeing in public. The SOR needs a vast overhaul in who is listed and why.

At 10yo you are more mature than a 4yo and semi understand what the hell you are doing but i disagree with putting anyone on the SOR unless they are an extreme case.

This is insane! They're just two kids, and we don't even know the context of what happened. They may have been just playing, like little boys and girls do. Many children play with each others' "privates", because it's part of discovering the differences between the genders and early sexual curiosity. If the boy protested, then yes, maybe it was "rape". But, maybe it was a case of "Can I put your willy in my fanny?", to which he answered "ok". Something similar happened when I was 10. A little boy asked me that question (the other way around), and I said no. It would potentially have been "rape" if he'd done it after I'd said no. We were both 10 year old kids. The ludicrous thing is that had I said "ok", he may have been charged with rape, even though in my view it would not have been, because we were just kids messing around.

I find it odd how many comments, in this sub of all subs, are saying something along the lines of "she was young, she didn't know better." Really? We don't know the details of what happened, but we do know that ten year olds really aren't that stupid or immoral. If they were, then shit, maybe we really do need to teach people not to rape. If we do need to do that, I say we start with the adults though, because not many ten year olds who do sexually harm others dont just come up with the idea of the top of thier heads.

I highly doubt the little girl knew what she was doing, children of that age are pretty ignorant. Hopefully she can learn from what she did and not leave her scared. The boy is probably young enough that they won't remember it (unless it was something violent)

Assuming that this accusation is true (considering it's coming from a 4-year old about a non-family child I personally think it's likely that she did whatever the boy said she did) it then begs the question of WHAT she did.

Due to the curiosity and naivety that comes with youth I think that regardless of the act it is too early to register her as a sex-offender, she has not been exposed to a proper understanding of what she did, so I don't think something so permanent should happen. That said since the nature of the accused crime is unknown, assuming worst case scenario (basically rather aggressive physically forced rape) some 'jail' time I think wouldn't be bad. I.E. those four days that she's been in a juvenile holding cell MAY be enough to give her proper context to understand that if she does this again it's not just fun for her, but something she will regret. Which if she merely very assertive and 'unaware' as to what she was doing would be enough.

But as well there is to consider, she's 10 not 3, while it is still UNLIKELY that a random 10 year old had sexual knowledge and possible context to regard such acts, it is not impossible given some messed up home environments some children are exposed to, perhaps she suffered sexual abuse of her own warping her 'mental' development. (I say that because it happens and she's young, not the fact that she's a girl means that she couldn't otherwise cause it).

Personally I think that it's too soon to get really invested in it. Maybe the boy is crying wolf, maybe the boy has a parent who doesn't like that girl who convinced him to cry wolf, maybe the girl's a monster, maybe she's just confused. We have no information to go on other than age, gender, and the fact that the accusation is being taken seriously. If you ask me the article seems like it is meant solely to play on emotions, as there are about a hundred different people who could be at fault (the girl, the boy, someone the girl knows, someone the boy knows, the police, or any combination of the above including all of them) thus this would really come down to emotional responses based on assumptions. If the girl raped the boy and severely damaged him in the process and goes around town doing it fully understanding what she's doing she needs to face the legal system. If the girl ignores the boy because she doesn't care for him and not give any response so the boy decided to 'get back at her' then the boy is wrong. If this was something a bit more 'harmless' in that say the girl was curious about what a penis was, politely asked the boy, he voluntarily showed her, he told his parents, they told the police, then I'd say the police are at fault for getting involved in a issue that just needs proper parenting which at this point is still an option.

This comment thread has really soured me on this sub. Most of the comments are ignorance masquerading as authority ("everybody knows" and the like). Basically, its just a bunch of people talking out their ass. Worse, many are clinging to the innocence of women myth. Males are much less likely to believed than females when they claim to be the victim of a sex crime, especially if the alleged perpetrator is female. Here, even in the men's rights' sub, everybody is so quick to assume that this boy couldn't have been raped. Maybe he wasnt, but it seems that too few are even willing to accept the possibility.

We don't know many details, and that may be the result of confidentially (which we should respect). Im not for making a villian of this girl, but I am willing to consider that the authorities might be doing the right thing here. I believe the girl deserves to be treated within a legal framework that presumes innocence, but I also think the boy (and any other at risk children) should be protected and be taken seriously. I know it doesn't always happen, but often the authorities do the best they can, and often that's damn good. Sorry, I know its easier to think that we have a broken system rather than it is to admit that thier are bad children. There are dangerous kids out there, and that's hard to admit. Its hard to admit because it leads to harder questions.

Why do children abuse, act out, or, as some suggest, not know better? These questions affect men, women, and everybody, so we all should be asking them, but to many here its simply easier to minimize the fact that rape does indeed occur (unless it happens within a narratively convieniant context), ignore that children really are abused (by men and well as women), vilify feminist (if they can't be the source of a problem, its not a problem), or just blame the system (like the moral panic seen below).

I dont think many of you have really thought about the ages in play here. You see ten, and think, of she's just ten. But he is four! She is bigger and stronger. She has 250% the life experience that he has. 2 years is often considered enough to create a potent power differential in this kinds of cases, and she is six years older than him. Maybe you have rose colored glasses on about childhood sexual development, perhaps your own, but even if she knew little about sex that doesn't excuse the age difference.

What 10 year girl old goes "exploring" with a four year old boy? Children of those ages often avoid eachother, have a hard time relating, and can't play the same kinds of games. Besides, all kids are aware of that older kids can bully younger kids, at least all kids growing up outside of Utopia. Ten year olds might "play doctor" with someone they can identify with, or they might "discover" their bodies with a best friend. But with a four year old?

The idea that a ten year old would innocently do that kind of thing with such a young child stretches credulity, and it should raise some serious red flags. The age difference creates a power differential, a physical advantage and a knowledge gap that add up to the possibility (if not probability) that the ten year olds actions were predatory. The next most likely situation would be that the ten year old was developmentally disabled, which would, given the ages involved and how such children often develop sexually, mean that these kids being together alone was a dangerous situation that should have been avoided.

Finally, the thing that pains me most is how people are so quick to minimize how this all could affect the boy, especially when denying the possibility of malice on her part. If you believe in men's rights and can't even empathize with a four year old boy, thanks, but no thanks. Your not helping.

Someone sat this psychotic little fuck down and told her that there were places you don't touch other people, and where other people don't touch you. She then proceeded to do it anyway.

This isn't a six year old. This is a ten year old. That's old enough to get why this was wrong, and old enough for sadistic tendencies to have cropped up that can't be put down entirely to the general sociopathy of childhood. She is well beyond that developmental state.

People saying "she's young, she didn't know any better!" is bullshit. Should she be registered as a sex offender? Probably not. Should she be punished in some way? Absolutely.

Fifth graders are not the drooling idiots you make them out to be. They are able to understand the basic concepts of assault, rape, molestation, murder, etc. Unless there is some seriously shitty parents involved who raised her this way, she should be punished in some way.
