This is what happened to me. My 9-year-old daughter came to me and said Daddy, I don't want you and Mommy to get a divorce. I tried to speak to my ex-wife she did not want to hear, and we argued. I did not even touch my wife. I left and stayed at my parent's house for the night. The next day 24 hours later, I got a call from the police department saying I can not return home. She filed domestic Violence against me. I said for what arguing, and they said yes. By law, the case has to be heard in 10 days. I go to court in 10 days to hear her say there were previous acts of Domestic Violence and that she needs to amend the temporary restriction order. The judge asked do you have any marks on your body, witness, or evidence. She said no. Then she said I was suicidal to keep the kids away from me. So the Judge ordered a supervised visit every other weekend. The worst part about this is that no law says that if the temporary restriction order has to be rescheduled in another ten days, I had to wait over two months. My ex never amended the TRO and waited until the last minute to discuss an agreement. My lawyer advised me to take the agreement. I was told a Judge would not let you back in the house if she fears her life. My job requires a clearance, so I could not take the chance of getting anything put on my record from her lies. I went into the agreement. Now I could not take my kid 50% of the time because I was homeless and living with my parents.

After we came to an agreement, I noticed my two daughters being weird with me. They told me Mommy said you can come home when you are better. I come to find out through the NJ court system they offer a service for domestic violence victims thru Catholic Charities. Through this program, she took my kids to Domestic Violence therapy. When my lawyer questions hers, we were sent a brochure, it says, "(c) Unless otherwise ordered by a court, at least one parent or guardian shall consent to the treatment of a minor. If one parent consents, a licensee may treat a minor even over the objection of the other parent. N.J.A.C. 13:34-18.6" When I tried calling Catholic Charities, they would not give me any information on my two daughters or even call me back. I am unsure how much she lied, but I believe she got her attorney thru them, and they possibly paid for her divorce even though she makes good money.

So she successfully removed me from the house and manipulated my kids. Now how is this fair? How does this not violate my civil rights? All it takes is a woman to lie and put on an act for any Judge to believe. The Judge is scared that it will be on them if they dismiss the charges and something happens. NJ needs to change its laws. It should have never been approved if someone goes 24 hours later to report domestic violence without supporting evidence. This law about only one parent approving a minor therapy needs to be thrown out. Only a judge should approve that when both parents have legal custody.

I gave up fighting for my kids and became an every-other-weekend father because the state of NJ does not care about men and only women. I consulted with a lawyer to go after the state, and I was told good luck finding a lawyer to go after the state. Lawyers do not want to make enemies with Judges. Think about it these lawyers rely on the Judges to rule in their favor. So how is this justice fair? I get it domestic violence does happen, but it is beyond ridiculous for it to become that easy to obtain now of days. Something needs to be done about it. I'm at the point she ruined me financially with lawyer fees that even if a lawyer could take my case, I could not even afford it now. Men beware. These women are being advised on how to beat the system, and us men can't do anything about it.
