My experience as a counselor, after listening to a gazillion excuses, is that in my state the laws were changed because people with good lawyers were beating DUI charges because they weren't driving at the moment (like after wrecking their car for example) the cop showed up. And I worked in a state that was generally pretty easy on drunk drivers because the alcohol lobby kept the lawmakers under control.
