WA. 12 year marriage, no kids, I worked (and earn a lot), and she didn't work. She requested to have me pay her legal fees. The judge declined. Of note, she switched attorneys in the middle of the BS and the judge did say that while she needed representation this represents new debt, not communal, for her to cover.

She ran up a huge bill too. I suspect whining to them about how horrible I was, them slow walking the case, and over billing.

Check with your attorney about what is normal in TX, but it's unlikely going to be on you.

Up to about 60k so far. Parenting agreement done, divorce done, but financial settlement not done, stay tuned, lol.

In CA, I spent $60,000 on my attorney and my ex had about the same. I offered 50/50 split on day 1 and didn’t budge from that. She wanted the whole house and full custody of the kids so she could continue to be a stay at home mom that lives off my income while going to pound town with her affair boyfriend.

She dragged everything out for a couple years before we went to trial. The judge saw right through her delay tactics and when she asked for attorneys fees the judge said “refused. why didn’t you settle back in meditation if you were being offered a fair deal”

I paid 80k plus - all - of my ex’s - ‘marital estate.’ Seems very unfair bc she was making good money and banking it.

If she dont work, they will likely make you pay for her lawyer in part or in full. The only way to avoid it is to rep yourself but thats not guaranteed. The court wants her to be able to afford representation. If you cant afford your own lawyer, the judge will need to reconsider making you pay for hers

We had to go to trial because my exwife refused to budge on anything. She wanted everything.

We each had 5 grand in attorney fees. Court ordered me to pay 3000 of her attorneys fees.

It was well worth in the end. Her atty did such a piss poor job…. She got 0 alimony.

In Texas here. When my (now) wife was getting her divorce, she was a stay at home mom and teacher by trade. Her ex left her in December and filed for divorce in January. He made the mistake of changing his direct deposit and leaving her with less than $200 in the bank while not having a job and having 2 kids with her.

Being a teacher, she couldn’t get a job until the following fall.

That created an instant emergency hearing and he was ordered by the judge to pay all her legal bills, pay mortgage, her car bill, and any other bills and provide her with $2000 a month for living expenses.

Judges don’t mess around when kids are involved.

A court order.

However, any attorney fees whether incurred by you or her come out of the marital pot. So, if she is broke and takes out a loan to pay for it, it is still marital debt.

Following. I’m in the same situation. I didn’t proceed because I felt that I would incur fees I’d have to pay. I didn’t get a lawyer either. Sounds dumb but there’s really not much to argue about in a 50/50 state like CA.

Im in Texas, too. I talked to my attorney about this when I was going through it and he told me it’s really rare to have to cover the other side’s attorney’s fees unless that’s a part of the settlement or you’ve been hiding a shitload of money or something. Even with this, everyone still has to divulge their attorney’s bills during discovery.

I have a feeling that there was enough fuckery going on over the years with attorneys doing outrageous shit with the bills when they knew the other side would pay it that judges quit doing that.

I think the odds are super low that you’d get stuck with her bills.
