Found out, in court, that my attorney never requested discovery from my stbxw, even though I provided all of mine as requested . My attorney never filed amendment to petition to include domestic violence (told my attorney since day one). Attorney convinced me to give up primary custody because “it has no real bearing today, it’s only a title. You still get 50/50”. I also found out that I had been sanctioned because my attorney never turned over discovery on time to my stbxw’s attorney and a motion to compel was filed.

Basically my attorney lied since day one to me.

I am the only person in my state from my family. She has her whole family here. I also work midnights so my son cannot stay over nights with me. He’s 3.

I still have one more court date. I am coming to the realization that I am going to loose.

So far, it looks like this: I have to give up 45k from my 401k to make her 50/50. I have to give up almost 20k (all of the joint accounts) because I do not have proof (lack of discovery) that she did not pay for joint items and I have to reimburse her. I owe her 15k from my separate property house because I trusted that she was paying for upgrades out of a specific account I had set up separate from the others. She was transferring it to a joint account and paying from it.

On top of all that, I will only get to see my son on every other weekend and pay 1200 in child support.
