If I remember correctly, it gets even worse. I believe she threw a big memorial in his honor, made a bunch of T-shirts and set up a suicide awareness foundation for him or something along those lines. I could be remembering incorrectly.

Edit: She set up a fundraiser "Homers for Conrad" and took to social media with such lovely tweets as: "National Suicide Awareness day, I wish more people understood. I love you and miss you everyday Conrad. Help others #WeCanEndSuicide.” You know those girls on facebook, when someone they kind of knew dies they post over and over about it, crying for attention. This girl took that to a psychopathic level

I wouldn't put it past a guy. My old roommate was kicked out of a somewhat famous band for convincing one of the band's good friends to jump off an overpass into highway traffic. The process took a while and he kept journals with daily entries about the process (which he kept in a briefcase in the apartment years later). The person he was convincing ended up jumping. This guy did it just for morbid curiosity reasons (he was schizophrenic). The band later ended up writing songs about it, and one of them was pretty successful, though most people don't really know what it's about.

There are varying degrees of accountability. If she had just sent a "go kill yourself" text, that's not exactly excusable but pins her with less accountability.

This was coercion of a person who clearly was not in control of their mental faculties. He was clearly very troubled. The way some of those texts read, she could easily have been the thing that pushed him over the edge.

Re: her lawyer's defense... That's how the system is supposed to work.

If society is against something to the point that it is willing to levy criminal punishment on those who commit that something, it has an obligation to put everyone on notice via a law that says "this is now a crime" and has gone through the process required to make a law.

At the moment, the law does not clearly say that what she did is a crime. So the lawyer's argument is basically, "Look, society, if you want to punish people like my client for these acts, make it illegal... But you haven't done so yet, so that's on you."

If people are outraged enough about this, they can pressure legislatures into writing up a law, and then applying that to future instances. If, however, people don't really care enough to put in that required effort, then they consequently are saying that these actions are not criminal even if morally abhorrent.

In law, coercion is codified as a duress crime. Such actions are used as leverage, to force the victim to act in a way contrary to their own interests.

Juris Doctor here: Duress/Coercion doesn't really apply under these facts... It could be argued otherwise, but it would be a pretty weak argument and that is the point of my post: what she did is not, on its face, criminal.

Both Duress and Coercion require that the victim do something against their will via some sort of, as you put it, leverage or force. Encouraging someone to reconcile their resistance to suicide is not such an example... Putting a gun to someone's head is the high end of the spectrum, but on the low end.... You need something more than her just encouraging him. It would be something like, "If you don't kill yourself, I will tell your Parents [some secret]" and even that would be weak, but it would be arguably coercive.

That's what makes bullying and encouraging suicide such hard behaviors to create legislation for. It's obviously offensive and not something we as a society want to tolerate, but codifying restrictions on such language is difficult and begins to intrude on free speech to a degree that can't easily be separated from rights we support.

For example, I have a right to tell you to go kill yourself. I have a right to want you to kill yourself. I have a right to enjoy the fact that you've killed yourself. If I see you about to kill yourself, I am under no obligation to stop you. The grey area that we are dealing with is "do I have a right to cheer you on and actively support you killing yourself while you are attempting to do so."

Since you have a right to do anything that isn't a crime, the answer to that is technically "yes," however, because it is so appalling, and so deep within a grey area of law, it is reasonable for prosecutors to make a good faith attempt to prosecute under existing laws... That is materially different. The real-life situation doesn't involve counsel, it involves definitive coercion. The nail in her coffin IMO is telling him to get back into the carbon monoxide-filled car. He showed a clear desire to stop, and she coerced him into continuing. In states that allow PAS, the doctor asks at multiple stages whether the patient is sure s/he wants to kill him/herself. If at any stage s/he shows reluctance, the procedure is stopped.

That's what I wondered about. I may be completely wrong here, but my understanding is suicide is technically illegal. As a self-inflicted homicide, but would she not be an accessory? Telling a man to rob a bank isn't very smart, but telling him when, where, how, suggesting resources, and to not pussy out seems like it would be a wholly different crime. Not saying I think suicide should be a crime (nor that it's prosecuted), but I'm pretty sure it's listed as homicide. The incessant did you do it yet doesn't look very nice but in the prior examples she's covering her tracks, indicating she knew what she was doing was wrong at the time. Giving false information to an officer and obstruction of justice are two other/smaller possible crimes that pop into mind. Also seems like the prosecutor would've had a better case if he'd included these (unless the article just failed to mention them). It's almost shows something akin to conspiracy, as if she put more thought into how to get this done (and what to say after) than he did. She thought she had this covered but didn't realize her messages could be retrieved if I understood it correctly.

There is no case without those messages, and she instructed him to delete them for the sole purpose of it not leading back to her, then misled the investigation to avoid telling on herself.

Just wondering. How is she even being prosecuted? It seems like such a slippery sloped. Telling someone to do something cannot equal the action. For instance if someone says they are going to rob a bank and I agreed they should do it am I legally just as liable? I didn't rob the bank. Why should I be held to account for it. I'll go against the flow.. Some people just don't want to live. I know it effects family, friends, etc.. But that's their choice. Why can't they choose to? Sure it's easy to assume oh he had mental illness, or he didn't know what he was doing. But to be in such a place that he's really considering doing it, and he doesn't want professional help, I can't imagine you'd want to communicate this with others. Prob bc they wouldn't say the things you want to hear. But a one true friend who can speak with you about these thoughts must have been nice for him.
