If he has been convicted or held otherwise on the basis of false statements that the prosecutor or law enforcement agency had reason to believe were false - and the CBS news article indicates this is likely - then the responsible LEO or prosecutor should join the lying girls in replacing Tyler Kost in his prison cell, for a very, very long time.

Er... you can, as a defendant, waive your right to a speedy trial, in order to give your defense attorneys the time they need to prepare an adequate defense (file all the right paperwork, gather and prepare the necessary witnesses, etc.) Given how litigious our society as become and how much paperwork is generated by a trial and how important it is to secure a favorable verdict in the initial trial, it's not surprising that most defendants do waive their right to a speedy trial. It's still appalling, because they're cooling their heels in jail without a trial, but that's how society works at the moment.

Who would be disbarred due to UVa prosecutorial misconduct, given that there was no prosecution, only a police investigation which concluded that no incident had occurred at the fraternity?

I had to look up Kern county. Wikipedia says:

Abuse trials Between 1983 and 1986, several ritual sex ring child abuse cases occurred in Kern County, resulting in numerous long prison sentences, all of which were overturned—some of them decades later, because the prosecutors had coerced false testimonies from the purported child victims. The details of these false accusations are covered extensively in the 2008 documentary Witch Hunt, narrated by Sean Penn.

But yes, should hope for disbarment of prosecutors (and large civil suits against various governmental bodies) when the 'justice' system tries to railroad an innocent person. Without accountability, tyranny will inevitably arise.

Come on now. He didn't say that at all. He merely pointed out the fact that there are cases of the known phenomenon Stockholm Syndrome.

Stockholm syndrome can be seen as a form of traumatic bonding, which does not necessarily require a hostage scenario, but which describes "strong emotional ties that develop between two persons where one person intermittently harasses, beats, threatens, abuses, or intimidates the other."

As I said above, I was not saying that this might be true in this case.

I was merely pointing out that, in general, it is common for a person in an abusive relationship to come up with excuses for their abuser and put the blame on themselves.

The abuser will usually play into this for their own advantage. This is true for all abusive relationships. Be it male abuser to female, female to male, male to male or female to female. It's how it plays out.

My statement was just sort of an advisory.

However, I would like to address your comment on credibility.

You seem to be assuming that we know they were in an abusive relationship, when you talk about how common it is for someone in an abusive relationship to say nice things about they abusers.

But whether he was abusing them is the central point we are trying to decide.

So the liklihood statement is then: what does the fact that they said nice things about him after the alleged abuse say about the liklihood that they were abused by him?

The only way you can argue that their posts don't tend to exonerate him is if you assume he was abusing them, so you can employ your stockholm argument. In other words, if you already assume he is guilty.

You have clearly assumed, in this particular case, that he is guilty.

In all fairness, your appeal to fairness doesn't appear to have anything to do with the topic.

Let's say, hypothetically, that the victim was abused. That them being accused of something they didn't do was harming their livelihood. The abuser is outwardly ideal, can do no wrong, and has numerous people defending them, willing to play devil's advocate to paint the victim as the abuser.

In that situation, your appeal to "fairness" is anything but.

You stated that

The argument you are made was

  1. it is possible that the accuser made positive statements about the accused, after having been raped.

  2. therefore the evidence has no value.

I don't think the only evidence that has value in court is evidence that can only be consistent with innocence or guilt. For evidence to have value, it only has to change the liklihood of a theory of innocence or guilt.

So while it is possible the the girls had been raped, but still thought they were in love with the accused, when they wrote those statements, the evidence, by itself, makes it more likely that they had not been raped.

I think in most real world cases, it is how the various pieces of evidence connect when taken together, that makes it possible to decide that the accused is guilty to a high degree.

I don't think you really bought your own argument. If you did, then why didn't you apply it to the accusation the girls made against the boy and conclude that, because people have falsely accused others of crimes in order to hurt them, that the accusation has no value in court?

I downvoted you because this is the same ridiculous excuse I've heard before. If a woman acts like you'd expect her to act, it's evidence she was raped. If she acts like she is in love with the guy, then it can also be evidence that she was raped. It's this idea that any way a woman acts can be used as evidence that she was raped that is the problem.

In this particular case I think it's 100% clear what happened, too.

I don't think he means that it is proof the relationship was abusive, he was simply showing how it cannot be used as proof that it wasn't. Really, it can't be used as proof of anything because women in nonabusive relationships show love admiration toward their partner, but also women in abusive relationships have been known to show the same love and admiration to their abusive partner. The old "He hurts me, but I really love him and know that deep down he loves me" and the ven worse "He hurts me because he loves me" and this mindset applies to both men and women in abusive relationships. They are totally infatuated with their abuser to the point of defending and denying any abuse. Flip side of the same coin, people can be equally infatuated with non-abusive partners. That is why love messages like those in this case mean next to nothing to the case without other evidence.

Exactly. It's the judges high honored position to not allow even slightly possibly false evidence go into play in a ruling. The judge clearly took liberty in the ruling and didn't have enough evidence to convict but due to pressure from women's support groups and prosecutors judges careers are on the line and like to "better be safe than sorry" and tend to put people away "just in case."

I'm using quotations because my brother just narrowly escaped jail time from false accusations from a stupid crazy cunt and we had to get another judge to rule on the case. The first judge admitted he didn't believe a word she said but thought my brother "brought it on himself." The new judge was a woman and didn't take half an ounce of shit from the lying bitch and the case was thrown out. The first judge was willing to convict an innocent person and embolden a liar just to appease the women's support group that said "you can't let a man free if she is afraid of him."

I'm not entirely sure they should. Don't get me wrong, I do think false accusers should be punished, but I also agree that you can't really do that without creating a real and dangerous disincentive for actual rape victims to come forward. The real problem, in my view, is the way the justice system handles rape accusations to begin with (Tyler Kost is an excellent example). If we acknowledge that false accusations are a problem, then we have to stop convicting accused rapists on circumstantial evidence that can easily be faked. That means real rape victims are going to get less justice, simply because direct evidence of rape is very hard to come by. Currently, in acknowledgement of this problem, we convict accused rapists based on circumstantial evidence, but if people are faking said evidence, then we can't continue to do that. This is how false accusers make like infinitely worse for real rape victims.

I've spoken about it before and yes it is a SA case but it's fucking retarded. There is planted evidence. And it's not looking good. The case is winnable but it's hard to win. This is has been one of the most stressful if not the most in my life so far.

I started therapy because of it (probably the best decision I've ever made) and I'm looking to volunteer so I can spread kindness and love before and if I get labeled a SO. Which if I do I'm not entirely sure how I'm suppose to deal with/handle that whole situation.

That's all I can I say. But what would you like to know ?

I just barely came across this case and after reading everything I could on this for several hours, I can't believe he is still in jail! This is a clear cut case of guilty until proven innocent. He should be free until he is found guilty of all charges by fact and evidence. None of which was done in the initial trial he went through!

They have texts from facebook posts among the alleged victims that strongly suggest that they were conspiring to frame him. The prosecution refuses to do it's job and compel facebook to hand over all of the texts. There have also been texts from one alleged victim professing how great of a boyfriend he was and how she wants to marry him someday.

But that is not is what at issue here. What is at issue is that there is absolutely NO evidence that he has done anything wrong at all. Used to be that if someone were to be locked up there had to be some evidence and an accusation was not enough. Now, a simple accusation can have someone locked up without bail for years.

I only ever see the snippet quoted above, in the framing presented by his defense attorney, yet this subreddit acts as if it is 100% unquestionable that he is innocent and framed by evil women. If we're going to take the texts you quoted as evidence, surely texts of him threatening girls to keep their mouths shut is just as persuasive, right?

They showed the witness testimony and texts to a grand jury and the jury indicted him. That doesn't happen without some evidence. He might still be innocent, the prosecution might be distorting or fabricating the evidence. I've seen it. However, saying there's no evidence is really dishonest.

His lawyers have asked for a gag on the sherrif's department, and if they got it, it's no surprise that the evidence against him hasn't been widely publicized.

You got me here I admit. But everything that I have actually seen in the way of texts tells me that something very fishy is going on and that there is still no proof that he actually did anything wrong. Texts are accusations and accusations alone should not put someone in jail, nor should a threat to "tell everyone what happened" be enough to put someone in jail however nasty it was.

I would be very interested to see this evidence and if the prosecution is allowed to use it whey don't they do their job and compel facebook to release all the texts?

Right, and the point here is that this is a Facebook record, that is at best ambiguous, from only four girls. Thirteen girls are accusing him. It's pretty clear that those 4 hated him, but not clear at all that they made their accusations up. Maybe they had good reasons to hate him. Maybe they banded together for strength.

Thirteen girls are accusing him. He threatened many of them to keep their mouths shut about what happened between them. Normal men with normal sexual encounters don't do that.

His defense lawyer is doing an excellent job playing this out in the press with those ambiguous Facebook posts from only 4 of the victims. That doesn't explain where the other 9 victims came from or why they all hate him or why he felt the need to threaten them.

This guy is going to prison and I seriously doubt that he is innocent.

There are many problems. 1. This guy is marring material. 2. Girls are allowed to talk out of both sides of their mouth. 3. You can't trust the justice system. a. Prosecution doesn't follow the law to divulge evidence for or against. b. Prosecutors are not held to finding the truth, right or wrong. c. Prosecutors or more interested in quantity not quality. d. Prosecutor may not like the person which doesn't necessarily make the person guilty.

My question is how do you fix out broken system of justice. Myself being drug through the system. The prosecution lies and withholds expulsionary evidence. The prosecution has way to much power without a balance. Attorneys are overwhelmed and if you don't have money no justice.

There is absolutely no proof that he did anything wrong and quite enough to strongly suggest that he is being framed deliberately by a bunch of slighted teenage chatterboxes. That should be enough to set him free and have the charges dropped.

By this logic anyone who is deemed to "look like" a rapist should be held without bail until a jury decides if he looks "rapey enough" to be sent to prision.
