I feel like, on the one hand, if it was male-teach-on-female-student the entire article would be rape this, rape that, rape rape rape rape rape. So there's a sexist double standard going on here.

Describing it as a "sexual relationship" is minimizing what happened, and that's not okay either.

At the same time, putting this in the same category as violent forcible rape is wrong. Putting it in the same category as sex with a prepubescent child is also wrong. ~~A 17 year old~~ is not a child, they are an adolescent, and ~~for all we know he was a month off turning 18~~.

Frankly, the issue here is that she was his teacher. So there's an imbalance of power, and she was abusing her position of trust/guardianship over him. That's the main problem.

The fact that a 38 year old had sex with ~~a 17 year old~~ is much less of an issue. It's still worrying, but it shouldn't be illegal unless you are in a position of trust/authority over the minor (which she was in this case).

Unfortunately California's age-of-consent laws are extremely backwards: it's set at 18 (that puts California in the same category as bastions of freedom and sexual liberation like Somalia, Nigeria, Sudan and India). So legally this was statutory rape regardless of the situation.

Edit: Seems I read the article wrong and the student may not have been 17. Obviously if the victim was 13 or something like that, the story changes dramatically.

For reference, I come from a country with a much more sensible age of consent: 16. However if you are in a position of authority over the minor, then the age of consent rises to 18.

You'll notice at the bottom it mentions a man being arrested for the same thing and says sexual contact rather than rape. I would be more outraged if you have another event msnbc article (preferably the same author) about a man and using the term rape over and over.

I actually think we should stop calling underage consentual sex 'rape'. It actually makes the overall term lose its meaning, and it blows things way out of proportion.

Should it be a crime? Of course.

But "rape" should be crimes of forced sexual behavior. The reason the states get away with calling it "rape" is by belittling the will of the underage person(s) involved, and saying they can't actually make choices for themselves.

They can, they do, and although this teacher should get in trouble, it's MUCH different than 'forcing' someone to have sex, but under the current state of the law, it's not. No matter what the genders.

Rape used to mean forced intercourse. Today it can be consensual sexual touching.. really.

So, I'm for this article not using the term rape, but I'd prefer that when its a male teacher and a consenting female, they also not used the term rape..

It's like if we started calling every act of violence attempted murder.. it's a bit harsh and untrue.

How does a dominant class ensure it remains in power? Through systematic institutionalised violence. That's what rape is.

Rape is the violence men as a class do to women to remain in power over them. Is this difficult?

A good way of shaming men is defining the age of majority as well past the age of puberty. A child, under this strained definition, cannot choose to be sexual, or even consent. But wait. Sex without consent is rape. Great. Now men who are sexual with post-pubescent "children" are rapists.

Plainly, women cannot rape or be violent to men. That's just silly. As for women raping "children", don't be ridiculous.

Also, only male " children" can rape.

I might get a lot of hatred for this, but I don't think this sort of sexual misconduct, regardless of genders, constitutes rape. Statutory is one thing, but to claim that a minor was "raped" despite it obviously being consensual, for either male student - female teacher or female student - male teacher, seems silly to me.

There is nothing more that I hate than in these cases people saying "LOL I WISH I WAS THAT STUDENT! LOLOL!"

What they don't realize was these innocent kids were pawns in their abusers game. That kind of experience fucks kids up for life. No healthy female, especially one in power like a teacher, has sex with a pre-teen or teen. They do not intend to have a "relationship". These kids are just objects for their perverted games.

One of the students was 18 so I am not sure how that is illegal. Unethical? Yes. That is probably why the low bail for one of them.

However, watch the video of a fellow teacher's interview. Which is complete is denial and how everyone needs to wait and find out the full story before reacting. If this was 2 male teachers they would be lynched but right now but instead they are free on 20K/50K bail.

Can someone create a page somewhere that documents all cases, in a timeline, so we have a metric? I guess US court system only.

Headlines, %age mention of rape in each case, some stats to breakdown by outlet - gender of author.

Would be very interesting to see which news outlet publishes first, and then if any subsequent ones copy / edit out rape from the titles, even if reported elsewhere.

The problem is calling either rape, I know people who have been raped, they were not having illicit sex with their teachers, "willingly" but with a person in authority / older, or being coerced, they are physically forced into a sexual situation after resisting coercion.

Calling anything other than that "rape" is demeaning to their plight.

It's evil.

Whenever a male teacher has a sexual relationship with one of his students, the news media automatically jump to the conclusion that it was rape, without giving either party a chance to speak. Whenever a female teacher does the same thing with a male student, the news media disregard the possibility that it was abuse or even rape. Of course it's sexist and prejudice (the media generally is), but I think we need to rethink our use of the word rape. It's used wrongly so much these days that it's been devalued to the point where the lines between consensual sex and rape have blurred.

I know this goes against the popular consensus here, and I can't speak for anyone else, but I highly doubt they did not consent, nor do I believe that all minors cant consent. I certainly understood sex, pregnancy and the legal consequences when I was 14.

The term "rape" is not used in the State of California when talking about violation of minors. The State of California uses the term "unlawful sexual intercourse." Specifically California law says

For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age."

Consequently, I don't agree that it is fair to blame the media for not using the term rape, unless you say have a similar case with a minor girl in California which did get called rape. Do you know of any such cases? What they did write does suggest "unlawful sexual intercourse".

The article wouldn't load for me, so I couldn't read it, but, people, whether you think that consensual sexual relations between an adult and a post-pubescent child is rape or not is irrelevant.

LEGALLY, a minor cannot consent to sex with an adult, the legal assumption in these instances is coercion. Again, whether you disagree or not is irrelevant.

Sex with anyone under the age of 18 (excepting Romeo and Juliet laws) is legally defined as statutory rape and as such, the article should have treated it as any other statutory rape, regardless of the genders involved.

Because it's not rape. We need to stop treating consenting relationships rape for either gender. It can be argued the teachers should face consequences but these actions should not be criminal.
