You are over thinkging it. The purpose of discovery to to determine the financials, that's it! The court doesn't care what you spend money on or how you spend it. They just to to calculator how much each party has, their expenses, and how to impute them. For example, lets say you spend $10k a year on your boat. That's what you have been doing for the past decade, that's just a line item. You could have been spending $10k a year in Vegas. The courts don't care.

As far as your STBC caring, it doesn't matter. She can flip out all she wants (that's her right). You need to start moving in divorce mode where her actions and reactions are no longer your concern. You do NOT need to suffer her, or explain yourself to her.

Now in some states, giving money to the AP can be an issue. But if already separated, shouldn't be an issue. In my case, the eX claimed that she needed a total of $4k/mo for expenses, gifts, memberships, shopping, etc. This was PURE BS. And we both had the banking records to prove that was BS. That's all the matters. So unless you were giving large sums to this girl (which might look like hiding money) it truly does not matter.

It is “voluntary”, hell, even financial statements are voluntary. The ex never disclosed anything, and hasn’t even supplied current income, and the judge let her away with it. The system is “unbelievable”.

Discovery process is voluntary, you should never give up info on accounts at a detail level. In fact you can always say 'this account does not exist'

I requested Venmo transactions to show rental income she didn’t report and payments to her friend that was supplying her with LSD. Like, in financial disclosures (we had multiple) she just didn’t report the account. In discovery She didn’t sent statements. She cut and pasted the statement into an excel spreadsheet, expanded the columns so the rows of one transaction covered several pages and couldn’t be easily lined up. Then created an image.

My lawyer was a douche. I asked for a motion to compel, he argued that she supplied what was requested but subpoenaed Venmo. They sent a multi page list of objections, and a list of her accounts with most of the account numbers redacted.

Before judicial settlement she spent all the money in that account. When I brought it up at the JSC , judge said no money, it’s all gone, quit arguing with me. I bet she coulda snorted a line of coke at any hearing and her lawyer woulda talked it down, the judge would’ve put it on me somehow, or deferred any implications to a future hearing where it would be forgotten or I was out of money.

It entirely depends on the state. Alimony or division of assets could be impacted.
