The problem as I see it is that the believe women bias is so strong, and men are only exonerated with overwhelming proof (and even then...) I suspect the real figure is much higher. I fear there are an awful lot of innocent men in prison.

Yes. The claim that false rape accusations are rare is itself a false claim, and there should be harsher penalties against these.

People lie a lot. Dating apps like Tea are full of false allegations, including screenshots of women admitting they’re lying to get back at men they don’t like for one reason or another.

Read any recent book about how the criminal justice system, mass incarceration, and for-profit prisons work to see how ghastly and prevalent false accusations are.

There have been many, many studies going back decades, replicated over and over, that show significant percentages of women admitting to and justifying false allegations. They often get suppressed by those who have an agenda. A few of these studies are cited below:

I had a sister, now deceased, who lied about it; told us while hammered drunk. The only evidence they had was that they had had sex and her word, there was no evidence other than that and he said, as she later told us, that she asked him to do it. It is one of the great progressive lies, required because as far as feminists are concerned, rape trials are sexist. The system should be, woman reports allegation to police and he is immediately locked up.

That is how the feminist me-too movement worked. An allegation was the same as proof of guilt and another man's career was destroyed.

OP, Your concerns are valid. The legal system allows No to Low evidence cases to proceed to trial. In these cases, outcomes depend heavily on credibility assessments, which - despite formal safeguards, retain a high degree of subjectivity & always produce harm to the accused.

Yea, mostly white knights propping it up. My experience in school was short but basically our entire school was each in a frat or org. Among them there were dudes who got all the pussy basically the chads. The other frats obviously in their jealousy, would wisper things in my ears like rumors saying their sexual assaulters. Then you'd talk to the chad dude bros and they were the chillest dudes you'd ever meet, sitting around playing chess and going to non college bars on the weekends. So basically we got tons of dudes friendzoned with a ton of girls constantly at their protection the moment a dude bro rejects them. You do know that only 2% of reported assaults are ever even prosecuted tho, right? This is in line with the number of falsely convicted ppl for every crime in America. There is a higher chance that someone who makes an insurance claim for their stolen car is making a false report. Now I'm not saying this country doesn't have a shit criminal justice system - bit I do have to say that the implication of this argument generally is that when people are raped they shouldn't be believed. When the 92% of the convicted ARE actually rapists, and the majority of sexual assault isn't reported at all because of the way that the cjs drops the ball constantly, I can't see the purpose of pointing to this stat as something uniquely and singularly shocking.

I was accused of rape by my ex gf after I dumped her for cheating. I was acquitted at the end, but I did spend a few months incarcerated. I was lucky, though, because she was crazy (personality disorder) but my lawyer told me a few stories from her experience where the guy was sentenced for rape after a women he had sex with accused him of rape after being caught cheating on her husband. I don't know if 8% is correct, but I can confidently say the number should be higher. Some number of sentenced people are 100% innocent. The problem is that, unlike murder where you have to have a motive, a weapon, no alibi and many other things to be sentenced, for rape you basically have to prove you didn't do it. Psych evaluation is one of the ways, but you have to be lucky enough for her to be crazy enough not to be able to hide it. I'm talking about EU laws, I have no idea how it's handled in USA.

This is 21 years old. And forcible rape being deemed false doesn't mean it was false. You're acting as though 100 percent of accusations result in an arrest and trial, and 50 of those cases are proven false. Of rape cases that are even reported, it's about 15 out of 100 that are even *arrested* and the percent is extremely small for them even going to trial, and even smaller of them being convicted.

Lack of physical evidence or witness (how many rapes are even going to happen in front of someone else?) plus lack of police actually doing their job means most don't even end in a charge, and any trial that does happen is going to be a character comparison. "What was she doing there, did she actually want it but now regrets it, what is she like in her day to day life?" Women's thongs have been held up as evidence that they're a slut who wanted it. Women recant after coercion and fear, and also don't report out of fear.

Rape cases are the only cases where the victim is put on trial to defend themselves while the defense for the rapist concentrates on his charming and successful character, how much this would affect his future, how no one has ever reported him doing this before.

The court system acts as though rape is near impossible to prove, so then how are they proving a false accusation? Do you truly believe every false accusation was deemed so because they found undeniable proof she was lying? The only way to prove it didn't was her not actually being there at the time. Whereas when reported, they can prove they were both there, witnesses could have seen him harassing or following her, she could have gone to the police immediately and a rape kit could have been done, and none of that (even combined) is sure to end in a conviction of the rapist. (Look into how many rape kits are backlogged.)

So while you're worried about a (very veryyyyy unlikely) false accusation, the rest of us wonder why you're more concerned about that than why so many rapes occur in the first place. You don't look into the legal system's response to rape at all. You see a 21 year old stat, no doubt understand it wrong, and have no knowledge on why these stats are very likely inaccurate. You're more concerned about a false accusation from a woman than the fact that you are more likely to be raped by a man than be accused.

False rape accusations, at least as defined legally are relatively rare. Several studies by groups, universities and police precincts estimate false rape accusations between 2.5% to 10%.

However one thing all these propaganda spreaders conveniently drop is that the remaining 90% to 97.5% are not legally proven rape accusations either. False rape accusations in all these studies are categorised as such after being conclusively proven as false. While proven rape accusations are generally estimated at 2x to 3x times the number of false accusations, the majority of rape accusations - probably close to 50% - are in legal limbo; neither categorised as proven or false, often he said she said scenarios with no other proof whatsoever. Innocent until proven guilty means no one is punished, however it is not counted as false either.
