Long story short. Twelve year old son tells me he wants to live with me full time. I have my kids week on/week off with their mom.

Son is pissed that his mother always lies about having no money although she is college educated. I also pay my ex plenty of child support, alimony, and so on.

I file a modification of custody. Get a hearing a month later. Ex lies about leaving three children home alone 10 times that she can remember (30 misdemeanors in my state- caretaker of multiple kids has to be at least 13 years old). Son testified that mom drinks alcohol every day, drives them around, etc. he testifies that he has to make his siblings food every night since mom passes out.

Judge was snide with me after my closing arguments and gave my ex full custody of the kids. Judge must have known he was wrong because he never wrote it all in an order nor did he rule from the bench (i.e. nothing has changed with custody).

I hired an appellate lawyer anyway and we are filing an appeal and complaints against the judge and my ex wife’s attorney. It will be great when the legal errors are exposed, and a judge and an attorney get sanctioned or disbarred for children knowingly being neglected. I always hope for the best and prepare for the worst but that’s all I can do. Well, that and being prepared.
