Generally speaking it's the first one to cry "rape" that is considered the victim. Safest bet is to be the first one at the police station after a night out. They can't accuse you of rape if you're already accusing them.

If a man or woman would consent to sex when sober, then there isn't a problem.

The problem is some people exploit and manipulate people who are so drunk they make choices they wouldn't otherwise, and that's not okay.

The more you guys focus on this strawman, the more you sound like rape-apologists. Why, sure, go ahead and have sex with all the blackout drunk people you want, but there are--and should be--consequences for that.

A lot more women take medication that interacts with alcohol than men. This medication in my experience with seeing people under the dual influence of drugs + alcohol can cause them to suddenly 'crash', or to be affected by the alcohol in an unpredictable way (sometimes more or less effect from the drinking). I don't think for instance that men should be held responsible for judging effects which for them can be unknowable at the time of sex.

EDIT: It's rape when the 'perpetrator' knows the victim cannot meaningfully consent. The element of mens rea seems to be essential.

Of course, maybe I just don't know what I'm talking about. I guess the other 95,710 people on the sub could just be lawyers.

Just to be a little bit of a devil's advocate here. As you can see she's quite thin so she's probably getting quite a bit more drunk than he is. She's childishly irrational so she probably isn't the best at understanding and making decisions and owning up to them while sober so drinking only exacerbates her problems. The man is probably not that drunk and far more rational to begin with and as such is, even while drunk, capable of inferring that this woman could never give informed consent in any state, but especially not while drunk. All of that considered he might be more responsible than her. Maybe it's rape when you think of it like that.
