As someone who supports the court's ruling, the misinformation here is really annoying.

Correct me if I'm wrong, but the ruling essentially states that if you're doing something in public in plain view (e.g., sitting on a bus in a skirt with your legs spread), because it is legal to photograph anyone in public in the States, photographing a person exposing him- or herself is thus not a crime. It would still be a crime to photograph somebody upskirt by holding a camera under her skirt, since that's not in plain view and thus is private.

~~At least, that's how my law professor described the issue, but I may be wrong. Please correct me if so.~~

Edit: There was some miscommunication and I believe I got the details of this case incorrect. It seems that the court's ruling stemmed from a lack of a law criminalizing this behavior, which Massachusetts just passed a few days after the ruling. In which case I still agree with the court's ruling (judicial system shouldn't make laws) just for different reasons. Source.

The fact is there is a element of personal responsibility and the only thing missing in his (demonspawn) comment was mention of plain sight. If someone intends to hide something it's one thing but it's another to make an effort to circumvent a reasonable expectation of privacy. That's the difference between a perv with a a mirror on his shoe and a person sitting across from a lady in a short skirt who sits with her legs wide open. The legal distinction is necessary as is the real issue of rights. You don't want to see men or women jailed for photos of women on a public beach.

Also would we arrest the photographer who caught Brittney Spears without her draws? I don't think so, because that was a failure on her part. Nobody told her to go out without underwear or to be a sloppy drunk who can't even get out of a car without exposing herself to a waiting horde of photographers she knew would be there. Notice rarely do other celebrity women have her problem. They either wear underwear or get out the car like a lady wearing a short skirt. Keep your junk out of plain sight, that's your personal responsibility. On the flip side there is no right to photograph what isn't in plain sight. A reasonable expectation of privacy does exists for our own good be you male, female, or child.

I know how this sub gets at times. And yes, there are plenty of folks who will say stupid things like "bitches are crazy" and "women whine." I've seen so many demeaning and resentful comments about women around here equal to the amount of thoughtful and worthwhile discourse, so they are not just inferring when there is plenty of empirical data to pull from. Regardless, we seem to be turning into Japan. Awesome.

[Edit: It is not clear to me that they were implying MRAs supported upskirting so much as it did that no one thought it mattered and people were irritated with women "whining" about it only to result in some action in their favor]
