Is it sexist that women lose the right to consent to sex if they have have been drinking?

In women's 'best interests' the government restricts the scope of their right to consent. Women can't be trusted with the same level of legal consent as men. For example, in states with automatic-arrest laws, women can't refuse to persecute their alleged abusers. I'm sure as time goes on we'll see the state restricting women's right to consent more and more.

For their own good, of course.

Never buy a woman a drink.
As soon as a woman drinks anything alcoholic, pretend she's radioactive and get away from her.

HA!! Do you wanna hear a story about drunken sexual consent, sexism and Reddit?

A few moths ago I posted a topic that said "What does it really mean when a woman wants to stop in the middle of sex?" The disturbing and sexist replies I had to endure made me SICK! Here's a quick summary: Me and an old high school friend got together for drinks. We connected over facebook. We both got drunk. I ended up driving her home. We had sex, and she wanted to stop. She became teary-eyed and apologetic. I said it was it cool, and I left. Well, HALF of you redditors accused me of RAPE! You said that considering she was too drunk to drive, then she must have been too drunk to consent to sex. What about me? I was drunk too! Too drunk to drive in fact. I shouldn't have driven, but I did. BUT, because she is a woman, I guess she is too "stupid" to realize she shouldn't have drunken sex? WTF?!? I was too sober and knew what I was doing? GIVE ME A FUCKING BREAK!! Needless to say, my question was never answered and I was labeled a RAPIST by Redditors. Its a real fucking shame that educated men are falling into this sexism trap! Fucking white knights....

If a man and a woman are drinking and the woman goes to court stating the man took advantage of her, he would be thrown in jail. Now even thought he man had also been drinking it doesnt matter. Some how he is expected to be superior to the woman and have a clearer mind and higher moral standard than the innocent victim female. It makes me sick. Sexism in 5th gear, right in our faces.

That depends on the state. In NY as long as she is conscious, and able enough to speak at all she has the right to consent, she could be unable to stand but still able to consent.

Laws vary place to place. Google tells me that where I am, the laws are gender-neutral: "A person who agrees to sexual intercourse when they are under the influence of alcohol or other drugs and who would not have agreed were it not for that influence will be treated as having consented. It is only when they are unable to make a decision about whether or not to consent that the law will invalidate any apparent consent." So basically, if you're too drunk to consent, you can't consent, whether you're a man or a woman.

Yes it is...there should be warning labels on all alcoholic beverages indicating that "Standards and good judgment may be lower than normal while under the influence." That way they will have no excuse. As for the sex while one is sleeping being considered rape, get her to do it to you too so you have equal ground in case a sticky situation should ever arise.

The law needs to completely get rid of the clause, paraphrased, "person would not give consent if sober." How the fuck are judges or lawyers going to be able to prove that person really wouldn't give consent if sober? The law should be: If you're drunk and you initiated the first drink, then your intent was to be drunk, and you accepted the consequences of being drunk, which include consenting to sex that might have embarrassed you later.

"Implied consent" in the event of emergency care means that if someone is passed out, it's assumed they want help. This means that if someone is refusing help--let's say, the Heimlich maneuver--once they pass out, you can help them (it's technically assault and battery if you try to do so while they're still awake).

So, clearly, the solution is to wait until they pass out!

Short answer: no.

Long answer:

It's difficult to discuss this purely in the context of consenting to sex, since we're talking about something which raises people's hackles. So, I'm going to talk about this in a broader concept of consent as applied by courts in torts cases.

Basically, it's possible to consent to any intentional tort. I can consent to battery (fights are an example), trespass, intentional infliction of emotional distress (horror game shows), almost anything. I can't consent to negligence directly (though there is assumption of risk, within limitations, and that's a completely different issue).

But, there are limitations on that consent. If, for instance, you promise to only punch me lightly in the jaw, and end up breaking my jaw after I agree to let you hit me, chances are that I'll be deemed to have not consented (since you obtained the consent through fraud).

A similar standard exists with intoxication. If the reason I am consenting is because I'm drunk out of my gourd, I can't have really consented. In order to consent, I must be within my right mind.

So, it's not quite "women can't consent if they've been drinking" as "no one can consent if they've been drinking".

Now, if someone would post something akin to "well, what if they're both drunk" I can write my spiel about mistake of law, which also helps me prep for my crim law exam.

Aparently they are too stupid to be drinking as well . We should remove that from them too. Just to make sure that they can make rational decisions. Of course no one wants to accept responsibility for their actions.

In my experience 9 times out of 10 it is the women that become really sexually agressive after drinking. I have been downright attacked on occasion. Of course I have to say nay, for fear of going to prison and being some big dudes meat sock for the rest of my life.

I don't think it's fair that men are automatically presumed guilty in the situation, when they have been drinking too.

Now on the other hand, if I do see a guy CLEARLY taking advantage of a drunk girl, I will proudly tear his sack off like a paper towel!!

Actually it's kinda worked out okay for me. First time with a new woman I'll refuse to while they are drunk or high. Often, for really hot chicks, this is the first time any man said 'No'. No confident woman will let a conditional refusal stand. They'll either persevere all night 'till they're sober or come back the next day to take your offer.
