In spain the complaints of "gender violence" are totally free and are almost never investigated/accused even if they are proven to be false. If it seems absurd to you that judges ignore 3 previous false complaints, imagine 20-30, and all staged in "gender courts" where everyone is indoctrinated in feminism.

Did he have sex with her, that isn’t in dispute, nor is that she was at a bar with him. She never claimed he raped her till 2015 when she realized she was losing full custody and getting joint and now is training her daughter to be a whore on top of claiming falsely he raped her.

I have a go fund me right now trying to raise funds for a civil suit. But the Sacramento family courts is more corrupt then most. As a 100% disabled veteran, lawyers fees is my yearly disability so I have no hopes

Man, I am sorry. I can related, it wasn’t that long, but I have had multiple TROs that I had to fight off and I lost 2 careers due to false accusations, including my military career.

Worse, I was expected to go to OCS, so I covered up a lot of injuries and told them a month before I went my knee was fine, I still have bolts holding my knee together. So no disability for me. If I knew they’d have pushed me out based on a false arrest, I wouldn’t have told them that. Bolts in my knee and the Army said I was fine, so no disability.

Keep up the good fight and don’t become one of the 22.

Nope. Ex-wife has been found 3 times in a row filing false statements (under penalty of perjury)… they just tell her it’s false and she files another BS one. Ask will they ever hold her responsible and was told no as they don’t have the resources to go after every women filing false statements. So had to cough up $400k.

I got at least 12 formal accusations of abuse/harassment by a girl that I only eat a pizza with, once. Exonerated in all of them. Judge even said to her that she was accusing me of something that is not a crime (being mean to a girl is not a crime) and abusing the courts. She didn't care, just wanted to cause trouble. Here, the courts just assume you are guilty and offer you a probation or parole. Had to cough the equivalent of a house in lawyers.

If a woman looks legal age and provides ID (which is false, but noone but her knows that) to prove she is of legal age then is it just for the men to be labelled a "rapist"?

In the UK 16 is actually the age of consent.

In most of the US 16 is the age of consent too. There are certain exceptions though, like a 16 year old cannot have sex with their teacher or their boss.

In fact, I’d argue it should be a crime for her.

We are told that women want to be treated equal, well fraud is a crime.

I find it appalling how many obvious females in the article comments are saying, “She was 16 so she couldn’t consent, so he needs to be charged.”

He consented based on the false information she gave him. That should be a crime. He committed no crime based upon his reasonable expectation she was over 18.

So stupid that this is an issue. If two people meet at an 18+ setting and they have consensual sex there should be no question about whether it was statutory rape. Yes the people and business involved should be reported to avoid people using it as a loophole but overall the girl shouldn't be using a fake ID, the business should improve their ability to check IDs, and the guy should continue following the law to the best of his ability.

Multiple court decisions. The facts about the sexual encounter were generally agreed upping in 2015 and the court felt there was no sexual misconduct by him since the events leading up to it were basically agreed upon.

Even she basically states the main points:

She said that she met the man in 2005 after a night out with friends at a bar in Hammond, when he offered to drive her home.

We also have her having a long history of lies, which I have listed and you simply ignored so let me list what lies we demonstratively know:

  1. She claimed the father was a man who was in prison and goin the child to him to bond with.
  2. She claimed that he sexually assaulted his daughter, which the court rejected by preponderance of the evidence.
  3. She claimed her losing custody was because she gave her daughter a cell phone, we now know it is because she made a false accusation of sexual misconduct to alienate him from his daughter, she knowingly let her unable to consent daughter have a sexual relationship, she allowed her daughter to use an unrestricted and unmonitored cellphone. That is a lot more to the story than her claiming it was because she gave a cellphone.

A Louisiana woman who claims she was raped at 16 by a 30-year-old man has been ordered to give up full custody to him — after he accused her of giving the teen a cellphone.

There was a case similar to this and the guy didn't do any time but he got put on the sex offender registry. After a lot of outrage I believe he got taken off.

In Canada you can use mistaken age as a defense. But not in USA, even if the girl lies to you and shows fake ID.

No, because he had every reason to believe she was of age. Unfortunately, in many states in the US, a mistake of age defense isn't even allowed! Even if that's exactly what happened. I wouldn't expect the mistake of age defense to work, if some dirtbag hung out at a middle school picking up girls. But if she was in a bar where you're required to be at least 21, and bars are usually very strict in that enforcement because they could lose their liquor license, and her ID looked real, in such a case the man should be exonerated due to mistake of age, or maybe they should call it "deception of age."

A woman will always win given the fact that our society at the moment is gynocentrist.

That's one of the reasons why women win but what a lot of people don't realize is men themselves shouldn't play along and start to use the law against women.

A woman in the past also reported me once for sexual harassment then I wrote a whole protocol afterwards contacted my lawyer and looked at the surveillance cameras. Four reports were made because of false suspicion, pretending to be a criminal, offense harassment, insult and character assassination and I got all five.

I won in court because of to many evidence and the woman had to go to prison afterwards. Just don't play with a woman. If she Sue's you and she has no evidence, started bringing your evidence to the judges and put several things on top of that so they don't have a chance to take action against you. Simply as that. I won because of that and showed no mercy.

Does anyone know what the age of being allowed to drink in LA is? Why is no one going after her and her friend for underage drinking AND the bar if she admits she was there doing it?

It’s 100% 21 years of age, with some exceptions for religious reasons and in private home with guardians.

Statue of limitations is expired on her under age drinking, unfortunately she is pushing him to be charged for rape, when he didn’t do anything but fall victim to fraud.

So she put another man on the birth certificate, he was in jail, she even took the child to bond with the guy.

Then it came out. There is a dispute how it came out, she claims he didn’t tell her, but that doesn’t jive with her story she didn’t tell anyone about the “rape”. He claims she told him. So far the media hasn’t really delved into that issue, but that was 2011

He had a paternity test done and it was his. Again, there was no accusations of rape, then as the custody went to give join custody, she all of a sudden said she was raped, and not just because she was underage, but that he drugged her and raped her.

The worst part is that he did sleep with a 16 year old, but she fraudulently claimed she was 21 by being in a bar buying drinks. She also lied she was in college.

Then this year she lied about him raping their daughter. Yes the daughter was examined and was sexually active, against his will. The court found it was sex with her BF and not with the dad.

So between violating the court order about the unrestricted phone, she also attempted to use parental alienation to get even with him. Court was appalled and revoked her joint custody.

She went to the media and played the victim, and used the magic word, like Amber Heard style move, and claimed rape. Now the media has so much pressure on the judge he reversed his decision. That isn’t justice, that is mob rule.

If she was in a bar when she was 16 the assumption is that she’s over 21.

There was a statutory rape case in the 80’s where the supposed victim came to court looking like she was on her way to Sunday school. The defendant told the court that that’s not how she was dressed when he met her at a club. The judge made the “victim” go home and return to court dressed in what she was wearing when she met the defendant. Upon seeing her, the judge tossed out the case saying that there was no way the defendant would know she was 16.

There isn’t a chance in hell he will be convicted or even charged with drugging her.

I used to hang out in and work in a bar where there was a chick whom a lot of guys there had had sex with. One night I’m tending bar and she comes in happy with her ID showing she was now legal to drink. She’d been coming in there since she was 16 and you could see all these guys, including me, calculating when and how many times they’d taken her upstairs. If she was vindictive she could have had a lot of guys arrested for statutory.

Jesus, I don’t think I made it even halfway through this mess of a story. I need a TLDR lol. I don’t really know what to think over all. No 16 year old child needs to be exploiting herself in such a huge platform, that’s for damn sure. As for the mom and dad—I don’t even know what to believe. I’d like to give the benefit of the doubt to the dad until there’s confirmed evidence that he’s ever committed sexual assault. Innocent until proven guilty. I also don’t want to just assume the mother is lying, again, there needs to be evidence. And at this point, I pity the child. What a circus.

So they met at a bar. They both had a few drinks. He drove home and they hooked up. She left. She never told him she was pregnant. She listed another man on the birth certificate. He was in prison, when this man found out he was the father, his daughter was age 5.

He seems to have stepped up to be a father, and the courts agreed, till the PR machine ramped up and took to the media a false accusation of rape.

There needs to be a criminal charge if a girl falsely claims she is over 18 when she is not.

It gets worse for her accusations:

On February 25, Abelseth in court documents accused Barnes of sexually abusing their daughter.

'Minor child contacted me (her mother) on February 23, 2022 with the suspicion that her father had drugged and sexually assaulted her two nights in a row,' the court documents state.

Abelseth stated that the Children's Hospital of New Orleans confirmed 'evidence of forced entry congruent with sexual assault'.

In the papers, she states: 'My daughter, minor child, was conceived as the product of the defendant raping me when I was a minor child of 16 years of age.

'I suspect drugs were used by him to sedate me as I was unable to move while he raped me.

'Now it is alleged that he has committed the same heinous crime on our 15-year-old daughter.'

On March 18, the allegations were dismissed by the court, which found that 'medical evidence does not support allegations in petition'.

Two days later, Abelseth also lost custody of her daughter, and has been forced to pay Barnes child support.

He claimed in court documents that Abelseth was allowing her to have sex with her boyfriend, and that the phone was being used for the pair to 'sext' each other.

So she claims sexual assault on her and then literally makes up the exact same accusation about him with their daughter.

Daughter’s sexual activity is answered why the medical center said she had sexual activity, and why the court found it baseless in the accusations.

Glad the court saw through it.

The last accusation I was accused of choking my ex. I literally have photos of scratch marks on my neck from 6 years ago with scratch marks. These accusations cycle. It was one of the points I made to the officer when he was investigating the latest accusation against me and was like, “Oh, that explains the accusation, it is her go to method of attack on you.”

The issue of consent is his word versus hers. Given the burden of proof in criminal cases is for the prosecution to prove beyond reasonable doubt, her propensity to lie when it suits her, and his honesty so far, he has more credibility.

False, it is a mandatory report, just as when i was a teacher, if I ever found out another teacher had sex with a minor, even if the student had become an adult 5 years earlier, I still have to report. Louisiana is a mandatory report if the judge felt a crime against a minor was committed, the judge did not, therefore did not forward it.

Hearsay? She has yet to dispute it. Also, it isn’t hearsay, it is his testimony that they met at a bar, you really need to understand what hearsay evidence is. That isn’t hearsay.

She has totally left out where they met in interviews, she just says he gave her a ride home, and either reporters didn’t ask or she just skipped over where. In fact the court documents make it appear that the bar isn’t even in dispute with her:

Abelseth stated that the Children's Hospital of New Orleans confirmed 'evidence of forced entry congruent with sexual assault'.

In the papers, she states: 'My daughter, minor child, was conceived as the product of the defendant raping me when I was a minor child of 16 years of age.

'I suspect drugs were used by him to sedate me as I was unable to move while he raped me.

'Now it is alleged that he has committed the same heinous crime on our 15-year-old daughter.'

On March 18, the allegations were dismissed by the court, which found that 'medical evidence does not support allegations in petition'.

Two days later, Abelseth also lost custody of her daughter, and has been forced to pay Barnes child support.

He claimed in court documents that Abelseth was allowing her to have sex with her boyfriend, and that the phone was being used for the pair to 'sext' each other.

So she complains that the father had underage sex with her, but she is literally facilitating underage sex (making her daughter a slut, just like her mom was/is) and now is complaining about being sexually assaulted because she lied about her age. Sorry, not sorry that she deserves nothing from the court.

So let’s go over the facts and see if we can spot the pattern:

Lied about her age at a bar

Lied about who the father was.

Lied about the cellphone being the issue.

Lied about him sexually assaulting his daughter.

See a pattern?

Admittedly, I’m not an expert, but I did mock trial for a while and my dad is a lawyer, so I could ask him questions about the rule of evidence. Hearsay includes even non-verbal communications. Many of his observations of her conduct would be hearsay. Like, he allegedly sees her drinking would be hearsay if used as evidence to prove she was at least 21. If she did in fact tell him she was a legal adult, then that would actually not be hearsay because that’s be exempted as an admission by a party opponent. The problem, though, is that still leads to the he-said she-said that leads to all these problems in the first place.

  3. I’m confused by your characterization that she and her daughter are “sluts” because of underage sex. My understanding is that the term “slut” is generally about the number of partners, not age. And I hope that you’d apply the same logic regardless of which gender is involved.

Most bars do not allow under 21 into the bar. I worked at a restaurant that turned into a bar at 2100 on Friday and Saturday, no one was allowed in under 21 and the under 18 busboys weren’t even allowed to work by the rules from the alcohol board.

Maybe some states are different, but until proven otherwise, I’m going to go with the fact she was presenting herself off as 21 or at least 18.

No problem. The story has been out for over a week, I thought it was rape rape and not, “I’m 21, been drinking at a bar and telling you about college.” rape.

I visited my parents and Saturday the news had her saying it was for a phone and she was raped at 16 and said there was no other reason for it other than he is well liked in the small town.

Having been through constant custody fights for the last 5 years, something didn’t sit right with me. So if spend time Monday, Tuesday, and the morning of yesterday.

That is when I realized that she was lying about the phone and lying about her daughter being raped. That is when it didn’t take much logic to realize that the entire story of conception of the daughter matches, except the drugs and that the accusation didn’t come out till 4-5 years after the custody battle, therefore it is reasonably likely a lie too.

So I posted this. It is why I defended him through out this. The reason is because I have been accused for DV. I NEVER have been accused before from any other GF or SO, never was accused by her, it wasn’t until I filed for custody that I was accused by her and arrested, 3 days after she was served.

He morally did nothing wrong, except maybe fornication. She has a long string of immoral actions from 2005 to today.

Anyways, have a good one, think for yourself and ask questions. Can’t go wrong doing that.

My ex has 2 felonies, but they still give us joint custody.

I mean, on one hand, you have a Mother that has lied since being a teenager, had multiple partners, lied about who a child's dad is, dragged said child to a prison to bond with her fake dad, clearly influenced the child sexually and broke the conditions of the custody agreement.

On the other, you have a guy that was lied too, lied about but has obviously worked hard enough to be in the position he is. Since finding out the child is his (which he seemingly just magically found out according to the Mum, another lie in there somewhere) has fought through the courts and probably paid a pretty penny to get full custody. Again, she met him at a bar, claiming she was a college student in 2005! She got pregnant and lied about the father. Then it came out (which is in dispute how he found out he was the father) in 2010/2011. She never accused him of rape, until she basically realized she wasn’t going to have full custody. Then in 2015, after having agreed to the exact same story he had about the bar, decided to come forward and claim that while she was at a bar, buying drinks and telling everyone she was in college, he took her home, then drugged her and had sex.

Now, you might say, but still looks bad it was that long ago. Well less than 6 months ago, she claimed he drugged and raped his daughter. The court found, not just reasonable doubt to dismiss the accusation, but found by preponderance of the evidence it didn’t even happen.

So we have her lying about the same exact situation, except instead of her being the victim, it being her daughter.

How many times are we to believe her when she has a documented history of lying, but this one time she is being honest? Nah, I don’t buy that.

So let’s go over the undisputed facts:

  1. They met at a bar.
  2. She was using a fake ID to buy drinks.
  3. She told people she was attending college.
  4. She took a ride with him and had sex at his house.

  6. She got pregnant.
  7. Claimed the father was a man who later ended up in prison and had him on the birth certificate.
  8. When the baby was 5 in 2010/2011 Barnes found out, sought legal advice about the girl and filed to protect his rights.

Disputed facts up to this point:

  1. She claims he drugged her when she got to his house and barely remembers the sex.
  2. Claims she was raped and told no one.
  3. He implies she told him about the child, but otherwise never addresses how he found out.
  4. She claims someone told him, but this contradicts her claim that she never told anyone about the rape.

Back to the undisputed facts:

  1. Four years after the custody hearings started and she basically no longer had full custody, she decided to claim she was drugged and raped and filed a police report. Wasn’t pursued for whatever reason.
  2. Late last year their daughter was having a sexual relationship with another teen.
  3. Dad moved in court to tell the mother to stop allowing her to have sex when she was with her mother (whole age of consent thing where mom got knocked up at 16 and her daughter is 16.)
  4. She had a medical exam on her daughter. It confirmed that she was having sex.
  5. The mother filed a new accusation, claimed that her daughter was drugged and raped by the father based on point 4.
  6. The court looked at the accusation and decided it was unfounded in March.

Disputed facts:

  1. She claims she lost custody solely because she gave her daughter a cellphone.
  2. He claims, it was the false accusation and because the court approved her to only use a restricted cellphone that he could monitor (remember the whole sex with another teenage boy at 16). He claims that because she violated the court order, that added to the judge’s decision to remove custody from mom.

Seeing how it is undisputed that she accused the father of a false accusation of rape of his daughter, it is reasonable to know that she is lying about the drugging and raping of the mom.

When she lost in court, she went to the media, claimed rape, and that she only lost joint custody because she gave a phone to her daughter. All her claims in the media are lied or half truths.

It isn’t immoral to he slept with a 16 year old when he had every reasonable belief that she was 21, because she was fraudulently passing herself off as 21 at a bar.

He claimed in court documents that Abelseth was allowing her to have sex with her boyfriend, and that the phone was being used for the pair to 'sext' each other.

So she claims sexual assault on her and then literally makes up the exact same accusation about him with their daughter.

Daughter’s sexual activity is answered why the medical center said she had sexual activity, and why the court found it baseless in the accusations.

So again my point stands. She didn’t make the accusation until she looked like she wasn’t going to get full custody and then when it looked like she was going to lose primary, she made up another false accusation the court dismissed.

No denying she’s bringing the rape allegations back from the dead to get back custody of the child.

That said, if the allegations are proven to be true, that will have had nothing to do with custody.

The fact is he did, and he admits to sleeping with her at 16. He states and the court accepted that she was at a bar, using a false ID, and she was stating she was in college. The court accepted that he had no clue she was 16, hence why the sheriff ignored the case, the time and other issues with the event.

He didn’t even know she was pregnant and had his kid for 5 years. She listed a prisoner as the father, it appears she found out he had money and then broke the need and filed for child support in 2011. Then in 2015, when it appeared that she wasn’t going to get full custody, but joint, she stated complaining she was raped.

It then became a huge issue after 7 years after she was a continued nightmare, made false accusations about their daughter being raped, helped her daughter become a slut by encouraging her to have sex BEFORE the age of consent with another teen, when she is complaining she was raped at the same age with someone the court admits didn’t know her she.

She also helped encourage sexting by giving her daughter an unmonitored phone without SM restrictions.

Now because of the media storm and women’s groups, they are pressuring the state to charge him with a crime that he had no intention of committing if she would have been honest with him.

Again, you are missing a huge fact: She met him at a bar, was drinking with him, and clearly told him she was an adult. How can you claim a man statutory raped someone when they had ever reasonable expectation that she was 21 or at least 18. The only fact that matters right now: If she was 16 when they first had sex then it was statutory rape.

This is true and were the circumstances similar that would be a very valid point.

However there are a few mitigating factors to consider.

In many of those cases the women are ‘trusted adults’, often teachers or bosses at part time jobs. He was not, nor tried to be at a place that put him in contact with school age children.

She was, according to her own account, at an ‘adult only establishment’, a bar with the intent to be served as an adult. She admitted to having a fake ID, proving her intent to lie about her age.

While now it’s easy to go to a brewery or public venue that serves as a minor, 16-17 years ago that was less likely and it was even less likely to have been described as ‘a bar’.

Should he have asked or tired to check, sure; but how often do you check the age of a partner with an ID and then question if it’s fake?

The timing is also in question. The time between ‘the act’ and her filing is 10 years (I don’t know why this article says 5, 2005- 2015 = 10). Looking at the start of the custody case items (again, noted in the article) it sounds like that was about the time those cases started.

Then this next set of allegations come at the back end of her loosing custody and only now the police are taking her earlier ‘rape’ seriously. That interest is convenient given the now increased media coverage.

Nah, this whole case doesn’t pass the sniff test and it would be a travesty for it to be used as precedent for case law… which means it will be.

The trusted adults status affects the age of consent so that studemts who are over the age of consent still are considered to be abused if it's by someone in a trusted position.
Not au fait with your laws, but I assume that if a minor is in an adult establishment it's considered the fault of the establishment. It doesn't make any real difference though either way.

I agree she should have gone to the police a lot earlier than this, it is suspicious but not proof of duplicity.

None of this addresses or affects the issue that even if she consented on video in front of a few hundred people it doesn't matter, she was still under age and therefore still cannot give consent. Sniff it all you want, that's proven with the age of the kid and presumably DNA proof of paternity.
We should not be supporting this case as relevant to MRA.

No, it is because she was using fraud. She was at an adult establishment and according to records telling people she was in college at Sadi establishment.

He didn’t morally rape her in any way, shape, or form.

Maybe LA doesn’t allow the fraud to be used as a defense, but it absolutely should be available, because he has ever reasonable expectation to believe she was of the age of consent.

It isn’t like she doesn’t have a long long history of lying.

The problem is you're trying to justify something that's definitely illegal and is proven to have happened with something that isn't illegal and didn't definitely happen. No, she is at fault for deceiving him, it has been admitted into evidence that she was portraying herself as being in college at the time and the courts accepted that. Therefore, your entire premise is garbage and you are defending an abuser and wanting to convict a man who did nothing wrong. This situation is as false of an accusation as a woman who happily sleeps with a man after a few drinks and then claims the morning after she was raped because they both had been drinking and she regrets it.

The judge gave the father custody for 2 reasons. Her mother was encouraging sexual activity, for what she claims at the same age was rape in her case. That proves her complaint is only a legal tactic and has no bearing on her moral position as a rape victim, because she is not a rape victim.

The second reason the judge stated was that she provided a phone that was not restricted and able to be check by the father to prevent the sexting that was occurring.

Having worked in a school district in the past, I can assure you that sexting is considered child pornography, because I have seen students arrested for having naked pictures of their ex-girlfriend, which is another debate.

The mom is said to have lost custody after giving her daughter a phone, which Barnes said the teenager was using to 'sext' her boyfriend and post sexually explicit TikToks.

Given their ages and the DNA test, he probably statutory raped a 16 year old. On one hand I question why you'd give custody of the kid to someone who took advantage of a child to conceive. Seems horribly unfair to me. On the other hand, I'm bothered this reconsidering is only happening because the victim was a girl in this case. The decision has never been reversed when the victim was a boy and there are far more boy victims with child support obligations. Either a lack of consent to sex matters or it doesn't. The sex of the victim (and associated public outrage because of the sex of the victim) shouldn't be a factor.

The interviews to the media she gave still insists it was because she gave a cellphone, but it is clear the court was upset she gave an unrestricted cellphone and letting her daughter sext.

Oh, absolutely. I was in graduate school and they had a 4 day board game convention at the university. Met a girl, there with the community college group took her number, she said she attended the community college. Ends up, she did, but that was through a high school program.

I found out, because about 2 weeks after I met her, she asked if I’d go to homecoming with her.

So glad I hadn’t slept with her at that point.
