Did everyone had divorce no kids no property in CA? I’m almost a year in this process… 2 TSC without any resolution, next one in September, my wife trying to delay the process… Hopefully will have a trial date in next TSC…

Texas here. Took me 25 months. Nothing really that complicated with our situation. Both of our attorneys were fucking terrible. We fought for sure, but basically our attorneys didn’t give a shit. 6 months would go by with zero progress made. Best of luck to you!

In AZ? Divorces go fast! Get this, from my divorce a few years ago.

Nov 1st. She got served divorce papers.

Last week of Nov, we had our temporary orders meeting. Divorce trial set for 2nd week of January.

Last week of December, we tried mediation, which went nowhere.

2nd week of January, her lawyer wasn't available that day, so divorce trial got pushed out to March.

Last week of March, 3 hour divorce trial.

Day after Memorial day. Divorce decree In Hand!

Filed first week of September.

Initial decree draft was sent over the week before Christmas.

We just signed final paperwork last week, and I'm hoping a judge will sign off on it in the next couple of weeks.

So about 8 months overall, and only because her lawyer was slow as fuck and she had no real incentive to move forward, because I was already freely/willingly paying child support. Not nearly as bad as some, but longer than it needed to be.

Do you get copies of the business’ income tax returns? I suspect your stbx and mother might be doing something with earnings and valuation. You might need a forensic accountant, depending on how much the business is worth.

You want results, not a bargain. No one cares more about your divorce than you. Not your STBX, not opposing counsel, not the judge, and certainly not your attorney. You have to understand the primary motivator for attorneys: Billable hours. You need to manage your attorney. When you hired your attorney, you should have set ground rules about communication. Sounds like you need to revisit that, and set expectations.

The fastest way to get your divorce finalized is to head to trial.

It depends on the parties. It can be as fast as 3 months in Texas if both sides cooperate. I think there is a 3 month waiting period between filing and final decree with a few exceptions for special circumstances.

But it takes two to tango and many times it is to the wife’s advantage to drag it out especially if the husband is out of the house and ordered to pay the bills. This gives her economic leverage to force an unfair settlement.

My advice is to request a trial date at the earliest possible date. A looming trial date is a good incentive for settlement. Most cases will still settle before trial. Delays just cost more in ligation cost besides prolonging the emotional turmoil.

My Texas divorce (with kids, a home, and somewhat significant assets) was over in less than 3 months. I filed (blindsided her to avoid some of the pre-divorce shenanigans women often pull) and she had an attorney within a week. Our attorneys exchanged our financials (no formal discovery - I had a good idea what she had and would have known if something was missing) within weeks and set a mediation date roughly 5 weeks after my filing date. We hashed it out in one long 9 hour day of mediation and then her attorney wrote up the decree over the next two weeks - another week of back and forth on wording of decree after our review and markup and it went to the judge to be signed just a few days later - I never even actually had to appear in court.

In short - the process does not necessarily have to take as long as it's taking. When attorneys and parties are motivated things can move pretty fast. I've got a buddy at work who filed over a year ago and STILL doesn't even have a mediation date. Of course he moved out off the top against my advice so his STBX has everything she wants - his money, his house, his kid, and no him - so why should she be in a hurry. I've been trying to light a fire under him for months to just set a fucking court date and get things moving but just as overrun as he was by a woman in his marriage he's overrun by a female attorney and won't rock the boat. Can't help those who won't help themselves...

Over 3 and a half years to get a final order. She had 4 lawyers. 3 judges. Still not really done yet since I finish paying her in 5 years after I already paid 3 and a half. We had 5 things to split. No kids.

I'm in Texas too. We have a house, 2 cars and a toddler daughter; we want to be as peaceful as possible for the good of our daughter. She also makes a lot more than I do and we're in agreement on how to split baby's expenses.

She asked for divorce April 16. We're in agreement in nearly everything, we'll probably file within a month once we have our agreement in place. Don't know what'll happen next

Have your lawyer request a hearing date. Once it's on the court calendar there will be a timeframe around when things need to be completed.

Be aware, she could be working on strategy behind the scenes, and she's just dragging it out for some nefarious purpose that they will spring on you later.

Beginning to end mine took almost 24 months, including multiple 8 hour mediations (which I footed the bill for, which was $8k each time). They would waste time or not respond unless there was a deadline, usually the threat of going in front of a judge was enough to get them moving.

I do this for a living and 6 months is fast. A year is the median. I know people will give you nightmare stories where it goes on for many years. And yes I’ve had one lasted 3 and 1/2 years. But those are so rare and the judge here will literally get angry with you. But things can happen in cases. Like jury demands and the wife getting pregnant and world changing events like Covid, etc etc.

We say in law that a case moves at the pace of the slowest lawyer. I have a trial tomorrow morning and it was filed 14 months ago. My client kept begging me to get it done faster and I kept telling her I’ve tried. The only thing I could do was set it for final hearing bc his lawyer was very stupid and didn’t know what she was doing. They already had a custody order. But her lawyer was just non responsive on the divorce filing. She got really interested two weeks ago and asked for mediation. And I told them no. It’s divorce only. So we can have a quick hearing. They offered to do an informal agreement and try to do prove up by affidavit and I just told my client they’ve been so bad at this so I doubt that will happen. So let’s just plan on seeing them in court. I kept channels open for us to talk but it happened exactly as I thought it would.

Your attorney is looking at your case and thinking it was filed 4 months ago. You don’t have a trial date. No one is probably pushing a temporary order it feels like. With no court date, no need to mediate so quickly. Your case just gets put on the back burner. I would just settle in and wait it out. You can beg your lawyer every few weeks to get do something to get it moving. But he may not be able to do anything.

Approaching 2 years in. Was supposed to have final hearing last week Thursday but she backed out and we have a conference with the judge on the 10th of May.

Did mediation and had an oral agreement. She reneged on it. She wants to stick me with her debt that she hid from me and racked up just months prior to filing for divorce. Interesting how someone who vowed to be a part of you can betray you in the worst ways and act like it’s no big deal.

My goal has always been joint 50/50 custody and being able to father our kids and that was agreed to. Her focus is more on money.

I'm 11 months in and pre trial conference with judge set for June 20 if no agreement we prepare for trial but custody is involved so they're dragging it out
