We have kids in 5th and 7th grade.

We would like to keep them in their schools. So one of us would like to stay in the house.

I’ve been the sole income provider

My lawyer assured me 100 times, that given the asset split, she will not get alimony. (Live in Texas).

She works, but not full time. Given her hourly pay (private in home nurse), plus child support (even if we have 50/50 custody), she could not afford the house payments.

But she wants to stay in the house as the primary parent, for the kids sake

She’s asking that I pay for all of it, while she stays there for a few years, and gets the kids settled and stuff moved out and sell the house.

But that leaves me with no money, and therefore not being able to afford basic rent for myself.

I think she’s delusional. But since I don’t agree with her, she just wants the lawyers to figure it out.

She doesn’t want to move out and rent for 6 months (this is the amount of time she thinks she needs to receive child support, to be able to qualify for a mortgage), then move again into a house she buys. Thinks that’s bad for the kids.

But I’m not sure how it’s ok for ME to do it, given we are agreeing to 50/50 custody.

I think she should I move out, get a 2 bedroom apartment, we “bird nest” until she can get a mortgage and buy a house. And SHE pay for the apartment.

But she refuses to move out (she filed for divorce, not me). And is now threatening to change the filing from “no fault” to “cruelty” and threatened to claim emotional abuse if I don’t do what she says.

So, has anyone been in a situation like this? Where I’m the only one that can afford the house (only one on the mortgage too) and she refuses to move out? Any creative solutions that don’t hurt the kids?
