Yeah, IDK about Saudi Arabia, but I lived in Kuwait for 2-3 months and they party hard. House parties are more common - friends invite their trusted friends, hook up basically any thing you want, drugs, whores, alcohol, etc, and they go at it. The rich especially (and ultimately, if you aren't rich, the Middle East is probably one of the shittiest places to live, so an American wouldn't go there unless he was loaded anyway).

That's the point. This is a power move, it has nothing to do with women's safety or solving crimes. It's about having control over men. The 'rape culture' hysteria didn't prevent any rape (since criminals don't read feminist leaflets), what it tried to do was paint every man as a potential criminal and every woman as a potential victim. ... I was reading an article from an old black guy, and he was saying that the real problem back in the day with being black wasn't as much the segregation where you had to sit in different places or go to different stores - I mean those were demeaning but you got used to it.

Article 128 (3) outlaws "unlawful sexual connection" (which refers to sexual acts other than those described in 128 (2) – i.e. without the penetration of genitalia by the penis – committed under the same circumstances of 128 (2).

The law differentiates between penetrative rape and non-penetrative rape, but both are still illegal.

That's just semantics though. That which we call non-penetrative rape is defined under law as "unlawful sexual connection," a form of sexual violation, the same crime as penetrative rape.

The article is based on this statement which never uses the word rape. It is added by the newspaper for shock value and as clickbait (worked well).

It's also worth mentioning that even with the proposed changes, the accuser must prove that sex occurred before there is a requirement for the defendant to prove consent, so fraudulent claims where no sex even took place would be thrown out.

I will concede that by the letter of the law, for an act to be deemed 'rape' it must include penetration. The 'spirit' of the law, however, comes back to this:

If a man rapes a woman, we call it rape, and the law calls it rape. The crime is sexual violation.

If a woman rapes a man, we call it rape, but the law calls it unlawful sexual connection. The crime is sexual violation.

Just because the law doesn't use the word rape to describe non-penetrative violation, does not make it any less of a crime.

So simple and yet so genius. I believe that this will be the way to go for New Zealand's males. Just after the law has passed they all go and file for rape. This will force the government to either step back from this dumbass shit or be sexist more openly towards men by modifying it.

This way it happened in Germany by the way. We had a discussion about cirumcition, which was ruled as being physicsal injury by a court.

This resulted in the parliament to establish a law to protect religous groups - especially the jews, justified by them because of nazi history - and to enable them to still mutilate their young males without having to fear consequences.

Of course the female agendas made sure that girls are being explicitly excluded from this.

Sure but if you keep the receipt and she claims you raped her or retroactively removes consent you tell law enforcement that she's guilty of fraud and should be arrested and charged as well because that's exactly what it is.

From a quick read of that article it looks like they didn't actually film it, they just claimed they did and that was enough for her to backpedal.

I imagine filming it would be good enough proof that you didn't do it and would save you from the accusation, but is also a crime. I wonder if you'd then be tried for that? Maybe in a separate case?

Making an accused man prove consent is no harder than making an accusing woman prove lack of consent, they are both fucked up. The proposed system wouldn't work because even consent in writing prior to sex could be made irrelevant by the person being raped changing their mind during the act. It's only rape in this case if person A withdraws consent (verbally) and person B does not stop. Then it becomes an issue.

Like if I loaned you something and then asked for it back, it would be theft if you refused and decided to keep it.

The difference here is that it's not rape if person A just decides they no longer consent, it's rape if they say they no longer consent AND person B does not stop.

Edit: Additionally, the onus of evidence is on the accuser, for good reason. Maybe women need to start recording their sexual encounters, or even better stop being alone with men. There is absolutely no legal system that could ever be put in place that won't result in:

A. Letting some rapists get away; or B. Imprisoning some innocent men

Plus the fact that women do often make false rape accusations and have been proven to abuse the already fucked up legal system can only lead, logically, to making it harder to prove rape.

The problem is, proving your innocence generally requires putting your life on hold, hiring an expensive lawyer, and then still leaving it to chance. For men who lack the resources to prove their innocence, maybe because they are just poor, maybe because they just got unlucky and didn't have an alibi despite being innocent, etc, they are just screwed. Not to mention that even if they prove their innocence, they still probably face losing their jobs, friends, getting slandered in public media with no recourse, and no way to sue for damages that the false accusation caused.

Stupid people who have no idea what being accused of a major crime does to a person see legislation like this and think "well, what's the problem, if he's innocent he'll walk, no biggie!"

No, you're looking at a financial and emotional cost that most people cannot actually deal with in this shitty economy. And I bet my ass that under this law, there are not going to be any decent, free or cheap attorneys provided to the accused or any modicum of privacy / protection during the period before guilt is determined. Because, of course, he is guilty from the get go.

This is just a law that is using a false hysteria to just make things shittier for men... with no other real goal other than to establish power and control over men. Just like, as another poster said, how women got behind the prohibition movement just because they were butthurt about men going out in town and spending their time drinking / hanging out with other guys. You're saying its not the same as having to prove yourself innocent.

You're saying that in cases where they can prove a sexual encounter took place (ie quite a lot of the accusations) the court will presume it non-consensual (ie your guilt) unless the defense (ie you and your lawyer) can drum up some convincing proof that consent was recieved.

It literally is exactly the same having to prove yourself innocent.

Ok so in that one very rare scenario where an accusation doesn't follow an act of intercourse, consensual or otherwise, sure, it's not the same.

But if intercourse has occurred (or she can convince a jury it did) which is the vast majority of all accusations, it is the same as having to prove your innocence...

Juries are getting very very loose with how easy they are to convince. And if they believe intercourse happened, as far as the case goes, it happened

They are only achieving convictions in 1% of sexual assault cases so they are knocking ideas around on how to actually convict rapists. Honestly I'd be ok with even collecting paperwork from my sexual partners if it meant helping put rapists in prison. The vast majority of sexual assault cases are probably actually rapes and it's good they are at least tossing ideas around on how to make it easier to convict rapists.

Enlighten me, why would this be conceived as us being rapists? Really I'm all ears. Is it because we discuss how men can get fucked over by a court system that already favors women? All it takes is one false rape accusation and you are done. Maybe you haven't known anyone that has been through that, but it can literally destroy a man's life.

Even the worst trp users don't advocate rape. In fact, feminists support rape so that the government will impose new laws to further restrict men. Whether the rape happened or not. Rape is so miniscule that .2% of 1,000 women ever encounter an attempt or were a rape victim.
