I understand why Cosby was released, and from a legal point of view, it's good that we're following the rules. It's just frustrating to see someone like that walking free.

Guilty or not, releasing him was the right and legal thing to do. You may not agree with it, but his rights were violated, and two wrongs don't make a right.

It's a really messed up case because functionally we have evidence that he is guilty (i.e. the evidence was sufficient for a court to convict), but the evidence is not admissible in court because it was obtained through violation of constitutional rights. Still, it's better to have a system where guilty people sometimes go free rather than a system where you don't have constitutional protections against the power of the state.

From what I understand, he confessed to doing it in exchange for not bring prosecuted legally. Imo, homeboy is guilty, but if the state made a deal they wouldn't prosecute him, they have to hold up that deal.

There was no deal. The supposed "deal" the majority are citing in this decision was just a press release that said "District Attorney Castor declines to authorize the filling of criminal charges in connection with this matter". That a bog standard example of prosecutorial discretion. I have a hard time reading it as some kind of promise that Cosby would never possibly face charges in the future.

The whole justice system just fucked itself up big time. Not only did they fail to properly conduct the standard procedure necessary for a conviction, it lead to the release of a rapist based on their own mistakes.

if they did this same kind of blooper with a younger rapist, he won't be as physically limited as Bill. Not the best of scenarios i must say..

I don’t think that video is an admission. I seriously doubt anyone is dumb enough to go on TV to advocate that boys as young as 11 have access to a date rape drug.

Spanish Fly is meant to be an aphrodisiac and while I do think that it is very wrong to give someone something without them knowing, this has nothing to do with the allegations that he used drugs to knock women out then rape them.

Legally it was the right decision. It’s really unfortunate that he was released, especially since he admitted guilt, but the law isn’t made to be ignored by anyone, especially the courts. He should have stayed in prison for a long time but I sadly agree with the decision

For the last time he already confessed to sleeping with Constand when she wasn't able to speak or move. He just assumed that if she didn't want it she would've moved or said something. But silence is not consent. And even if she took the drugs from him willingly she had no way of knowing he was using them to incapacitate her so he could have sex with her. He told her that the pills were her friends and that they would help her with her anxiety. He didn't tell her that they would be having sex.

Of course she didn't say "stop" or fight back. She was given a fucking sedative. Even one pill of benadryl is some strong fucking shit.

Judging by the comments and upvotes I don't see any of the hypocrisy here that you're implying exists.

There is one difference though: when someone like Cardi B does the exact same fucking thing multiple times she doesn't even get arrested or prosecuted. And nobody bats an eyelid except for here.

In wokespeak, even if this hypocrisy did exist on this sub, it would be justified and referred to as "punching up" and "dismantling gender norms".

I think it really depends on the context. There are guys who would even lose money but wouldn't want to be raped or ejaculate inside someone else's vagina. And there are others who don't mind it cus that's what they have been doing everyday with many girls and really wouldn't want their money taken away cus it's of paramount importance to them. No two crimes can be compared like that. Only murder can be debated to being a more terrible crime no matter what the situation is.

One is a violation of property rights. The items can be returned with minimal damage, and there can always be some “greater good” argued for (I was poor and needed the money, the guy I robbed didn’t need it, etc).

The other is a violation of bodily autonomy. Rape has no non-hedonistic justification, and it cannot be undone.

I'm exceedingly glad that Cosby was released. A man should not be charged for rape nearly 40 years after the fact. "Believe women" is all the evidence we had here. After seeing the vindictive behavior, lying, manipulation, and hamster wheel of justification that women are capable of; Nothing short of verifiable physical evidence should be the standard measure for this type of case.

Furthermore im looking at every one of you who cant get down with Cosby being released and im asking you directly; Do you have the same issue about Brock Allen Turner being released after serving three months of a total 6 month sentence in prison for a rape that he was literally caught in the act of?

Specifically what happened was he alleges that he was given a non prosecuting agreement by the DA. To be noted is that no evidence of this agreement was brought up during the hearing. Regardless, the decision of the court said that the conviction was unlawful. Charges may be brought against him again. He did do it. He admited it. That is not disputable. However it was decided the law was not properly applied. Currently his is not guilty, as he hasn’t been properly convicted in court. He did it though, he’s not a good person.

Specifically what happened was he alleges that he was given a non prosecuting agreement by the DA. To be noted is that no evidence of this agreement was brought up during the hearing.

An agreement was never offered between the two parties, nor was that the content of Cosby's appeal. The actual appeal was based around the fact that the DA's office announced publicly that they would not be bringing criminal charges against Cosby in the matter. They also stated publicly that this decision to not bring criminal charges was made to allow a civil case against him to proceed. Those announcements are undisputed, and part of the public record. And following them the civil trial against Cosby occurred, and his victim won, receiving damages.

The important thing to realize at this point in the story's history is that Cosby's testimony for the civil trial was predicated on the fact that there was no longer the possibility of a criminal case in the matter. That lowered the level of any possible proceedings and changed his fifth amendment protection, but it also changed the very nature of the testimony itself. There are factors which may create reasonable doubt as to the defendant's criminal guilt that – for various reasons – a smart lawyer will not raise in a civil case. So it is not impossible that a civil defendant's testimony is significantly impaired, and they no longer have the ability to give the full story should a criminal trial follow. For example: the defendant may have a strong alibi proving their innocence, or they may have documentation that proves they received consent from their alleged victim, or many other things, but for various reasons they may choose not to introduce those arguments in a civil case on the advice of their lawyer.

So returning specifically to the Cosby case, years after the civil case had been closed, the DA's office decided that they were no longer bound by the earlier decision not to bring criminal charges in the case – again, a decision that court records show was publicly stated – and they initiated criminal proceedings. The judge for the new criminal case allowed this to happen, plus allowed evidence to be brought against Cosby where the statute of limitations had expired, and allowed testimony that did not pertain to the case to be entered into evidence. Basically, it was a huge shit show.

I am still not very familiar with all of the events in the original case against Cosby, but I did walk through a detailed review of the appellate court decision, and the actions of the DA's and the judge were criminal to the point that it should result in significant jail time for them IMO. I know the phrase "released on a technicality" is thrown around in news articles about this judgment, but that's a very forced and incorrect narrative. This isn't a case of forgetting to dot an "i" or cross a "t". Instead, this is like chasing someone down in a car, driving over them back and forth three times, getting out and beating them with a baseball bat, and then saying "Oops, that was an honest mistake. My bad.". This level of unfair prosecution against a defendant is very obviously deliberate, politically motivated, and criminal.

And the judge and DA's office will probably get away scot-free with it too, because there is such a strong public dislike for Bill Cosby (not so with me, but not because I think he's innocent...moreso because I never followed the original case closely, and I consciously try not to form an opinion without getting as much of the full story as possible, which in this case we will never get because of the way it was handled). The thing that should make everyone feel the most worried right now is that there is nothing preventing the legal system from doing the same thing again, to any of us. This decision was not a new precedent set by the appeal court; the strong separation between civil and criminal proceedings has underpinned the justice system in the US and elsewhere for more than a century. However, everyone just decided to ignore that legal separation until the appeals court finally put a stop to the insanity (my pessimism tells me they only did so because they felt safe from social sanction, given their status and anonymity in their employment situation, and the fact that Cosby had already been imprisoned for several years, and not due to any adherence to the truth and fair rule of law ...otherwise, they would have made up some reason to refuse the request I suspect).

A broken legal system is a much bigger danger to every one of us than any one criminal can ever be.

If you read the actual judgment it states the following:

By removing the threat of a criminal prosecution, D.A. Castor reasoned, Cosby would no longer be able in a civil lawsuit to invoke his Fifth Amendment privilege against self-incrimination for fear that his statements could later be used against him by the Commonwealth. Mr. Castor would later testify that this was his intent:

The Fifth Amendment to the United States Constitution states that a person may not be compelled to give evidence against themselves. So you can’t subpoena somebody and make them testify that they did something illegal or evidence that would lead someone to conclude they did something illegal on the threat of if you don’t answer, you’ll be subject to sanctions because you’re under subpoena.

So the way you remove that from a witness is if you want to, and what I did in this case is I made the decision as the sovereign that Mr. Cosby would not be prosecuted no matter what. As a matter of law, that then made it so that he could not take the Fifth Amendment ever as a matter of law.

So I have heard banter in the courtroom and in the press the term “agreement,” but everybody has used the wrong word. I told [Cosby’s attorney at the time, Walter] Phillips that I had decided that, because of 11 defects in the case, that the case could not be won and that I was going to make a public statement that we were not going to charge Mr. Cosby.

I told him that I was making it as the sovereign Commonwealth of Pennsylvania and, in my legal opinion, that meant that Mr. Cosby would not be allowed to take the Fifth Amendment in the subsequent civil suit that Andrea Constand’s lawyers had told us they wanted to bring.

[Attorney] Phillips agreed with me that that is, in fact, the law of Pennsylvania and of the United States and agreed that if Cosby was subpoenaed, he would be required to testify. But those two things were not connected one to the other. Mr. Cosby was not getting prosecuted at all ever as far as I was concerned. And my belief was that, as the Commonwealth and the representative of the sovereign, that I had the power to make such a statement and that, by doing so, as a matter of law Mr. Cosby would be unable to assert the Fifth Amendment in a civil deposition.

[Attorney] Phillips, a lawyer of vastly more experience even than me and I had 20 years on the job by that point agreed with my legal assessment. And he said that he would communicate that to the lawyers who were representing Mr. Cosby in the pending civil suit.

Recalling his thought process at the time, the former district attorney further emphasized that it was “absolutely” his intent to remove “for all time” the possibility of prosecution, because “the ability to take the Fifth Amendment is also for all time removed.”

Your statement "they would not bring charges at this time" (emphasis mine) runs opposite to what the actual DA in the case said, as he stated under oath that the possibility of prosecution was removed for all time, and it had to be done this way in order to legally remove the Fifth Amendment protection from Cosby for all time.

Cantor also refutes the sophistry and semantics of your argument about the word "agreement", so I don't even have to respond directly to it myself.

Idk the full case. Never even heard of it. I don't even know the age of all the people involved...maybe it was more of a mentor or a celebrity/fan thing.. But I do know that in normal circumstances...when a woman goes with a man she met at a club to a room...they usually do it for the deed. I completely understand that they can go for many other reasons...and I don't intend to argue that she was willing to have sex and then lied later on cus idk the case itself. But when you're going alone with a man to a more isolated place...you definitely need to have caution about what and all they are doing and what they are giving you.. Forget about investigating very hard to prove guilt....just don't give them a chance to do it by being mentally strong by taking care of yourself. Lesser the number of avoidable cases, more the attention can be given to other grievous cases and I know the shortage of man power in the police force is not an issue in my country alone....

I don't know much about the case to put much of an opinion but all I know is that they convicted him about 10 years after his most recent allegation back in 2008 (I'm just going off of Wikipedia) and personally I don't think any rape evidence could last 10 years unless there where a bunch of pictures.

Tldr was given a plea bargain for raping one woman over a decade ago, said woman was used as proof alongside his admission of date raping women after drugging them until they passed out. They can't go back on it unless they want to open the road for slippery slope arguments.

The prosecution will likely drag him back to court, just omitting the basketball player he date raped and his admission of drugging her until she was asleep and then raping her.
