It definitely should be, but we can't do that for the sole reason that it would deter the rare cases in which the accuser comes clean. It would actually increase the number of falsely accused never getting their name cleared. The few that do come forward wouldn't if they knew they would go to prison for that long.

Letting hundreds of guilty go free is worth even just one innocent person not getting charged.

It seems he is suggesting that most sexual harrassment/assault/rape cases depend on circumstantial evidence and hearsay, not hard/concrete evidence. Without the woman admitting her lie (in cases that are false) more innocent people (mostly accused men) would be charged, convicted, and imprisoned for crimes they did not commit.

The American justice system says "innocent until proven guilty" but United States society treats the accused as guilty, especially when sexual crimes are alleged, and especially when the accused is male. Prosecutors have such a ridiculously high conviction rate because jurors have become increasingly willing to convict defendants with little to no substantive evidence.

I do believe false accusers who are children should be given the ability to recant their accusations at any time with zero penalties, however, adult false accusers should not be free from consequences, even under the law.

If a woman comes forward and says she lied about getting raped, then the man that was falsely accused gets to go free. This is great.

If we then harshly punish the woman, then future identical situations become worse for innocent men. The woman may be afraid to tell the truth in the future, because she doesn't want to go to jail, so the innocent man will never be set free.

It really sucks. These false accusers are the scum of the earth. They put away innocent men, and make real rape victims less likely to come forward in fear of not being believed.

I understand that. However, even if you throw false accusers in jail, it would ONLY be the ones that admit it, or have some damning evidence like a video, which is extremely rare.

It's just not likely to stop false accusations, when the only way to punish them is when they admit they lied. Proving beyond a reasonable doubt that they intentionally falsely accused someone nearly impossible. Even with video evidence, it would only prove they weren't raped in that specific incident, or they had time mixed up. Not enough to convict.

However, It is extremely likely that serious punishment would decrease the likelihood significantly of someone admitting they falsely accused.

You can't just change the rules of proof for one specific crime. Not his it works. Even if it did, you're arguing to make it super easy to get away with rape...when it's already super easy to get away with rape. The vast majority of rape cases are never closed.

Well different standards already exist, most universities go either with preponderance of evidence or less (since plenty don't even allow the accused to defend themselves to any effect) instead of beyond reasonable doubt (which it always should be since you're about to ruin someones life). There's also the fact that trial by jury has a much higher convication rate not because of evidence but because the jury aren't judges/lawyers and use their emotions more in the decision making for high-emotion trials like these. I'm thoroughly in the Blackstone's Ratio camp when it comes to crime, especially when it can be so he-said-she-said.

Different standards for charging someone with a crime don't exist. Colleges and companies can have whatever rules they want...that has nothing to do with someone getting charged. Many colleges go out of their way to bury rape accusations and actively attempt to tell the accuser to not go to the police. Many accusers that do go to the police are kicked out of university.

I was saying you can't change standards for actual convictions of rape to be different than other crimes. It will always be "beyond a reasonable doubt".

The problem is many get convicted when there is definitely reasonable doubt. That's a separate issue that I wasn't attempting to argue about.

How about we simply stop fucking locking men up on the word of a woman without solid evidence. That's the core problem. You can never make the punishment of the false accuser the issue. The problem is that they are believed in the first place without evidence and then they are not punished if they are lying. It isn't a crime that's punished, first of all.

I was just making a generic comment about things that happen to sex offenders in prison. If they go to gen pop in a level 4 prison, someone will find out, and it will be bad. My knowledge on this is based purely off YouTube videos made by ex cons, so it could be wrong.

Regardless. If you spend life in prison because of a flare accusation, I'm sure you would support my comment. Then again, that's just my assumption.

That's not at all what I said. If you can prove, beyond a reasonable doubt, that a person is guilty they should be punished. The real problem here is that people are convicted of rape when there was definitely reasonable doubt. That is completely separate legislation that I haven't being arguing about. We should never convict someone based on a sole witness testimony.

The reason that isn't the law, is because it makes it much easier to get away with crimes, such as rape. It's really easy to get away with rape if the only proof is the victim's testimony.

Lol, I can still continue to use your logic against you because you still haven't realised you're point is equal to mine, the real question is would harsher laws prevent more false accusations than the confessions they later prevent? If so, it's a net gain.

Also, it's better to remove the false accusation entirely rather than have it undone after the fact because my way there's no suffering and your way the guy still has to go to prison and be shunned by society. How do you measure that?

I want to discourage people commiting the crime in the first place rather than give perpetrators a safe space to confess their evil at a later date.

I feel like you didn't read or understand my comment (2 back). Having punishment for false accusations won't prevent false accusations because they are almost impossible to prove without a confession.

To charge someone with a false accusation, you would have to prove, without a reasonable doubt, that the rape did not occur. That isn't possible without a confession. I'm not sure what you don't understand.

If you can't prove it, you cant convict them, so you aren't deterring false accusations at all. You are only deterring the ones that confess they lied, because that is the only way to build the case.

Prepare yourself because I've had to write an essay because it seems otherwise you will refuse to see my point unless I spell this out for you.

I fully understand your point. What's happening is you are failing to see anything other than your own thoughts and while im trying to highlight to you the issues with that thought, you are refusing to acknowledge anything other than your own metrics. You are trying to box in the argument but that's not how it works, the things I am saying are relevant and stand in stark contrast to your own point.

Let me elaborate. You are only focusing on the cases where someone has chosen, for whatever reason, to confess they falsely accused someone. You are stating that in those cases the men are saved. You are completely ignoring their lives were temporarily ruined and in most cases will continue to be ruined via lost time. For example college students losing their place in school and not getting it back because it's too late. Another example, neighbours still continuing to believe they are rapists because "no smoke without fire" or they simply haven't heard they've been exonerated.

The preferred case would be that they never be accused in the first place. To this end, how do you discourage something from being perpetrated in the first place? You make the punishment for being caught worse. This is basic law making. It's provably effective in areas where the crime isn't motivated by need, such as a poor man stealing to feed his family. Accusing someone of rape isn't a need, therefore increasing the punishment will certainly reduce the numbers of fake accusations in the first place.

Currently, women making false rape accusations are like rich people parking illegally. They might get caught/fined or they might not. The problem is the punishment is so low that they do it regardless. If rich people were to be fined instead, say, by a percentage of their wealth, rather than a flat pitance, then many wouldn't do it where they used to before the change. The same can be said here.

If the punishment is high, then you rebalance the risk reward equation for a lot of women, making the accusation not worth the risk.

There is also the fact that your women, the ones who are confessing...why are they confessing? They either feel guilt for what they have done or they fear being caught. I can't think of another reason they would do it. Let's analyse these two possibilities.

If they felt guilt, then I think it's reasonable to assume that a harsher punishment would have disuaded them in the first place, because it is clear they are not beyond reasoning. In other words, there would never even be a need for them to confess in the first place because they won't commit the crime. This is immediately the better option because no life is temporarily or permanantly ruined.

The other case, they confess because they fear being caught. If they fear being caught, they again, will still probably not do it in the first place because the punishment is so high that the risk reward ratio was never encouraging to begin with. Alternatively, if they fear being caught then they would still confess for leniency, at least in some cases.

Here's the thing I still haven't said in this post. There's also now been a reduction in initial cases of rape accusations. There will be women who were never going to confess that now never even accuse. This is a major point. Some men who will never be saved will now be saved completely. Your confession point still encourages it all to happen in the first place.

So not only has increased punishment reduced the number of confessions required by flat removing the accusation, but it also saved men from accusations that were perpetrated by soulless bitches who's only concern is self preservation who now never did the confession in the first place.

The question is has these reductions outbalanced the cases of people confessing and the probable reduction in confessions? For the reasons I have given, I believe it would.

Lastly, prevention is better than mitigation. A confession is not better than the crime never being commited.

You're suggestion is actually a very old one that's been the dogma for a very long time in courts. "We don't want to scare off legitimate victims from reporting crimes" or what you're saying, "there's probably a few good sumaritans out there". Preventative medicine is the best medicine as is with law when it comes to deterring crime.

Your argument is one of a few that is a wolf in sheep's clothing. Prioritizing the lives of woman over men with a non-sense argument.

All you have to do is remove the "they" and just say "a certain group" and I would agree. The more powerful a certain group is over another, whether they be religious, political, or anything else, the more the people who aren't in that group suffer. This power to destabilize society isn't specific to members of the "female group", it is a power that any group can have.

In the UK, you definitely can't use previous convictions to secure a new one. The jury is not allowed to know or research the accused's previous history. This is why the classic statue of Justice is blindfolded.

However, it absolutely can be used in sentencing. Assuming the defendant is guilty, the judge gets to take previous offences into account, and will adjust their tarriff accordingly. Having sat as jury leader in an Old Bailey case, I believe that this is just.

That’s wrong because of how the burden of proof works in criminal law. To convict someone of rape you have to prove it beyond a reasonable doubt. That’s a very high burden. We make the burden so high because the penalty for a conviction is huge, a loss of liberty. So what that means is that lots of people are not found guilty even though they did the crime. The state was just not able to meet the burden of proof.

So if there is a rape accusation and the accused is not convicted, that doesn’t mean the accusation was false. To prove a false accusation you would then have to prove beyond a reasonable doubt that the rape did not happen. That’s a pretty high burden.

So in a situation where two people had sex and the man claimed he had consent and the woman claimed he did not, absent other evidence, it would be difficult to prove, beyond a reasonable doubt, that the rape did happen or that the rape did not happen. So neither person gets convicted.

There’s a similar issue in both sides of this argument: both crimes (rape and false accusations) are sometimes hard to prove with solid evidence; with rape, the problem is there is a time frame in which you have to gather said evidence, and the process can be uncomfortable or traumatic for a victim; the problem with false accusations is that it is very difficult to prove a negative, it is not often easy to get evidence of someone NOT doing something, so it is a very damning accusation that leaves little room for defense.

I agree that false accusations should be investigated and punished appropiately, its just that I’m not sure how to compensate for the issues mentioned above.

The problem lies with society’s attitude towards rape accusations, the law is quick to blame the perpetrators even when they weren’t, just to satisfy the thirst for revenge of the angry mobs.

In reality both rape accusations and false accusations should be investigated properly before putting the blame, instead of publicly shaming the accused while their innocence hasn’t been disproven yet.

The defendant may have had evidence in this particular case. But with other cases people will be much more reluctant to come clean from their false accusations if they knew a 10 year prison sentence was the cost.

I read that in Islam, a person who falsely accuses someone else of a sex crime receives 80% of the punishment the other would have received and their testimony is to be rejected forever and they have zero credibility in all future transactions. Imagine having your credit destroyed, business reputation destroyed, insurance claims disbelieved, needing to be audited and produce proof for every single transaction you make because you are labeled as a fraudster and dangerous liar because you tried to destroy someone's honor and reputation. I'm not saying the man needs to prove his innocence to escape punishment, since that would be ridiculous. But, making a possible rape victim who failed to prove that they were raped/assaulted apologize, is just as ridiculous.

Even if she confessed, I think it's weird to make her apologize. It just feels off. Of course the statement that the man hasn't been shown to be guilty should be as public as possible, but to then go on and make it public that the accuser must have been lying is weird, since that's not what's been proven.

Still, from all of this I will assume that she did lie and should apologize of course, even though it may not help much.
