Now, assuming the allegations as per the post are true, the man is a criminal. The crimes are theft and perhaps fraud. Crimes he deserves to be punished for. But rape is not one of those crimes.

The sex worker only consents to sexual activity on the explicit condition of financial payment, withholding that payment negates that consent.

Conditional consent is the exact same story for Stealthing, where one partner removes the condom without the other knowing. That is rape, because the conditions of consenting to sex were undermined. They are breaking a predefined condition which directly invalidates consent, allowing the act to be prosecuted as rape.

If you think this shouldn't be a crime, then you'd just as well be defending stealthing, which is disgusting. This sub has a real issue with invalidating and attacking sexual assault victims, it's so boring.

Consent was agreed beforehand on the basis that the client was paying for sex. Rape is where someone proceeds to have sex, either overcoming someone's refusal of consent through force, fear, or fraud.

There are plenty on this sub who would consider e.g. baby-trapping, such as a woman lying about birth control, or poking holes in condoms, to be rape because it is a fraudulent way of generating consent.

IMO, this is no different. If the sex worker wouldn't otherwise have had sex with the client, and the client intended to have sex with her via fraud, then that is rape.

I guess there could be some grey areas here, you'd hope no-one is phoning for the police because the client's credit card was declined, I doubt sex workers are going to want that hassle vs being paid.

End of the day, these people are selling intimate services, part of themselves that many of us would feel is very private and personal. I don't think it's unreasonable, morally or legally, to frame it pretty differently from shoplifting or a dine-and-dash.

Nah this is actually reasonable. A prostitute consents to sex in exchange for money. No money, no consent. She upheld her part of the bargain, and he didn't so she didn't consent to this, thus it's rape. I don't see anything wrong with that, just uphold your end of that agreement.

This is not the same as eating a chocolate bar without buying it, you are talking about someones personal safety and a verbal contract between the two parties to exchange money for sex.

So, if there is a disagreement over services or quality there is a charge of rape?
What if he only paid half. Half rape?
This is a commercial transaction where there is plenty of legislation and processes for non-payment for services.
Alternatively, we need to recognise that a persons category can change (from seller of services to victim) based on behaviour after the fact.
Drawing analogies to stealthing is disingenuous , that is an act that is never consented to, and that status doesn’t change after the fact.

Feel like people here are missing the point of the entire thing.

She did try to make it a financial thing, and only when it was impossible to do so, is that she was advised to make it a sexual assault accusation.

The guy was scaming women and they were being left with no defense until it turned into a sex crime. If authorities had done their job and made him pay them, this wouldn't have happened.

Show me any other case where 11 counts of sexual assault lead to 6 years, possibly 4 with parole. This was, very clearly, not judged as 11 counts of sexual assault, or the guy would be facing a lot more time in jail. This was a way to make the crime easier to investigate.

Thats dumb. A sex that a prostitute sells is a service like any other. Not only that but the sex part was consensual, its just the payment they had a disagreement.
