Inexplicable how the boy (who is 5 years younger) is arrested and deemed a perpetrator while the girl was recognised as a victim. A gender-neutral POSCO Act is meaningless if it isn't enforced as such.

While it's not out of the question that a 12 year old boy ACTUALLY raped a 17 year old girl, it seems to be quite a long shot.

Here is a link to a news story... sounds fishy to me. Looks like statutory at best, if not a false allegation outright.

“We received a call from the hospital on April 18 saying a 17-year-old girl had given birth to a child,” the office said. The victim, however, refused to give a complaint to the police against the minor boy. The police said after taking the girl to counselling and only after much convincing did she register a complaint.

During the enquiry, the girl revealed she was in an intimate relationship with the boy and that he was responsible for the pregnancy. After this, the boy was booked under the POCSO Act and produced before a local court.

“We have a doubt whether this boy was the reason for the girl’s pregnancy. She told us he is 15-year-old. But when we asked his parents, they said he was 12. To cross-check, we sought his records from school, but they did not have any,” the police said.

Apparently the age of consent in India is 18... I could not find anything regarding what happens when both parties are under age.

If this article is to be believed, this looks like a travesty indeed.

In yet another article I read that was linked elsewhere in this thread, both kids were apparently school dropouts - so, perhaps this is in a very poor region of India.

This is an odd one and I'm not sure what to make of it.

I'm dubeous that a 11 year old would be able to rape and impregnate a 17 year old....but we don't know the details....she may have been drunk/asleep or something.

My instincts leap to her saying rape , to cover that she committed statutory rape against a minor. But without any information all we are doing is speculation.

I'm going to reiterate what I said in a comment as a reply to one of the posters here. As an Indian and being around a lot of 11 years old boy when I was the age I can say the balance of probability is not that a 11 years old boy is physically imposing enough to force a late teens girl to do something completely out of her will. The greater probability what exactly happened though is, the girl in the late stages of her puberty wanted to try something sexual and invited the boy, and the boy not having enough mental maturity just went with the experience as it was something new. They were both young and stupid enough not to use birth control, and now the girl is facing the repercussions. In India in cases like this the sympathy is almost always with the girl (as much sympathy as our society can extend to a rape 'victim' anyway, we still have a lot to do in that domain, but undeniably more than the guy who is suspected of actually committing the rape), so you can see her receiving almost a 'counselling session' with an 'all woman' police force. Indian women when backed into a corner often reframe any sexual act that has come out in the open as rape, and on her words that boy was arrested and sent to a juvenile home without probably any care about his account of the events and the action was seen as justified as he 'impregnated' a woman. What is happening here is that this is such an absolute, GROSS miscarriage of justice that isn't even registering to most people here who do not know how sexually conservative the Indian society is and how much an act of sex is demonized in the general consensus that such a travesty can actually be carried out. The sex was an act of coercion by the girl (I refuse to entertain the notion an 11 years old boy is mature enough to sufficiently consent to a sexual act), but the hyper accountability paradigm resulted in the boy actually being arrested, even though he was the victim in this case. (After all he's the BOY so he must have initiated and the regular drill)

Yep, a feminist police force will arrest a 7 year old boy for innocently kissing a girl on the cheek, and call it sexual battery and make sure he gets the adult penalty for it. Guaranteed it was the girl who started all of this, and they had a long term relationship so I doubt it was rape. More like coersion from the girl this whole time. I hope the boy wins his case and the girl goes to the Ho Factory.
