No it didn’t? Unless you only watched the first episode. If you watched the 2nd, you’ll learn that the story is a lot more complicated than the media made it out to be. Conrad was just as shitty and manipulative and both their families were fucked up and semi abusive. If anything, watching this documentary allowed me to have empathy for Michelle Carter and disdain for how the media twisted the story to a neat package about a villainous woman. A story like that sells, whereas a story about a complicated relationship fraught with mental illness and semi-abusive families does not.

Dude the celebrity hoe married to what's his beard got 14 days (prison time, not jail, WTF?) for buying her daughter a spot in college. There was debate if she would actually get transferred to the prison from court holding pens, because with good behavior she would be out in 7? 8 days. Edit: my job doesn't even give time off for good behavior until you hit 90 days.

What? You think 2 years is nothing? I can absolutely promise you that to someone facing jail time, even a month can be an eternity and life changing.

I’m not saying that the sentence in this case was or was not warranted, but from having dealt even tangentially with criminal justice, basically any jail time is a huge deal for most.

We get caught up in seeing news stories about someone getting huge sentences, but most cases aren’t like that in my limited experience.

Not that I agree with the defense, but that’s a good defense. As a society, we want defense lawyers like this. They’re good not just for accused individuals, but for assuring guilt as well. For example, if she can be found guilty under the best of defenses, it’s much easier to believe that she’s actually guilty. Inversely, if her defense lawyer were out to lunch during the trial, you’d definitely get mistrial claims and the whole thing would be back tying up the courts and dredging pain for the victim’s family.

A friend of mine is a public defender. And I asked him how he handles a defense where he’s convinced the defendant is guilty.

He said you try to make sure they get a fair trial, that they get the best defense he can give. The facts will determine the outcome, but they should be presented as well as possible.

That sounds noble but the issue for me becomes when cops or prosecutors do dumb stuff (for example) that still doesn't absolve the defendant of his obvious guilt for a heinous crime, and then a good defense lawyer will get a dangerous criminal acquitted in the name of giving him "the best defense he can get". I guess that becomes a personal value judgment and maybe they're convinced it's for the greater good in protecting rule of law, but it would personally be hard to stomach that in the face of letting a serial child rapist or something back into the community just because there was a solid evidentiary technicality.

Because that’s the only way it works. Individuals have rights and they’re innocent until proven guilty. They retain those rights even when they’re being investigated for and charged with a crime. The burden is on the state to protect those rights first and prosecute the crime within the law.

Some people thought that individual rights were literally the most important thing to protect, and they convinced enough other people to support them. God bless ‘em for it too, because it’s an idea that’s lit the world for more than two centuries.

I guess the question here is whether he believes the person is guilty or the person told him they were guilty. I he just thinks the defendant is guilty, then obviously he needs to still defend him. I the defendant admits guilt to his lawyer, then there are practices in place to handle that.

I used to hate lawyers who did this, until I met someone who ran a law school. When he was a public defender he had actually defended a (then unknown) serial killer who went on to kill again - but the police never got a warrant and the evidence they gathered against the killer was ruled inadmissible. As horrific as it sounds in that case - it's a lawyer's responsibility to mount the strongest possible legal defense for their client. If they don't - either by intent or laziness, it actually causes more problems down the line, it also forces prosecutors to have a solid case before they charge you with something. Unfortunately most people get pressured into taking plea deals from what I understand - very few cases ever go to trial.

Most law in relation to this distinguishes between speech and a speech act. Insulting someone to their face, for instance, is a speech act. As they put it in the old western movies, "fighting words" are not simply the same as saying a thing that someone might disagree with.

Other examples are verbally assenting to a contract, lying to a police officer or in court, yelling "Jump!", and of course the old yelling "Fire!" In an old-time theatre made of wood and upholstery.

These are not generally held to be simply "free speech".

Urging someone to commit suicide false into this category.

She didn't simply tell him to kill himself. She goaded him into doing it. She badgered him to get back in the car even though he said he didn't want to die. And she ACTIVELY PREVENTED LIFE SAVING EFFORTS by not alerting them to his attempted suicide.

She wasn't convicted of expressing free speech. She didn't say "kill urself lmao." She was convicted of involuntary manslaughter.

But that isn't what this case is about. She supervised someone taking his own life, encouraged him through the process, and did so out of her personal amusement.

2: On a more serious note replying to your comment where you say it was unintentional on her part (according to her), from my understanding there ARE some laws that are NOT protected by free speech. many of them are mostly overlooked as jokes and the sort.

For example... If I was to say "I hope you get hit by a bus The_Froward_Coward" That is protected by free speech. However if I was to change the language and get specific with it..."Please someone; The_Froward_Coward is at xyz, go there and hit them with a bus." That is seen as a call to action, and is no longer protected. In fact in Virginia vs Black it was ruled that even if you say it with no intention on doing anything, there is still some precedent as its not just your intentions but also protecting the victims FEAR of violence.

What she did would fall under this category, and was no longer protected. I understand your example and there is some gray area (although like I said earlier this gray area could lean either way depending on how the person takes your statement. And if they killed themselves...clearly they took it to heart and that changes the context). However in this specific case if there is any doubt if you were to read the full story at one point he steps out of his truck to breath fresh air at which point she "fucking told him to get back in...". She claims she did it for his own well being but...her words directly encouraged and caused someones death. She confirmed with him numerous times that he was going to, and should do it. Its obvious by him stepping (even if it was just for a moment or not, we arent sure) he had second thoughts, rather than encourage him seeking help she coerced him back inside. She truly may have been the direct cause of his death that day. There is no longer any gray area in this specific case. She made the defense case for "Free Speech" at which point the court replied

“The only verbal conduct punished as involuntary manslaughter has been the wanton or reckless pressuring of a vulnerable person to commit suicide, overpowering that person’s will to live and resulting in that person’s death. We are therefore not punishing words alone, as the defendant claims, but reckless or wanton words causing death. The speech at issue is thus integral to a course of criminal conduct and thus does not raise any constitutional problem.”

Thank you for that. By the by, I didn't want to seem like I thought she was innocent of manslaughter. I had just looked up the definition of involuntary manslaughter:

the crime of killing another human being unlawfully but unintentionally.

and thought, "wait, unintentionally implys she didn't intend to, but it definitely seems she intended to."

What Carter did was calculative, and intelligent. (Not in positive tense.) She is possibly a narcissist (not my own diagnosis) - which potentially means she has no empathy, this adds an extra dimension to the crime, as this means her emotions would be shallow, and for show only.

She proactively manipulated an already-depressed young man in to taking his life, for the sole purpose of attaining sympathy and attention. Completely different to shoes being stepped on.

Like I said, there has to be evidence that the person knew they were going to die. In this case, we have text logs showing that she without a doubt knew that he had a generator on in the car, attempting to kill him self. Knowing someone has depression or has been suicidal in the past is not enough, because there is a lack of clear evidence that they knew their actions/words would cause the person to commit suicide.

That's not what happened. She knew where he was. She knew he was at attempting to kill himself and having second thoughts. She encouraged him by directing him to continue with his efforts. She was goading him to die. She could have left him alone and he would have backed out, but she continued to tell him to stay in the truck.

She wanted him to die. If she hadn't texted him at all, he would have backed out and lived. If she'd have texted his family, he would have lived. She intervened and only texted him- a man who was in serious trouble and pushed him over the edge so that he would die by his own hand.

That is nowhere near just telling someone to kill himself.

It's awful. I lost a friend to suicide. When he told me of specific plans I did everything in my power to stop him. I talked to judges. I talked to social workers and psychiatrists. I have my friend confined to a mental hospital against his will because I believed there was a better way to solve his problems than death.

He convinced the judges to let him out. The next time he tried, he didn't tell me first.

For the record, it is legal to shout fire in a crowded theater, if there is a fire. In which case the result would be the same. People trampled in the crowd's haste to escape. A person charged in such a case wouldn't be charged because of the words they spoke, they'd be charged with inciting a riot. You can't create a public disturbance dangerous to others by telling some guy who constantly threatens to kill himself, to go ahead and do it. The individual has agency. He gets to make his own decisions. Did she force him? Did she threaten him? Did she coerce him? No? Then she should not be held responsible for what he did to himself.

If there's evidence of her telling him to go kill himself and other such douchebaggery, then this case could be precedent.

A note in this case, the last comment in the article:

"Additionally, it is never in society's best interest to incarcerate anyone for the content of their speech where there is not a specific statute previously enacted," he added.

Advocating suicide could be ostensibly considered incitement to violence, and not covered under most concepts of free speech. A competent lawyer will should smash such an appeal.

Thank you. What a long read. Having been in Conrad's position. I have to say I don't really feel as strongly about her being a monster as some do. You'd be surprised how people react in these situations. It's only after years that I met someone who knew what the right thing to do was, and got me on my way to dealing better.

This has been posted before on this sub and I got downvoted for basically presenting the facts of the case, but ill give it a shot. The documentary is setup perfectly to present both sides of the story: the first part presents the story how most of us heard it on the news - guy is persuaded to kill himself because of crazy girlfriend. The second part of the story goes into what really transpired, not just that night but their entire relationship and both kids lives. The guy who killed himself was clearly mentally ill, and stated dozens, if not hundreds of times that he wanted / was going to kill himself. She, being mentally ill herself, told him NOT TO kill himself most of the time, but relented towards the end and supported his decision.

the biggest part of this story though is what everybody gets wrong on the actual suicide. We are told that he, while sitting in his car and a generator on in the backseat, had second thoughts and decided to step out of the car. But she told him to get back in so he did. The fact of the matter is that there is no proof she ever told him to get back in, since they supposedly were on the phone while this was happening. The only reason she is in prison is because she texted a friend after the fact months afterwards that it was her fault he was dead because she told him to get back in, something the documentary suggests that could have been a way for her to get more attention / sympathy from friends.

In this case, the only reason she is in prison is because she stated months after the suicide that she told him to get back in, which would, legally speaking, be considered a threat (threats aren't classified as free speech) and make her liable for his suicide. However, there is no physical evidence that she actually made this "threat".

What she did was a form of psychological abuse. It's not a free speech deal. 1A protects citizens from censorship by the government.

In a landmark case, it was decided that 1A rights end when the citizen makes a credible threat, or incites violence. There are two stipulations. The instance must be A) intent to do malice, B) likely to become a reality. Which is why a person can jokingly say "I'm going to kill you". But cannot say, "I'm going to kill you" while holding a knife to a person's face.

If the reason this girl is punished is still not clear, think of this. A johnstown esk figure convinces 50 people to commit suicide for religious cult like reasons.

At the root... If a human has the fundamental right to kill themselves (which they should), her talking him about it, or in to or out of it, that is absolutely a matter of free speech.

Those saying he was in a mental state that made him more vulnerable than another, imply that she should have an understanding of his mental commitment, his mental stability and his seriousness to go through with it. How can someone know that when he had used that threat in the past?

There is no question that people use the "I'm going to kill myself" excuse to gain things, and that puts the person they are saying it to in a position that she was not equipped nor required to deal with. You're going to kill yourself if I don't do X? Go for it. It's your right.

In this case there's a period of months where the kid is suicidal and she suggests he go see a therapist. If your son is in a similar boat use this as an opportunity to learn from the mistakes of his parents who apparently ignored signs for months or probably years leading up to the suicide.
