The approval drew an outcry from members of the “First Wives Advocacy Group,” a coalition of mostly older women who receive permanent alimony and who assert that their lives will be upended without the payments.

It’s interesting too because lifetime alimony doesn’t line up with women fighting for equality (women’s lib). They act like they can just go to the ‘other side’ but I don’t think they’re going to get much sympathy there either. There’s going to be some parties coming to an end in the villages soon once those checks stop coming in.

The only caveat is, and I say this reluctantly because I don't know exactly how common it is, is apparently permanent alimony is often awarded as an alternative to the separation of assets. If she's entitled to half your pension, maybe alimony in perpetuity is a better alternative than the lump sum distribution from your deferred income and retirement savings.

I would expect this law to only apply to future awards, but apparently it is also retroactive.

Any ex husband remitting lifetime alimony will at least get one victory upon his death - payments to his ex wife would stop.

Crazy, a lot of these men probably cannot retire because of their lifetime alimony.

Whenever there is divorce-related news, it's always interesting to go see the women's perspective. Over on the 2X subreddit last night, the girls were chatting about this law.

Many of the comments focused on some Florida woman Republican voter who said the law will hurt her. And, of course, there's a pile-on of comments about how she voted for DeSantis and now she gets what she deserves. Wow, way to support a sister.

It's a little disappointing to see this law politicized so quickly. It's not as if Family Law is a fair and functional enterprise when Democrats are in charge. And personally, I couldn't give a shit if my judge or the opposing lawyer was a Republican or not. If someone pops you a new asshole in your forehead and takes all your money, do you really care if they voted for DeSantis, or Trump, or Hillary? BTW, Bill Clinton tweaked the child support laws pretty hard; no doubt hurting some of his supporters, but no one ridiculed them.

Anyway, can I please vent for a moment? This news has brought up the subject of alimony in general. And I see the same, tried, stupid arguments rolled-out, again and again.

"She sacrificed her career." Give me a break. It's not like your typical SAHM has an Ivy League law degree and was offered a senior position with Bank of America when she quit to be a SAHM. When the average SAHM became a SAHM, she was probably unemployed, working hourly-waged retail, or Starbucks, or whatever. If she had a degree, it was probably something worthless like art history. Sure, there are a few exceptions, but generally, WHAT CAREER did she sacrifice?

"She stayed home to raise your kids so you could work." Okay, how many young women, freshly-married, say to their husbands: "I want you to stay home and raise the kids. I'll go out and work 60 hours a week to pay the bills and come home too exhausted to enjoy any quality time with the kids." C'mon, you know the answer. The point: She got the job she wanted. She preferred to be a SAHM. Why does someone get financial compensation for getting the job they wanted?

"She needs alimony because she has no skills after 30 years as a SAHM." Sorry, it doesn't take 30 years to raise kids. It just doesn't. Certainly by high school, most kids are independent, leaving mom available to do other things. I was raised by a single mom. When my sister and I were in high school, my mom worked full-time and attended college at night, eventually earning a bachelor's degree and getting a promotion. She did that as a single mom. So don't tell me a married woman can't do it.

"She deserves alimony when he runs off with his secretary." Holy Shit, is this the 1950s? Why does that cliché persist? Why is it always the man who cheats in these hypotheticals? In fact, why not consider the possibility his wife has become a sexless, insufferable bitch. That seems much more likely to me.

"Women won't want to get married anymore." Fine. Let's burn the whole thing down. Fewer marriages mean fewer men getting screwed in court. Society is coming apart like a cheap suit anyway. As long as it is, might as well protect yourself.

While we get there different ways you make good points. Marriage shouldn’t be about a woman ‘hitting the lottery’ because of who she marries. I work in an industry with a lot of ‘pretty women’ and I see the number of them that start their ‘I do’s’ with we are going to work and it’s going to be awesome. And the. All of a sudden two years into the marriage it’s ‘well I want to stay home’. What’s the guy to do? Divorce them right then? When you’re together you’re together. When you go your separate ways there should be a clear cut off ramp to truly go your separate ways.

Agree with you it doesn't take 30 years to raise kids. We agreed to have my wife be SAHM (after two years of me being college student with primary care role for our two kids). She was able to go back to part time once the youngest was in Elementary school and full time once he hit Junior High. Took about 14 years for 4 kids averaging 1.5 years apart where she was full time SAHM.

My ex actually did. It was hilarious. By the time she figured out she got the short end of the stick, she would have made a fool of herself for asking to go back to the way it was.

The article is a good read. They keep saying the changes are NOT retroactive. Yet women keep saying they are affairs they will get taken to court and their agreement modified. They also say this is the end of everything for them.

Every situation is different. But sounds like many haven't worked a day in their life or tried to seek meaningful income 🤔

They also say that this is a huge blow to marriage??? How does divorce reform hurt marriage 🙃

I agree, complete eliminate of alimony might be a step too far. It should be dependent on the ancillary assets divided up in the divorce and it should be very temporary, (6-12mo) depending on circumstance.

That said, with how slow the divorce process can be, would a temporary assignment of alimony of 12mo when the divorce took years, actually be meaningful?

I think the most significant change is removing the requirement to “maintain the quality of life established through the marriage”. I believe the new language is “reasonable needs”. I think this is bigger than the whole discussion on lifetime alimony / duration.

Think about maintaining quality of life- vacations, club & gym memberships, luxury cars, boats, expensive restaurants, etc. Those are all “in play” when considering quality of life. Absolutely none of those are reasonable needs.

I think it’s absolutely an enormous pivot because it changes the whole perspective on alimony. What the breadwinner earns and what was provided for in the marriage is no longer a factor. That is huge to me.

I love this. I wasn't aware of that language - it's critical. Now if that way of thinking could just be applied to CS. IE the child is entitled to an average life with reasonable needs rather than the status quo of having the household privided by the marriage/relationship be upheld.

I can dream on I suppose.

Mixed feelings about this. Honestly it removes a possible tool in negotiations; house for lifetime alimony for instance. These are all legal agreements at the end of the day, that both sides had a hand in. Very possible the women in some cases were giving up substantial assets like a share in a business.

That’s why they claim it isn’t retroactive (some exceptions it would seem). They’re trying to protect agreements already made that can’t be renegotiated.

I mean still - if I have a business and don't want her having a share, but don't have cash on hand for a big payout... it gives options.

There are lots of bad scenarios for lifetime alimony, but there are advantages as well.

I gotcha. I’m betting that you can still settle away lifetime payments if you choose to. I’m thinking this is more what a state judge can decide. I’m sure even if you chose to go this route the judge would make sure you understood that and would be like ‘there’s no going back…’.

Wife becomes an insufferable bitch

Regardless of why, this is what I observe is the number one reason marriages end. The wife might have legitimate reasons such as alcoholism, a sexless marriage (husband), etc.

Or, more likely, it is disappointment and boredom because life isn't a guarantee. Much of life is disappointing and unpredicatable.

It's the "I could have done better" thinking that may be natural but somehow has become humorous instead of contemptuous.

Then there is the "high value man" who gets cut down to size every time he enters the home.

I've seen wives drive husbands to find a pleasant woman as the wife decides he gets too much respect at work. After a while, he'd rather be at work.

Questions older wives: were all that criticism and contempt the alimony payment you chose? Was that vengeance the payment you chose? Was it your fault for letting immature emotions rule your life? Was withholding sex and affection the equitable payment you thought was justified?
