Some good recommendations below with regarding to transferring to trusts, but you will still likely need a marital property agreement that each of you review independently with attorneys to get the "community property" designation removed given you are in CA, and it's not very likely your spouse will go for that. Pre-Nup or Post-Nup - always my man. Best $30k I've ever spent hands down.

The following strategy is grey zone ethically, especially if your ex didn't betray you. I personally pursued it only to a quite limited extent, but I'm not as rich as you.

You don't have much leverage, but you don't have none either. An important piece of leverage you have is that the money is under your control, and she doesn't get to start spending it until you settle. If there's one thing lawyers are usually successful at, it's making shit go slowly. Put coins in the slot, and a decent lawyer will produce delay. Obviously, you'll need one whose personal standards accommodate such behavior.

Make life during the negotiations less comfortable than she's used to. Hem her in financially so she can't take major steps to establish her new life, such as buying real estate. Make the clock work for you and against her; you get to move on and live your rich prosperous life, she doesn't. Then let the clock wear her down until she voluntarily settles for less than half.

A key factor here is that a financial cutoff date is established and that it is early. How that is done varies by state, consult your counsel. You don't want her having a right to all the new money you're making during negotiations if you're going to deliberately drag them out. Again, you need the clock to be hurting her and helping you.

It's easier to produce delay before a court is involved, as a judge does have the power to impose a timetable. Make that seem scary, which isn't difficult.

This probably would have worked on my ex, to get her to maybe 40%, but the lawyer bills needed to keep things bogged down for years would have wiped out anything I gained. For you, maybe not.

If she has an affair partner or falls crazy in love soon after you separate, that's a big plus for you. Lots and lots of incentive to get that money to establish a wonderful new life together.

If she is low enough to try to alienate your from your children in order to get you to settle, this strategy won't work. That weapon, I'm sorry to say, is devastating and unanswerable. If you go low, she will feel justified in doing the same.

You left out details. How long married, if she works and both your ages. You will pay legal for both sides and it could cost 500k each and the pain will be in you for disclosing assets, product if documents and generally getting your teeth kicked in depositions. You will then part with half and this is the worst part — pay her tax free alimony for at minimum 1/2 the length of the marriage. I highly recommend you keep your marriage together and move to Texas. Become residents (3 months time usually) then divorce her. You will have a much better time there.

Similar situation here, prepare to spend $500k+ in legal fees, and she will turnover every rock to find “income available for support”. If you built the business while you were together, she’s going to get her half.

You will either have to sell the business or work out an asset split where you retain the stock but she gets a note payable, or other compensating assets.

It’s awful, but I’ve made peace with it. It’s the price of freedom.

Pro se online legal separation; get two signatures from her on legal separation form. Check option to not disclose assets and giving each spouse financial assets they currently control
Open an onshore or offshore trust; gift assets to trust
Gifts to charity or relatives: Remove assets from marital property, make gift above $64K and report on tax return next year
As you are in California, get her signature on a transmutation agreement
Someone suggested moving to another state, that's a bit extreme, all you need is move your assets to a local financial institution in another state

Plenty more, lost my other thread which had several more options including home sale and renting from parents.

What's fair according to you? 100-0 for yourself and alimony? 70-30? The closer you are to 50-50 the more help you will get from lawyers and internet forums

Not sure if this is even possible but.. what would happen if you moved to a different state? Suddenly there is a new business venture in a state where it’s easier to divorce her and after a year or however long residency needs to be established to file for divorce. Idk I’m thinking long game for a divorce where you get her to move and then divorce her so you can keep the money you did all the work to earn.

IF you've got a $25m+ business you can and should get an attorney. Doubly so because you're in CA. Marriage over 10 years and you're on the hook for life time alimony.

The short answer is no... assuming you started the marriage at 0 or its a short term marriage, she'd due half. California is particularly rigid. If you have been married 10 years, you're probably on the hook for lifetime alimony.

You said entrepreneur, so I'm guessing that wealth is in part a business or businesses you've built which you really can't hide. You can just try to get a fair valuation and you may have some input in that.

I have a business... I never did the things necessary for it to exist without me. No real reason for that aside of I'd have nothing to do if I did. A key valuation component is "can the business exist without the founder", if no, then less valuation. But that's not something you can engineer after the fact. I never took those steps and waited until final financial settlement, now I'm working on that.

Bear in mind, it's usually fair value of the business, not fair market value. I.e. it'll get a valuation even if it's not really a "sellable" business.

I mean, there are specialists who help to optimize it. But generally, you are going to lose about half of what you have anywhere in the world; pretty much any court would disagree with your statement that she has nothing to do with it. She's been supporting you, whatever that means. Full time job.
