As a victim/survivor (you have no idea how much I hate those terms) of 12 years of sexual abuse as a child I just don't get women who make this shit up. Seriously I went through some dark places as I tried to get past what I went through. The constant worry about becoming a victim again, of second-guessing all my decisions, thoughts of suicide, the difficulty trusting anyone who wanted to touch me. I'll be 32 in a few months and I still cry when I really think about it.

As a survivor I really want to hurt these women. Why, how, can they lie about this? Not only do they make a sick parody of everything people like me go through, but to turn an innocent persons life upside down? I don't think prison is good enough for them.

If you read my latest blog post, WAR (Women Against Rape), may themselves have put women off reporting rape, because of their use of the misleading 6 per cent 'conviction' rate statistic.

This group have also had the ear of the British government and were against anonymity for the rape accused.

1 - Both the accuser and the accused should remain anonymous until a final verdict is reached, and then only the guilty party will be identified.

2 - False rape accusers should be prosecuted, and subject to the same penalties as the crimes they lied about.

As a guy who has spent a lot of time in court rooms let me say this: The whole truth never comes to light in any criminal trial. The Prosecutor and Defense attorney actually debate what evidence will be used beforehand. One thing that is never allowed to be mentioned is the criminal history of the accused (For fear that past crimes committed would bias the jury about the current incident).

One memorable case involved a career criminal who stabbed another man in the presence of the victim’s girlfriend. The girlfriend called 911 and followed the man. Police arrived and found a knife on him. The guy siad he stabbed him and made up a story about a huge gang fight. Written statements from the victim and girlfriend were taken. The man was taken to trial months later. Everyone testified. The Defense Attorney told me she knew the man was guilty but she had to try since her client had so many offender points that if he was convicted again he would be looking at about 10 years (He had been arrested 60+ times in that city alone and convicted of multiple felonies, of course that information is not allowed in court).

The Prosecutor was unprepared and one juror could not believe that this man was capable of a crime. First vote: 11 guilty 1 innocent. After hours of the ‘1’ badgering everyone and the group’s lack of interest in the case, they decided to just vote innocent so they could all go home.

My point is that this glowing example of the US legal system could have easily involved a rape case. If you start prosecuting false rape accusations then you are forcing victimized women to rely on the system I described above. It is too easy to be found innocent of rape. With a false innocent verdict the groundwork has just been set for a criminal case against our hypothetically legitimate victim for false statements. If our victim is really unlucky she might even see her attacker again in civil court facing lawsuits for Defamation of Character and even “damages suffered” while the rapist was waiting for the trial in jail.

TLDR; Dominos Pizza has really stepped up their game.

When I was in college in the 1980's, I used to talk to a lot of women. During my time there, five different women told me that they had been raped. All the incidents were described as date rapes. I asked a few questions and got them to tell the stories. Each of them was crying and very upset. After I heard the details of the first story, I started trying to get as much information as possible when other women told me about their rapes. I was as careful as I could be about not seeming to be doubting or questioning them. It became clear that, although they were describing the incidents as rape, they were on dates, went to a bedroom, fooled around, took off their clothes, had sex and then, apparently regretting it, thought of it as rape. I do not doubt that they were not sure they wanted to proceed that far, but the "rapists" were never informed of that uncertainty and committed the "rapes" without knowing they had done so. None of those women ever told me about anything they had done to let their rapists know that they did not want to go as far as having sex.

Later, I was a police officer and a female college student came into the office and reported that she had been sodomized while very intoxicated and named a middle eastern gentleman as the perpetrator. She said she had too much to drink and he raped her in a frat house. She could remember a poster that was on the wall. He was identified and the poster was in one of the rooms, but not the "rapists" room. She made a sworn statement and he was arrested for aggravated sodomy (punishable by 20 years in prison). She informed some of her friends, who informed almost everyone, put up posters all over the local campus calling for his conviction, castration, etc. This went on for a couple of days. Then a guy who had been out of town since the day she reported the rape and had no idea what was going on, called to tell her how much he had enjoyed their night of new love and hoped that they could continue their relationship. She liked that guy and no longer considered the incident a rape. She refused to pursue charges on that guy.

To her credit, she came forward and rescinded her statement so that the real victim of the incident did not spend most of his life in prison. It turned out that he had spoken to her on the stairs of the frat house before she met up with Prince Charming. She had two fragmented memories from the night, that conversation and seeing the poster on the wall as she was being brutally sodomized and put those two incidents together. Those incidents made me rather skeptical about rape claims.

The only real argument I have heard for not prosecuting false rape accusers is that fear of punishment will make it less likely for a false rape accuser to admit what they did.

I would much rather a false accuser admit it, because they know they will not be punished.

That said, if they lie on the stand, there are always perjury laws.

I think this discussion needs to focus more on the gray area of rape accusations rather than the black and white. If the facts are that a man raped a woman I'm sure both sides will agree he deserves to be punished, and if it's a known fact that a woman false accuses a man of rape, I'd like to think both sides can also agree on the proper course.

Lisa Longstaff's comment seems more to mean to be regarding the cases when a rape occurs and there's little evidence of it or not enough to convict, or at least the evidence is ambiguous - ie the majority of cases. I can easily imagine scenarios where all the court has is two people's words against each other and evidence that is not clearly one way or another. In these cases, I can also see why prosecuting women who "lie" might be a bad idea as even a guilty man threatening a counterclaim can deter reports of rape. It WOULD put women off reporting real rape if they possibly face the same punishments as "rapist" if the cops on their case aren't competent, or if they waited too long, or a number of other scenarios. Law enforcement officials across the board will tell you that real life is not like CSI where everything's cut and clear.

I'm not saying false rape accusers should not be prosecuted, just that a law that prosecutes false rape accusers without deterring real rape reports would be really hard to write/enforce in practice

Rule of law means the same law applies to everybody as written. It wouldn't be unreasonable to argue that parliament should change the law and write in an exception for false rape claims. However saying that the law shouldn't be applied as written is an affront to the rule of law.

For instance I don't believe that pirating music should be a crime, but I'm not going to rail against the RIAA for taking people who pirate music to court. Sure it's mean and hurtful and stupid, but the solution is to change the law, not to challenge its rule.

Unfortunately, as much as I would love for this to be a black and white issue its not. There is no way for someone to definitively tell whether a woman has been raped or not. What constitutes a false rape claim? One for which a man is acquitted of rape, or one in which it becomes clear that the woman straight up lied? Also, how clear is it really going to be that a woman has lied? To stop this injustice against men are we really willing to run the risk of possibly putting a rape victim behind bars for coming forward?

I'm not saying one way or the other that women should or should not be prosecuted for a rape claim. A false rape claim is a disgusting thing and so is rape. I think the issue is more that we need to protect people who are charged with rape.
