Looking for some guidance. My wife has decided to split as of last week. While this isn't what I want, she is sure. So, I am in the process of moving out. We started talking about child custody split and eventually assets/debt. One big sticking point is our house. The equity currently is approximately 100% of what is owed. The options I provided were 1) sell the house (not going to happen, this is a great family home) 2) refinance and pay out equity to each 3) Leave both on mortgage until the air clears.

My STBXW used a form on the internet to draft a separation agreement so that she can take that to apply for refinance. In addition to all of our debt and who is responsible for what, it has this regarding the house:

If (W) is approved for refinance, she will pay (H) $X and he will relinquish ownership, etc.

If (W) is not approved for refinance, both will remain on mortgage until such time as (W) is approved.

So, my question is: Am I being rushed into this thing? Am I putting myself in a bad spot? I have no reason to think she will be malicious, but I'm very emotionally raw right now and not thinking straight.

Also, I know some folks will say "Get a lawyer", but I don't have one available currently, so there's that.
